The answer can depend on your country, how an emulator was developed, where its firmware and game files came from, whether security protections are bypassed, and the terms of Sony’s software licence. Sony’s cited agreement licenses PS5 system software for use on a PS5 system; it does not establish the technical requirements of third-party emulators.
Why “is emulation legal?” has more than one answer
Emulation can involve several separate legal questions. Whether an emulator program is lawful is not the same as whether its development involved lawful reverse engineering, whether a user may obtain or use Sony firmware or game files, whether copying or circumvention is permitted, or whether use complies with a software licence. A conclusion about one issue does not automatically resolve the others.

The emulator software and how it was developed
The legality of independently written emulator software can depend on the relevant jurisdiction and the way it was created. A historical U.S. court decision involving an original PlayStation emulator is discussed below, but it is not a blanket ruling about PS5 emulators or every method of developing one.
Firmware and game files
Acquiring or using system software and game files raises questions distinct from whether emulator software itself is lawful. The sources cited here do not establish that owning a PS5 game, disc, or console automatically authorizes downloading a game image or using Sony firmware outside the terms that apply to it.

Security protections and contract terms
Bypassing technological protections can raise a separate legal issue, including under anti-circumvention rules where applicable. A licence agreement can also set contractual terms for using software. Neither question is answered simply by saying that an emulator exists or that the user owns a copy of a game.
What Sony’s PS5 software licence says
Sony Interactive Entertainment Inc.’s cited PlayStation 5 System Software Licence Agreement is the Indonesia English agreement, accessed October 4, 2026. It says, “SIE Inc grants you a non-exclusive, non-commercial right to use System Software solely on your PS5 system.” The agreement also reserves Sony’s intellectual-property rights and restricts, among other activities, reverse engineering, use with unauthorized or modified software, circumvention of PS5 security or authentication, and obtaining system software through non-authorized channels. It states that restrictions apply to the greatest extent permitted by the user’s jurisdiction.
This is evidence of Sony’s contractual position under that agreement, not a complete answer to every copyright, anti-circumvention, or fair-use question. The cited page is specific to Indonesia in English; users elsewhere should check the agreement applicable in their location. Sony also says the agreement may change and that the latest version supersedes earlier versions.
What the cited U.S. DMCA exemption does—and does not—cover
The U.S. Copyright Office’s 37 CFR § 201.40 includes a narrow video-game exemption at subsection (b)(19). It addresses specified circumstances involving lawfully acquired complete games whose external server support has ceased, local gameplay, and preservation by eligible libraries, archives, or museums, subject to additional requirements and definitions.
That provision is not a general personal-use exemption for emulating any commercial game, copying a disc, or circumventing protections on a currently supported game. Whether a particular activity falls within an exemption requires checking the regulation’s conditions and the facts; the provision should not be read more broadly than its text.

Why the Connectix case is not a PS5 safe harbor
Sony v. Connectix concerned development of an emulator for the original PlayStation and intermediate copying of BIOS material. A 2026 Cardozo Arts & Entertainment Law Journal article summarizes the Ninth Circuit result as finding those intermediate copies fair use on the facts of that dispute.
That case was not about PS5 software, and it does not decide whether an end user may obtain firmware or game files, bypass protections, or use a particular emulator today. Its result should not be treated as a universal rule for other consoles, other conduct, or other jurisdictions.

Do you need a PS5 console or a game disc?
The sources establish the official route for using PS5 system software under Sony’s cited agreement: use it on a PS5 system. They do not establish that a PS5 is technically required to run an emulator. Nor do they establish that a physical game disc is required for emulation, that owning one authorizes a downloaded copy, or that any specific PS5 game can be dumped and played in a named emulator.
| Route | What the available information establishes | What remains unresolved |
|---|---|---|
| Official gameplay on a PS5 | Sony’s cited Indonesia English agreement licenses system software for use solely on a PS5 system. | For users elsewhere, the applicable local agreement and laws should be checked. |
| Third-party PS5 emulation | No cited source verifies a currently working PS5 emulator or its requirements. | Whether a console, physical disc, particular firmware, or game-file method is needed depends on the specific emulator and game; none is established here. |
What to check before relying on a legal answer
- Your jurisdiction: copyright, anti-circumvention rules, and enforceability of licence terms vary by location.
- The specific emulator: identify the software and consider how it was developed; the cited Connectix dispute concerned a different console and facts.
- Every file’s source and use: determine how system software and game files were obtained and what licence terms apply. Ownership of a disc or console does not, by itself, settle those questions.
- Any circumvention involved: assess whether the method bypasses a technological protection and whether a specific exception applies. The cited U.S. exemption is conditional, not a general emulation permission.
- Current documentation and terms: emulator requirements and Sony’s licence can change. The sources cited here do not verify current emulator compatibility, extraction methods, or a physical-disc requirement.
For a decision with legal consequences, consult a qualified lawyer in your jurisdiction with the emulator, file sources, and intended method specified.
