The construction-service valuation option used 30% of the total amount, producing 4.5%. Those percentages applied to different valuation routes and credit conditions; neither, by itself, establishes which option was cheaper overall. This is a comparison of India’s pre-GST service-tax regime, not a method for calculating tax on a current construction contract.
What the two options meant
The GST Council’s 2018 retrospective describes two routes for service-tax assessment on construction of a complex, building, civil structure, or parts thereof. One was a works-contract composition option; the other valued the service under the construction-service entry in serial no. 10 of Notification 26/2012-ST. The Council’s figures are specific to that described context and period, not a universal rule for every construction contract.

| Historical route | Valuation base in the Council’s comparison | Effective service tax at a 15% headline rate | Input tax credit described by the Council | Land treatment in the comparison |
|---|---|---|---|---|
| Works-contract composition option for original works under Rule 2A | 40% of value | 6% of full value (40% × 15%) | Credit on capital goods and input services was available; credit of duties or cess on inputs used in the works contract was unavailable. | Included |
| Construction-service valuation under serial no. 10 of Notification 26/2012-ST | 30% of total amount | 4.5% of full value (30% × 15%) | Input tax credit on inputs was unavailable. | Included |
These figures are reported in the GST Council’s 31st meeting agenda note (2018). Its 15% headline rate is part of the historical calculation; it should not be assumed to describe another date or tax regime.

Why the lower percentage does not settle which route was preferable
The construction-service route’s 4.5% effective rate was lower than the composition route’s 6% in the Council’s arithmetic, but the credit treatment differed. The composition option allowed credit on capital goods and input services while denying credit of duties or cess on inputs used in the works contract. The construction-service option denied input tax credit on inputs. A comparison for a particular contract would therefore need to account for the relevant credit eligibility and costs, not just multiply the valuation percentage by the headline rate.

Rule 2A percentages beyond original works
A secondary reproduction of the historical Rule 2A amendment lists these percentages for categories where value was not determined through the actual allocation route:
- Original works: 40% of value.
- Maintenance, repair, reconditioning, restoration, or servicing of goods: 70%.
- Other works contracts: 60%, including specified completion and finishing services.
The Council’s retrospective directly supports the 40% original-works figure used in its comparison. The additional category figures come from Tax Management India’s reproduction of Rule 2A, a secondary source; check the applicable Gazette text before relying on them for a formal legal position or a specific historical date.

State VAT was a separate part of the historical tax burden
Service tax was not the whole tax burden. The Council note says state VAT was payable separately and that states used different methods and options. It describes Maharashtra and Uttar Pradesh as examples. The Council characterized the effective service-tax incidence for the construction options it discussed as around 4–4.5% after considering input-tax-credit availability, while treating state VAT separately. That service-tax range should not be read as a combined service-tax-and-VAT rate.

No. These are pre-GST service-tax valuation routes. Current construction services and composite works contracts are covered by GST entries, whose categories, rates, and conditions vary. The CBIC GST rate table sets out current entries; the relevant treatment depends on the applicable category and contract facts. The old 40% and 30% service-tax bases should not be carried forward as current GST rules.
A contract-specific historical answer also depends on the contract date, state, type of work, valuation facts, and input-credit history. The GST Council note is a retrospective overview, not a ruling on an individual contract.
