Short answer: In the United States, a public prediction market offering event contracts generally operates inside the federal derivatives framework. The Commodity Futures Trading Commission (CFTC) says a contract can be a swap or futures contract, and a venue offering those products to the general public must register as a designated contract market (DCM). That registration brings listing, surveillance and market-integrity duties, but it does not approve every contract or settle whether a state may restrict access.
The CFTC withdrew its 2024 event-contract proposal in February 2026 and began a new rulemaking process. Several 2026 notices are proposals or staff advisories rather than final rules. Meanwhile, lawsuits involving Arizona, Connecticut and Illinois leave the federal-state jurisdiction question unsettled. Traders therefore need to check the exact venue, contract, state and current legal status before treating an event contract as available or lawful for them.

What the CFTC means by an event contract
“Event contract” is common industry language, not a defined term in the Commodity Exchange Act (CEA) or CFTC regulations. The legal classification depends on how a contract is structured. In the markets discussed by the CFTC, a binary payoff tied to whether an event occurs may fall within the CEA definitions of a swap or a futures contract.

The CFTC’s March 16, 2026 advance notice of proposed rulemaking (ANPRM) distinguishes a public market on a DCM from swap trading on a swap execution facility (SEF). A SEF is designed for eligible contract participants, while a DCM is the route relevant to a market open to the general public. A platform’s marketing description therefore cannot substitute for checking its federal registration and the status of the individual contract.
Why prices matter to the policy debate
The CFTC’s ANPRM quotes its 2008 Concept Release: prediction markets “function as information aggregation vehicles” because contract prices reflect participants’ aggregate beliefs about whether events will occur. A price can therefore be read as an implied market assessment, but that informational role does not remove the legal obligations attached to a derivative or protect a trader from loss.
What a registered public market must do
A DCM has continuing obligations under the CEA and the CFTC’s regulations, including the Part 38 core principles. Product listing is a central control. Before listing, the exchange must evaluate whether a contract is readily susceptible to manipulation and follow the applicable product-submission process. The CFTC’s Division of Market Oversight reiterated those duties in a March 12, 2026 staff advisory, including in connection with sports-related contracts.
The CFTC also has authority under CEA section 5c(c)(5)(C) to prohibit certain event contracts when it determines that they are contrary to the public interest. Registration is therefore not a blanket federal endorsement. It means the venue is subject to a regulatory regime; each product still has to satisfy listing and integrity requirements, and the agency can scrutinize a category or individual contract.

- Venue status: the market must be a registered DCM when it offers covered swaps or futures to the general public.
- Product review: the DCM must assess manipulation susceptibility and comply with submission requirements.
- Market integrity: the exchange remains responsible for surveillance and for operating consistently with applicable core principles.
- Public-interest authority: the CFTC may act against contracts it determines are contrary to the public interest under the CEA.
These duties concern the exchange and the product. They do not guarantee that a contract will remain listed, that its settlement will be favorable, or that a participant will make money.
What changed during 2026
The legal framework is moving through several different types of agency action. The dates and legal forms matter: a final rule, an ANPRM, a staff advisory and a litigation press release have different effects.
| Date | Action | What it means now |
|---|---|---|
| February 6, 2026 | Withdrawal of the 2024 proposed event-contract rule | The CFTC said it would not finalize that proposal. The withdrawal cited state regulatory actions and litigation concerning jurisdiction, statutory definitions and sports-related contracts. Later 2026 activity is a new process, not a revival of the withdrawn proposal. |
| March 16, 2026 | ANPRM on prediction markets | The Commission requested information about core principles, public-interest restrictions, inside information, contract types and other aspects of prediction markets. An ANPRM gathers input; it is not a final operating rule. |
| March 12, 2026 | Division of Market Oversight staff advisory | Staff reminded DCMs of CEA, Part 38, Core Principle 3 and product-submission duties, with discussion of sports-related contracts. It is staff guidance, not a newly enacted statute. |
| April 2, 2026 | Lawsuits involving Arizona, Connecticut and Illinois | The CFTC challenged state actions against CFTC-registered DCMs and asserted a federal-jurisdiction position. The announcement is not a court ruling and does not answer every state or contract question. |
| June 10, 2026 | Proposed amendments to Regulation 40.11 and new Appendix F | The proposal would create a contract-by-contract public-interest process, including a 90-day review, for contracts involving enumerated activities such as terrorism, assassination, war, gaming or conduct unlawful under federal or state law. It remains a proposal unless finalized. |
| June 25, 2026 | Proposed reporting framework for certain fully collateralized event contracts | The CFTC proposed changes covering reporting markets and certain intermediaries. The announcement does not say that an individual trader must personally file these reports, and the proposal is not effective merely because it was announced. |
| September 22, 2026 | Division of Market Oversight advisory on “mention markets” | Staff described limited circumstances in which contracts about whether a person will say specified words, attend or appear at an event, or interact with someone could be listed consistently with the CEA and rules. The analysis is contract-specific and focused on manipulation risk. |
Chairman Michael S. Selig said in the June 10 announcement, “The CFTC will protect the integrity of our regulated markets without standing in the way of responsible innovation.” That is a policy statement about a proposal, not operative regulatory text.

Availability can change without a platform shutting down
A DCM can add, modify or remove contracts as listing reviews, regulatory questions, litigation or settlement mechanics change. Contract wording becomes important
Settlement language identifies the event, the source used to verify it, the measurement time and what happens if information is delayed, revised or ambiguous. The CFTC’s mention-market advisory illustrates why seemingly simple questions can require a close review: whether a person “appears,” says particular words or interacts with someone can depend on precise definitions and evidence.
Manipulation concerns can affect what is listed
Core Principle 3 and the March staff advisory put manipulation susceptibility at the center of product review. A contract tied to a small pool of participants, a privately controlled event or an outcome that can be influenced by one person may receive more scrutiny than a broadly observable event. The existence of trading interest is not enough to overcome that concern.
Federal supervision does not remove trading risk
Derivatives can lose value quickly, and a binary settlement can reduce a complex event to an all-or-nothing payout. Federal oversight addresses the venue’s obligations; it is not a guarantee against losses, outages, disputed facts, changing terms or a contract being delisted.

Are prediction markets legal in my state?
As of the materials available through October 11, 2026, there is no settled nationwide answer that resolves every state and every contract. The CFTC filed cases against Arizona, Connecticut and Illinois after those states took action against CFTC-registered DCMs. The agency’s filings express its view that federal law controls the relevant markets, but a press release or complaint is not a judicial holding that preempts every state restriction.

State law can also differ by product design, participant location, licensing theory and the specific action taken by a regulator or attorney general. A state’s position about one venue or contract should not automatically be generalized to another. Until courts rule and agencies update their positions, availability may be blocked by geolocation controls, account rules or a state directive even when a venue is federally registered.
For a current state-specific answer, verify all of the following on the date you intend to trade:
- The latest docket and orders in any relevant federal or state case.
- The CFTC’s current rulemaking page and the Federal Register record for proposals or final rules.
- The CFTC’s DCM and product registries for the venue and the exact contract.
- The relevant state regulator’s current notice, order or enforcement position.
- The venue’s own eligibility and location terms, including any change made after a court or agency action.
Those checks can establish what is documented at that moment; they cannot guarantee that a rule, listing or litigation position will remain unchanged.

Which proposed contract restrictions could matter?
Enumerated activities proposal
The June 10 proposal would amend Regulation 40.11 and add Appendix F. Its stated approach is a contract-by-contract public-interest review, with a proposed 90-day process, for products involving categories such as terrorism, assassination, war, gaming or conduct unlawful under federal or state law. Because it is proposed, traders should not treat the listed categories as a final automatic ban or permission. The eventual text, effective date and any transition provisions would determine how a particular product is treated.
Best Value
Reporting proposal
The June 25 proposal addresses reporting for certain fully collateralized event contracts, reporting markets and some intermediaries. It is aimed at market data and regulatory reporting architecture. Nothing in that announcement establishes a new personal filing obligation for every retail trader. Any duty would depend on the final rule, the role of the market participant and the contract’s structure.
Mention markets
The September 22 staff advisory does not create a general safe harbor. It says limited contracts about words, appearances or interactions may be listed consistently with the CEA and rules in appropriate circumstances, while emphasizing manipulation concerns and a contract-specific submission. A platform’s use of the term “mention market” therefore tells you little without the actual contract terms and listing analysis.
How large has the category become?
The CFTC’s March ANPRM supplies historical counts that illustrate growth in listings, not the size of the customer base or the amount of money traded.
| Period | Figure reported by the CFTC | What the figure counts |
|---|---|---|
| 2006–2020 average | Approximately five event contracts per year | Contracts listed, as described by the ANPRM; not traders, trades or dollars. |
| 2021 | 131 event contracts | Newly listed contracts. |
| 2025 | Approximately 1,600 event contracts | Contracts certified for listing. |
The jump in these figures helps explain why the Commission is asking broader questions, but it does not show whether any individual contract is liquid, profitable or available in a particular state.
A practical checklist before placing a trade
- Identify the legal venue. Find the market’s registered entity and confirm that it is a CFTC-registered DCM rather than relying on the generic phrase “prediction market.”
- Confirm the exact product. Check whether the contract is currently certified or listed, its payoff, expiration and settlement source.
- Read the definitions. Note how the terms define the event, time window, verification evidence, revisions, cancellations and ties or ambiguous outcomes.
- Check for special subject-matter issues. Ask whether the contract concerns sports, gaming, unlawful conduct, war, terrorism, assassination or a person’s words, appearance or interaction. Those subjects have received specific CFTC attention, but proposed or staff treatment is not the same as a final rule.
- Check your location. Review the venue’s current state eligibility controls and the relevant state authority’s latest position. Do not infer legality from a friend’s access in another state.
- Separate regulatory status from economics. Review fees, collateral, liquidity, position limits and loss scenarios independently. CFTC registration does not predict a return.
- Save the version you relied on. Keep the contract rules and settlement terms in effect when you trade so you can compare them with any later amendment or dispute.
Common mistakes and how to avoid them
- “Registered” means approved. Registration subjects a venue to requirements; it is not an endorsement of every product.
- A proposal is treated as law. The 2026 ANPRM, enumerated-activities proposal and reporting proposal request or propose changes. They do not automatically alter today’s obligations.
- A staff advisory is treated as a statute. Staff guidance explains how a division views existing duties; it does not itself enact a new CEA provision.
- A lawsuit is treated as a victory. The CFTC’s Arizona, Connecticut and Illinois announcement establishes that the agency filed cases and stated its position. Only court orders and judgments resolve the legal issues presented.
- One state answer is generalized nationwide. State actions and contract structures differ, and the federal-state dispute remains unsettled.
- Historical listing growth is mistaken for market size. The CFTC’s figures count listed or certified contracts, not customer accounts, volume or revenue.
- Federal oversight is mistaken for a trading guarantee. Price volatility, binary outcomes, settlement disputes and delisting remain possible.
What to watch next
The most decision-relevant developments are final agency action and court rulings, not headlines about a proposal alone. Watch whether the CFTC finalizes, changes or abandons the June proposals; whether the Federal Register records an effective date; how DCMs update contract catalogs; and what courts do with the state cases. Also watch the venue’s settlement rules, because a contract can be legally listable yet operationally unavailable or materially changed.
For U.S. traders, the reliable approach is contract-by-contract verification: identify the DCM, read the current terms, check your state and distinguish binding rules from proposals, advisories and agency arguments. That process cannot eliminate uncertainty, but it prevents the most consequential mistake—assuming that a “prediction market” label answers the legal question.
