An MLS data license gives a platform only the permissions described in the applicable agreement; access credentials or payment do not transfer ownership or create an unrestricted right to reuse listings. To assess what a platform may do, separate the broker’s authority to submit listing material, copyright in original content or qualifying compilations, and the contract governing the feed.
What “owning MLS data” can mean
There is no single ownership right that answers every question about an MLS feed. A platform may need to assess several distinct interests:
As an Amazon Associate I earn from qualifying purchases.
| Layer | What it concerns | What it does not establish by itself |
|---|---|---|
| Broker and seller agreements | The listing agreement and the broker’s authority to submit listing material to an MLS. | That the broker owns every item in the listing, or that a platform can use submitted material for any purpose. |
| Copyright in content | Rights in original expression, such as qualifying text or photographs, when the claimant owns that material. | Copyright in every factual field, or ownership of all the content by the MLS. |
| Copyright in a compilation | Potential protection for an original selection, coordination, or arrangement of material in a qualifying database compilation. | Copyright in each underlying fact or record simply because it appears in the database. |
| Feed contract and license | Permission to receive, store, display, transform, or share data under specified conditions. | Ownership of the feed, its contents, or rights beyond the license’s scope. |
NAR’s Handbook on Multiple Listing Policy, Policy Statement 7.85, dated January 1, 2026, says an MLS cannot require participants to transfer ownership rights in listings or listing content as a condition of participation. It allows an MLS to require licenses necessary for storage, reproduction, compilation, and distribution to the extent needed for the MLS’s defined purposes. That policy distinguishes an ownership transfer from a purpose-limited license; it does not supply the terms of a particular platform’s agreement.

The U.S. Copyright Office distinguishes individual facts from original expression. An address or asking price, considered as an individual fact, is not protected by copyright. A compilation may qualify for protection if its selection, coordination, or arrangement represents original authorship. Copyrightable content within records may also qualify when the claimant owns it.
#1 Best Overall
This distinction is not a blanket permission to copy or reuse a feed. A contract may restrict access or use even where individual facts are not copyrightable, and third-party rights in content may remain relevant. The copyright status of one field does not determine the rights in a whole database or the terms under which a platform received it.
Listing media needs its own rights check
A broker’s authority to submit a listing does not necessarily include authority to license every asset in it for every downstream use. Photographs, video, virtual tours, floor plans, and other contributed material may come from photographers or vendors under separate agreements. NAR’s policy guidance says the listing broker should own or have authority to license listing content. For a platform, that makes it important to trace the rights and permitted uses of media separately from factual fields.

What an MLS feed license does—and does not—authorize
The actual written grant controls. A license may define which recipients can access data, what products or purposes are permitted, and what conditions apply to display, storage, or sharing. Do not infer a broader right from the fact that a platform has credentials, pays a fee, or can technically retrieve a field.

- Purpose and product: Which activities are expressly covered—such as a brokerage IDX display, VOW, back-office tool, analytics product, valuation service, syndication, internal research, model training, or resale?
- Eligible users and recipients: Who may receive or access the data, and does the permission depend on a participant or broker relationship?
- Scope of content: Which MLSs, listing statuses, fields, photos, and other media are included?
- Display obligations: What rules govern public display, attribution, refreshes, and corrections?
- Data lifecycle: What do the terms say about caching, retention, derived data, and deletion, including at termination?
- Sharing and oversight: May the platform use vendors, sublicense, redistribute, or share downstream? Are there audit or reporting requirements?
- Commercial and risk terms: What are the territory, term, fees, termination rights, warranties, and indemnities, and which party bears each obligation?
These are practical comparison points, not a universal MLS contract checklist. The sources do not establish a standard license or uniform terms; confirm the operative agreement and rules with each relevant MLS.
IDX, VOW, and uses beyond brokerage display
IDX: limited display under applicable MLS rules
NAR describes Internet Data Exchange (IDX) as limited electronic display of listings by MLS participants under applicable policy requirements. The permission and conditions depend on the relevant MLS’s rules and agreements. A vendor or platform that helps build a participant’s site should not assume it has inherited the participant’s permission for a different product, recipient, or purpose.
Rank #4
VOW: a brokerage service with a defined relationship
NAR’s Virtual Office Website (VOW) policy concerns a participant’s brokerage website or feature serving a consumer after a broker-consumer relationship has been established as defined by state law. NAR describes the relevant MLS data as limited to establishing and operating a VOW on the participant’s behalf. That context is not a general license for an open consumer portal or a platform-wide right to reuse the feed.
Other products require an express basis
For analytics, automated valuation models, data products, syndication, internal research, AI or model training, or resale, check whether the written license covers the particular purpose, fields, media, and recipients. The reviewed policy materials do not establish blanket permission for these activities. NAR Policy Statement 7.85 addresses use outside the MLS’s defined purposes through participant consent, subject to the policy’s conditions; it should not be read as a substitute for checking the actual agreement.

Local rules can change the practical answer
MLS PIN’s published rules illustrate how local terms can combine a service-purpose license with participant warranties. In that example, filing data and images triggers license and warranty provisions, while a participant’s user fee grants use under the rules rather than ownership of the MLS publication. Those are MLS PIN terms, not evidence that every MLS uses the same grant, warranties, or fee structure. The relevant MLS’s current rules and the executed agreement are the documents to assess.
RESO standards are not data-use licenses
The Real Estate Standards Organization (RESO) helps standardize the structure and transport of real estate data. Its Web API and Data Dictionary can support consistent technical communication, but RESO does not provide an MLS’s real estate data or grant permission to use it. RESO says a recipient arranges data-use and licensing policies with the MLS, then coordinates technical access with that MLS’s provider or staff. Technical interoperability and legal permission are separate steps.
Quick Recap
Before launching a platform feature
- Identify the source and recipient. List every source MLS, the applicable agreement and policy version, the named licensee, and the technical recipient or vendor involved.
- Describe the feature precisely. For each product capability, record its purpose, users, and whether it operates as a participant’s IDX or VOW service or as an independent platform service.
- Map the content and rights chain. Inventory fields, remarks, photos, video, virtual tours, floor plans, and other media. For each, record its origin, rights holder, license scope, attribution requirements, and editing or reuse limits.
- Translate contract terms into operating controls. Confirm the required behavior for display, refreshes, corrections, caching, retention, deletion, vendors, derived data, redistribution, audits, and security against the actual agreement.
- Resolve gaps before enabling access. If the grant is unclear for a purpose, recipient, or content type, seek clarification from the relevant MLS. Have counsel familiar with copyright and real estate data agreements review ambiguous ownership, third-party media, or nonstandard uses.
