Omnibus vs. Segregated Crypto Wallets: What the Ledger Really Decides

Omnibus wallets pool customers’ crypto on-chain, while segregated structures use separate customer wallets. Internal ledgers track customer interests, but agreements and local law shape legal treatment.

An omnibus wallet pools multiple customers’ crypto-assets on-chain; a segregated wallet structure gives each customer separate on-chain wallets. In either setup, a custodian can keep an internal ledger assigning balances to individual customers. That ledger is essential when assets are pooled, but it does not by itself determine who legally owns the assets or how they would be treated if the custodian became insolvent. The custody agreement and applicable law matter too.

What is an omnibus crypto wallet?

An omnibus wallet is an on-chain wallet—or set of wallets—that holds crypto-assets for multiple customers together. “Omnibus” describes how assets are grouped on-chain; it does not mean the custodian can leave customer balances unidentified in its records.

A segregated wallet structure instead gives each customer separate on-chain wallets. This is a distinction about wallet topology, not necessarily a statement about legal ownership or insolvency protection.

How does a custodian track balances when coins are pooled?

The custodian uses customer-level records to attribute each customer’s interest in the pooled assets. Those records may include an internal ledger account for each customer, together with records of deposits, withdrawals, and adjustments. New York’s Department of Financial Services describes customer-only omnibus wallets paired with internal ledger accounts as a permissible custody pattern in its virtual-currency supervisory context. It expects records and a clear audit trail that keep each customer’s beneficial interest evident and current. NYDFS updated guidance, September 30, 2025.

The ledger is therefore operationally important: it supplies the customer-level accounting that the shared on-chain wallet does not show by itself. But a balance recorded in a ledger is not, on its own, a ruling on legal ownership. The custody agreement, the provider’s legal role, and the law governing the arrangement also matter.

What does “segregated” mean?

Two different separations are easy to confuse:

  • Customer-to-customer separation: whether each customer has separate on-chain wallets or multiple customers’ holdings are pooled in omnibus wallets.
  • Customer-to-firm separation: whether customer assets are kept apart from the custodian’s own proprietary assets, both on-chain and in the firm’s records.

Customers can share an omnibus wallet while their assets remain separate from the custodian’s corporate assets. NYDFS guidance describes customer-only omnibus wallets alongside customer-specific wallets, and expects customer assets to remain separate from corporate assets on-chain and in internal ledger accounts. Its earlier guidance also discusses these structures in the context of insolvency protection. NYDFS guidance, January 23, 2023.

Omnibus and segregated wallets: what changes?

Question Omnibus wallet Segregated wallet structure
On-chain arrangement Multiple customers’ assets are pooled in one or more wallets. Each customer has separate on-chain wallets.
Customer-level accounting Internal records are needed to attribute each customer’s interest in pooled assets. A custodian may also use internal records alongside separate wallets.
Separation from custodian’s assets Must be considered separately from whether customer assets are pooled with one another. Must also be considered separately from whether each customer has a separate wallet.
Legal ownership and insolvency treatment Not determined by the omnibus label alone; the agreement and applicable law matter. Not determined by separate wallets alone; the agreement and applicable law matter.

The official sources cited here do not establish a general speed, cost, privacy, or security advantage for either wallet design. Those outcomes depend on a particular provider’s implementation and terms; the wallet label alone is not enough to compare them.

Are segregated wallets safer if a custodian fails?

A separate wallet can make an on-chain arrangement easier to distinguish, but wallet separation alone does not settle whether assets are legally treated as customer property or how they would be handled in insolvency. A useful assessment includes the custodian’s legal role, the custody agreement, the records supporting each customer’s interest, and the law that applies.

Rules are jurisdiction- and service-specific. For authorized crypto-asset service providers providing custody and administration on behalf of clients, EU MiCA Article 75 requires client holdings to be separated from the provider’s holdings on the distributed ledger and requires legal and operational segregation from the provider’s estate in clients’ interests under applicable law. The article also addresses return procedures and liability in specified circumstances. ESMA’s MiCA Article 75 text.

In Australia, ASIC says omnibus custody may be permitted for certain financial products under conditions, while client assets still must be separated from firm assets. The applicable regime depends on the asset’s classification and the custody service. ASIC guidance on digital assets, financial products, and services.

Can a customer’s crypto share a wallet with other customers’ crypto?

That depends on the service and applicable rules. For the EU, Commission Delegated Regulation (EU) 2025/303 addresses disclosures about how client crypto-assets are segregated, including how an entity handles omnibus accounts containing assets of multiple clients. A separate EU question concerns whether a crypto-asset service provider acting as custodian may hold client assets in the same wallets as crypto-assets belonging to entities in its group. ESMA’s answer, dated June 17, 2025, points to MiCA Article 75(7)’s separation requirement between client holdings and the provider’s own holdings. That answer concerns the stated group-entity question and should not be read as a universal rule for every jurisdiction or custody arrangement. ESMA Q&A 2578.

What should customers check in a custody arrangement?

  • Whether the provider uses customer-specific wallets or customer-only omnibus wallets.
  • How its records map customer balances to assets, and whether they provide a clear audit trail.
  • Whether customer assets are kept separate from the provider’s proprietary assets, both on-chain and in its books and records.
  • What the agreement says about the provider’s role, ownership, permitted use, sub-custody, and procedures for returning assets.
  • What the provider discloses about pooling and the risks relevant to the arrangement.
  • Which jurisdiction’s rules apply to the provider, service, and assets.

The practical distinction is straightforward: wallet structure describes where assets sit on-chain; the ledger records each customer’s attributed interest; legal treatment depends on the agreement and applicable law. NYDFS, MiCA, and ASIC materials address different jurisdictions and services, so no single rule should be assumed to apply everywhere.
