What the patent covered
Patent No. 7,069,560 is titled “Highly scalable software-based architecture for communication and cooperation among distributed electronic agents.” In practical terms, it describes a software architecture in which flexible, autonomous electronic agents cooperate to complete tasks.
That is broader than voice recognition. The verdict did not say Microsoft copied Siri’s name, interface or entire product. It concerned specified patent claims about how distributed software components could communicate and work together.

The lawsuit originally included U.S. Patent No. 6,851,115. Before trial, the court granted Microsoft summary judgment of non-infringement on every asserted claim of that patent. The jury’s $242 million decision therefore concerned the ’560 patent only. The court’s order sets out that distinction.
Why Cortana was part of the dispute
IPA accused systems used with Microsoft’s Cortana assistant, including Windows 10 client devices and Microsoft servers that processed Cortana commands. The litigation referred to two relevant implementations as the Legacy Architecture and Cortex Architecture.
The allegation focused on the client-and-server architecture used to process requests, not simply on Cortana hearing speech or answering a question. The case therefore addressed historical software implementation details rather than every Microsoft product marketed as an AI assistant.
Who sued Microsoft?
IPA Technologies was described in reporting as a subsidiary of patent-licensing company Wi-LAN. IPA had acquired the relevant patents from SRI International’s Siri-related business. Apple was not the plaintiff in this Microsoft case. Calling the dispute “Apple’s Siri patent lawsuit” would incorrectly identify the litigating party and oversimplify the patent’s ownership history.
How Microsoft defended the case
Microsoft maintained that Cortana-related systems did not infringe and argued that the patent claims were invalid. It also challenged IPA’s proof that the server software performed every required step of the claimed method.
After the verdict, Microsoft attacked both liability and damages. Its post-trial arguments included these points:
- IPA had not proved infringement of all required claim elements.
- The patent was invalid.
- IPA’s damages expert used an unreliable methodology.
- The $242 million award was grossly excessive.
- The court’s damages instructions were legally defective.

Did the patent’s expiration matter?
Yes, but expiration did not erase potential liability for earlier conduct. The ’560 patent expired in January 2019, according to post-verdict legal reporting. A patent can support damages for infringement that occurred while it was enforceable even after the patent expires.
Expiration generally prevents a patent owner from obtaining a forward-looking injunction requiring continued users to stop using the invention after the patent term ends. It also means the verdict was about alleged historical use, not an order controlling Microsoft’s future products.

Did the verdict shut down Cortana?
