A GST-bearing purchase is not automatically creditable: check the recipient’s registration, business use, type of supply, evidence, receipt, return and deadline for the relevant tax period.
Who can claim input tax credit under GST?
Section 16(1) of the Central Goods and Services Tax Act, 2017 gives a registered person the general entitlement to credit for input tax on goods or services “used or intended to be used in the course or furtherance of his business.” That entitlement is subject to the Act’s conditions and restrictions, including section 17’s apportionment rules and blocked-credit list. Read the CBIC text of the CGST Act, Chapter V alongside the facts of the transaction.

In practice, assess each purchase rather than treating “business expense” as a sufficient test. A cost can be business-related yet partly attributable to exempt supplies, include personal use, or fall within a blocked category. Exceptions may also change the result.
Eligibility checklist: the conditions to test for each claim

- Permitted category: Check section 17 for apportionment and section 17(5) for blocked credits, including any applicable exception.
- Prescribed document: Hold an eligible invoice, debit note, bill of entry or specified Input Service Distributor (ISD) document, as applicable.
- Receipt: Confirm that the goods or services have been received. For goods delivered to another person on the recipient’s direction, the Act provides a deemed-receipt rule in specified circumstances.
- Tax and return conditions: Check the statutory condition concerning payment of the tax charged on the supply to government, and ensure the recipient has furnished the return under section 39.
- Time limit: Verify the claim against section 16(4), the relevant financial year and annual-return date, and any narrowly applicable statutory relief.
- Evidence: Keep records that support the invoice, receipt, business use, allocation and payment history.
Section 16 also addresses particular situations. If goods covered by an invoice arrive in lots or instalments, credit is available on receipt of the last lot or instalment. If the recipient does not pay the supplier the value of the supply plus tax within 180 days of the invoice date, the required credit amount must be added to output tax liability with interest as prescribed; the recipient may avail the credit again after making payment. The CBIC Input Tax Credit Rules set out the related reversal procedure. A recipient also cannot claim ITC on the tax component of capital goods if depreciation has been claimed on that same tax component under income-tax law.
When is ITC apportioned rather than fully available?
Apportionment is different from a categorical block. Under section 17(1), credit attributable to non-business use is restricted to the business-attributable amount. Under section 17(2), where inputs or input services support both taxable supplies—including zero-rated supplies—and exempt supplies, only the portion attributable to taxable supplies is generally available. The prescribed method determines the allocation; do not assume that one invoice serving mixed uses is either wholly creditable or wholly blocked.

Which credits are blocked under section 17(5)?
Section 17(5) names categories for which ITC is generally unavailable, but several categories have defined exceptions. The following is a practical overview, not an exhaustive statement of every statutory condition. Apply the Act’s exact wording to the transaction and period.
- Motor vehicles and other conveyances: Credit is generally blocked, with exceptions that include vehicles or conveyances used for further taxable supply, passenger transportation, training drivers or operators, and transportation of goods.
- Food and beverages, outdoor catering, beauty treatment, health services, cosmetic and plastic surgery: Credit is generally blocked, subject to exceptions including use for making an outward taxable supply of the same category or as an element of a taxable composite or mixed supply.
- Club, health and fitness-centre membership: Credit is generally blocked.
- Rent-a-cab, life insurance and health insurance: Credit is generally blocked, subject to specified exceptions, including certain benefits an employer must provide under applicable law and specified same-category taxable outward supplies.
- Employee travel benefits: Credit is generally blocked for travel benefits extended to employees on vacation, such as leave or home travel concession.
- Construction-related works contracts and property: Specified works-contract services used for construction of immovable property are blocked, as are goods or services used for construction of immovable property on one’s own account, even when used in the course or furtherance of business. The Act provides relevant rules for plant and machinery and for works-contract supplies used for further works-contract services. Its construction explanation includes reconstruction, renovation, additions, alterations or repairs to the extent capitalized. The plant-and-machinery definition also has inclusions and exclusions, so neither “all construction inputs are blocked” nor “all machinery inputs qualify” is a safe general rule.
- Composition-tax supplies: Credit is blocked for goods or services on which tax has been paid under the composition scheme.
- Supplies to a non-resident taxable person: Credit is generally blocked, except for imported goods.
- Personal consumption: Credit is blocked for goods or services used for personal consumption.
- Losses, write-offs and gifts: Credit is blocked for goods lost, stolen, destroyed, written off, gifted or given as free samples.
- Specified tax liabilities: Credit is blocked for taxes paid under sections 74, 129 and 130.
For the statutory list and its qualifications, refer to Chapter V of the CGST Act on the CBIC site. When a purchase appears to fit one of these categories, identify the specific exception relied on rather than assuming that ordinary business use overrides the block.

What documents support an ITC claim?
The CBIC ITC rules recognize several document types on which credit may be availed, depending on the transaction:
- A supplier’s tax invoice issued under section 31.
- A debit note issued under section 34.
- A bill of entry or another prescribed customs document for import IGST.
- Specified ISD invoices or credit notes.
For a standard tax invoice, use the CBIC invoice rules as a practical checklist. Relevant particulars include the supplier’s name, address and GSTIN; a unique serial number and issue date; recipient details; HSN or service accounting code as applicable; a description and, where relevant, quantity; total and taxable value; tax rate and tax amount; place of supply for an inter-State supply; delivery address if different; reverse-charge status; and the supplier’s signature or digital signature. Invoice requirements have special cases and notified variations, so this is not an exhaustive checklist for every document type.

A document alone does not establish eligibility. Match it to evidence that the goods or services were received and used for business, and retain relevant payment evidence. Reconcile the purchase register with supplier-reported invoice data and the return statements applicable to the tax period. Supplier-reporting and portal procedures can change, so verify the live requirements for the period instead of relying on a workflow label as a permanent rule.
Where consolidated input services are directly used by GST registrations in more than one state, CBIC’s Sectoral FAQs say the credit should be appropriately invoiced or distributed through the ISD mechanism to the distinct persons who actually used those services. Confirm the ISD registration and distribution rules applicable to the period before acting on a multi-state allocation.

How long must GST records be kept?
CBIC’s Accounts and Records Rules address the preservation of accounts and associated invoices, bills of supply, credit and debit notes, and delivery challans for the period provided by section 36. They also state that books must be produced on demand. The applicable retention duration should be checked against the current section 36 text; do not assume a fixed number of years from a summary of the rules.
What is the deadline to claim ITC?
The general section 16(4) deadline stated in CBIC’s Circular No. 237/31/2024-GST, dated 15 October 2024, is 30 November following the end of the financial year to which the invoice or debit note pertains, or the date the relevant annual return is furnished, whichever is earlier. The date is not a blanket extra period: if the relevant annual return is furnished first, that earlier event governs.
The circular also discusses retrospective relief introduced by the Finance (No. 2) Act, 2024 through sections 16(5) and 16(6) for specified cases. That relief is limited and fact-dependent; it should not be treated as a general extension for late claims. The CBIC Act webpage presents older section 16(4) wording referring to the September return, so the 2024 circular is important when stating the amended general deadline.
A practical file review before claiming credit
- Confirm the claimant, GST registration and tax period.
- Link each document to the goods or service received and explain its business use.
- Allocate mixed business/non-business or taxable/exempt use under the applicable rules.
- Check the section 17(5) category and document any exception relied on.
- Reconcile invoice data, receipt evidence, return information and payment records.
- Check the 180-day supplier-payment rule where applicable and track any reversal and re-availment.
- Check the applicable section 16(4) deadline and whether any specific statutory relief covers the facts.
This explainer covers the central Indian GST framework. The result for an actual claim can depend on the transaction, registration, use, tax period and statutory exceptions; check the law and applicable procedures for the relevant period, and obtain qualified GST advice where the treatment is uncertain.
