पहले पहचानें: live interruption है या archive पर claim?
YouTube सभी live streams को third-party content matches के लिए scan करता है। Licensed footage इस्तेमाल करने पर भी, यदि rights holder ने आपका channel Content ID allowlist में नहीं जोड़ा है, तो stream interrupt हो सकती है। YouTube की सलाह है कि stream से पहले owner से allowlisting माँगें: Copyright issues with live streams।

यदि आपने archive चालू रखा है, तो stream समाप्त होने के बाद उस video पर Content ID claim आ सकता है। Live interruption और बाद में archive पर दिखने वाला claim अलग घटनाएँ हैं: पहले से allowlist कराना भावी claims रोकने में मदद करता है, लेकिन यह किसी मौजूदा claim को अपने आप release नहीं करता। Asset के कई partner owners हों तो हर owner को channel allowlist करना होगा।
Claim का असर और स्थिति YouTube Studio में देखें
YouTube Studio में claim वाले archived video के Restrictions या copyright details खोलकर claimant, claimed segment और लागू policy देखें। Content ID claim video को block, monetize या track कर सकता है; परिणाम देश या क्षेत्र के لحاظ से बदल सकता है। भारत में दिखने वाला असर दूसरे क्षेत्रों में भी समान होगा, यह मानकर न चलें।

Claim, copyright takedown और copyright strike एक ही चीज नहीं हैं। Claim अपने आप strike नहीं है। लेकिन गलत आधार पर dispute करने के बाद claimant removal request भेज सकता है; वैध takedown से video हट सकता है और channel को strike मिल सकती है। यदि Studio में takedown या strike दिखे, तो उसे साधारण claim-release प्रक्रिया न समझें।
Dispute से पहले license का दायरा जाँचें
License की प्रति और शर्तें खोलकर पुष्टि करें कि वही asset, वही उपयोग और वही territory कवर हैं। खास तौर पर देखें कि license में livestream, archive या VOD, monetization अथवा commercial use, अवधि, attribution, edits और sublicensing या redistribution की अनुमति क्या है। Subscription या purchase receipt अकेले यह साबित नहीं करती कि आपके खास stream और archive का उपयोग शामिल है।
दस्तावेज़ और claim का रिकॉर्ड तैयार रखें
- Footage का नाम और asset ID, provider, purchase या subscription receipt, तथा लागू license की प्रति और उसका version या तारीख।
- उपयोग की तारीख, channel ID, stream या archive का URL, claimed timestamp या segment, claimant का नाम और दिखाया गया territory।
- ऐसा संक्षिप्त विवरण कि footage live stream और archive में कैसे इस्तेमाल हुआ।
ये रिकॉर्ड rights holder से बात करने और किसी उचित dispute में अपने अधिकार समझाने में मदद करते हैं, लेकिन claim हटने की गारंटी नहीं देते। YouTube कहता है कि वह तय नहीं कर सकता कि uploader ने content ठीक से license किया था या कोई copyright exception लागू है; इसलिए अपने दस्तावेज़ों से अधिकार का आधार आपको दिखाना होगा। देखें Dispute a copyright claim – Computer।
पहले claimant या licensor से release और allowlisting माँगें
- License provider या claim में दिखाए गए rights holder से संपर्क करें। Asset और claim की पहचान, channel ID, stream या archive URL, claimed segment और license का प्रमाण दें।
- स्पष्ट रूप से दो अलग कार्रवाइयाँ माँगें: मौजूदा archive claim release करना और भविष्य के लिए channel को Content ID allowlist में जोड़ना।
- यदि footage के कई partner owners हैं, तो पता करें कि हर संबंधित owner ने allowlist किया है या नहीं। सिर्फ allowlisting से पुराना claim नहीं हटेगा; उसके लिए अलग release चाहिए।
- यदि जवाब न मिले, license का दायरा अस्पष्ट हो, या claim किसी दूसरे asset अथवा territory के लिए हो, तो उपलब्ध दस्तावेज़ों के आधार पर अगला कदम तय करें। बिना अधिकार-आधार के dispute न भेजें।
सही आधार होने पर YouTube Studio में dispute दर्ज करें
Desktop पर आधिकारिक रास्ता है: YouTube Studio > Content > claim वाला video > Restrictions में claim details > Take action > Dispute। विकल्प और स्क्रीन की भाषा खाते या YouTube के UI बदलाव के अनुसार अलग दिख सकती है। Dispute में वही आधार चुनें जिसे आप सचमुच दस्तावेज़ों या लागू कानून से समर्थन दे सकें।
कब dispute का आधार हो सकता है?
- आपके पास उस इस्तेमाल के लिए सभी आवश्यक अधिकार हैं और license उसकी पुष्टि करता है।
- आपके मामले में copyright exception लागू होती है।
- Content ID ने गलत content match किया है।
Credit देना, clip की copy खरीदना, या video को monetize न करना अपने आप में वैध dispute आधार नहीं है। केवल यह कहना कि footage licensed है पर्याप्त नहीं, यदि license livestream, archive, monetization या संबंधित territory को कवर नहीं करता। YouTube dispute और copyright exception की वैधता का फैसला आपके लिए नहीं करता।
Claimant को जवाब देने के लिए 30 दिन मिलते हैं। Dispute के दौरान YouTube संबंधित revenue अलग रख सकता है: claim लगने के पाँच दिन के भीतर dispute किया जाए तो hold claim की तारीख से शुरू होता है; पाँच दिन के बाद dispute किया जाए तो hold dispute की तारीख से शुरू होता है। यह platform workflow की समय-सीमा है, न कि claim के नतीजे की गारंटी।
भारत में fair dealing को सामान्य छूट न समझें
भारत के Copyright Office की Section 52 जानकारी fair dealing के प्रयोजनों में निजी या व्यक्तिगत उपयोग, आलोचना या समीक्षा, और current events की reporting सूचीबद्ध करती है: Copyright Office: Exceptions। इससे यह निष्कर्ष नहीं निकलता कि सामान्य commercial livestream में licensed stock footage का उपयोग अपने आप किसी exception के अंतर्गत आता है। अपने license का वास्तविक दायरा देखें और परिस्थिति अस्पष्ट होने पर योग्य कानूनी सलाह लें। YouTube Studio का dispute workflow भारतीय अदालत का निर्णय या भारतीय copyright कानून का विकल्प नहीं है।

समस्या आए तो क्या जाँचें?
- लाइसेंस है, फिर भी live stream रुकी: rights holder से पूछें कि आपका सही channel ID Content ID allowlist में है या नहीं। कई partner owners हों तो हर owner से पुष्टि करें।
- Allowlist के बाद भी archive claim दिख रहा है: allowlisting पुराने claim को release नहीं करती। Claimant या licensor से उस claim की अलग release माँगें।
- Claim में गलत segment या claimant दिखता है: timestamp, claimant और territory को अपने asset record से मिलाएँ; पहले provider से ownership और claim की पहचान स्पष्ट कराएँ। गलत match हो तो उपलब्ध आधार के साथ Studio dispute पर विचार करें।
- License है, पर livestream या VOD की शर्त स्पष्ट नहीं: provider से लिखित पुष्टि लें। अधिकार अस्पष्ट होने पर dispute दाखिल न करें।
- Claim को चुनौती देने पर strike का डर है या takedown/strike पहले ही आ चुका है: claim और strike के अंतर को ध्यान में रखें और मामले-विशेष के लिए योग्य कानूनी सलाह लें।
