In the United States, no single website setting settles whether AI training on site content is lawful. Copyright law, website terms, and technical bot controls address different questions: whether protected expression was used lawfully, whether a site’s conditions may apply, and whether a crawler is asked or technically prevented from accessing pages. A robots.txt rule can express a preference to compliant crawlers, but it is not a lock.
Can AI companies train on copyrighted websites?
Sometimes the material on a website is protected by copyright, but that fact alone does not decide whether a particular use to train an AI system infringes. The copyright question is whether protected expression was copied or used with permission or under a legal defense. In the United States, fair use is a fact-specific analysis; it is not established that all AI training is fair use, or that all training on copyrighted material is infringement.

The U.S. Copyright Office’s May 2025 Part 3 report analyzes generative AI training, licensing, liability, and opt-out approaches. Its study page described the report as pre-publication and said a final version would follow; whether a final version has since appeared is not established here. The report also recounts differing stakeholder views about metadata, terms, and technical flags, as well as concerns about their removal, platform-level limits, and whether robots.txt was designed for AI ingestion. Those are positions discussed in the report, not a universal legal rule for any particular signal.

The Copyright Office said it received more than 10,000 comments during its AI study comment process in 2023. That number measures submissions, not the strength or legal acceptance of any one position.

Training inputs and AI-generated outputs are separate questions
The Office’s Part 2 release, issued January 29, 2025, addressed copyright in AI outputs. It said existing copyright principles can be applied to generative AI outputs and that protection requires sufficient human-determined expressive elements. That does not decide whether material used as training input was lawfully acquired or used. In the release, Register of Copyrights and Director Shira Perlmutter said: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection. Extending protection to material whose expressive elements are determined by a machine, however, would undermine rather than further the constitutional goals of copyright.”
What do copyright, website terms, and bot controls each do?
| Layer | What it addresses | What it does not settle by itself |
|---|---|---|
| Copyright | Whether protected expression was copied or used with permission or under a defense, including fact-specific fair use. | Whether a website’s terms formed a contract, or whether a crawler followed a site’s technical instructions. |
| Website terms | Conditions or prohibitions a site communicates and possible contract or other claims. | Whether every crawler is bound, whether the terms resolve copyright liability, or whether access is technically blocked. |
| Robots.txt | A standard way to state crawler instructions that compliant crawlers are requested to honor. | Server-side prevention of access or a definitive answer to copyright or contract questions. |
| Server, network, or service controls | Technical enforcement intended to prevent or limit access. | Whether later use of content is lawful under copyright or contract law. |
The distinction matters in both directions: a copyright defense does not automatically resolve a contract claim or how content was obtained, and a terms clause or robots.txt file does not automatically establish or defeat copyright liability.

Does robots.txt stop AI bots from using site content?
No. RFC 9309, the Internet standard for the Robots Exclusion Protocol, describes crawler rules as instructions crawlers are “requested to honor.” A robots.txt file is useful for communicating a site’s preferred crawler behavior and for compliant bots to discover those instructions. The site does not enforce the file against a client that ignores it, so it is a signal rather than an access-control mechanism.

Those controls address access; they do not, by themselves, decide whether any content already collected may be used for training or whether that use is lawful.
Training and search crawlers may be treated separately
Provider crawler policies are not interchangeable. OpenAI documents separate crawlers named GPTBot and OAI-SearchBot and describes allowing search crawling while disallowing training-related crawling. Anthropic identifies ClaudeBot as a crawler that may collect content potentially contributing to model training and says its bots honor robots.txt. These are company statements about their own systems, not guarantees about every crawler or proof of the origin of every training dataset. Bot names and policies can change, so check each provider’s current documentation before configuring rules.
Can website terms ban AI training?
Terms can state conditions or prohibit automated access or use, and may be relevant to contract or other claims. But the mere presence of a terms page does not establish that its provisions bind every crawler. The language and presentation, notice, assent, the conduct at issue, and governing law can all matter. No universal rule establishes that a terms clause binds every crawler or resolves copyright questions.

Cloudflare publishes sample terms addressing AI-related automated scraping. That is vendor guidance and an illustrative starting point, not a court ruling or a guarantee of legal effect. A publisher considering such terms should assess whether their wording, notice, and technical controls align with the outcome sought; legal effect depends on the specific facts and applicable law.

What does the Ziff Davis robots.txt ruling establish?
In a 2025 opinion, the U.S. District Court for the Southern District of New York considered whether allegations about robots.txt established a technological measure that effectively controlled access for a claim under section 1201 of the Digital Millennium Copyright Act. The court concluded they did not for the claim as pleaded, reasoning that the protocol requires affirmative action by a bot to impede access.

That is a limited ruling about the pleaded DMCA claim and record. It does not determine every contract, copyright, or state-law issue, and it does not mean robots.txt can never be relevant evidence. Subsequent proceedings in the case are not established here.
How can a site owner choose an approach?
Start with the outcome you want, then match the measure to the question it can address. A preference for a compliant crawler, a contractual restriction, and a technical block are different mechanisms; none should be treated as a substitute for the others.
- To communicate a crawler preference: publish clear robots.txt instructions and identify which crawler and purpose the instructions concern. A compliant crawler may honor them; a noncompliant one can ignore them.
- To state site conditions: write terms that clearly address the conduct and use the site owner wants to restrict. Consider how the terms are presented and how notice and assent may be shown; the existence of terms alone does not answer whether they apply.
- To restrict access: use server-, network-, or service-level controls. These are the relevant layer for technical enforcement, rather than relying on a crawler request protocol.
- To separate search from training-related crawling: check the current documentation for each provider and configure the relevant crawler instructions accordingly. OpenAI’s documented distinction between OAI-SearchBot and GPTBot illustrates why a blanket rule may not express the desired policy.
- To address copyright risk: evaluate the specific material, copying or use, permissions, and any applicable defense. Neither a robots.txt entry nor a terms clause supplies a universal copyright answer.
For a defensible policy, keep records of the terms and crawler instructions in effect, the notice presented, and any technical access controls. These records can help show what the site communicated and enforced, though they do not predetermine a legal outcome.
