Do not use AI-generated legal research as authority until you have independently verified every material citation, quotation, holding, procedural fact, and legal proposition. Treat the output as a list of research leads. Open each primary source, confirm that it exists, read the relevant passages in context, check its current status and jurisdictional force, corroborate important facts, and apply the rules of the court where the matter is pending. The lawyer who signs, files, or relies on the work remains responsible for its accuracy.
What verification actually involves
Verification has two separate questions. First, is the authority real and correctly identified? Second, does that authority support the proposition the AI attached to it? A citation can pass the first test and fail the second. A genuine opinion may be summarized inaccurately, quoted out of context, assigned the wrong procedural posture, or treated as binding when it is only persuasive.

The danger is not theoretical. The American Bar Association reported in 2026 that a researcher had tracked nearly 400 decisions in which a court or tribunal explicitly found or implied that a party relied on hallucinated content. That figure is the researcher’s count as reported by the ABA, not an official judiciary statistic or a complete census of such decisions.

Start by defining how the material will be used
The intensity and documentation of review should match the intended use. Brainstorming privately is different from sending an analysis to a client, relying on it in negotiations, citing it in a memorandum, or filing it with a court. Before checking the output, mark its intended use and the deadline. A filing or advice on a dispositive issue warrants source-level verification of every material proposition, not a spot check.
- Private issue spotting: AI output can supply search terms and possible authorities, but nothing should be treated as established until checked.
- Client or internal advice: verify the authorities and material facts that support the advice, and preserve a record of what was reviewed.
- Negotiation or correspondence: check every legal claim that could affect a position, admission, deadline, or settlement decision.
- Filed paper: personally read and verify every authority, quotation, and factual assertion that appears in the filing, and follow the court’s AI-related orders and local rules.
Use a claim inventory before opening sources
Copy the AI output into a working document and break it into checkable units. Do not only investigate citations that look unusual; fabricated material can be formatted convincingly. Record the exact text, the source the AI named, the proposition it is supposed to prove, and the result of your check.

Give each item a status such as verified, partly supported, unsupported, contradicted, or not located. “Not located” is not proof that an authority is fabricated, but it is a reason not to rely on it until the discrepancy is resolved.

Locate the authority in a reliable source
Cases
Search the exact case name and citation in an authoritative court repository, official reporter, docket, or established legal research service that provides the underlying opinion. Confirm that the document you opened is the same case the AI cited. Similar names, consolidated appeals, amended opinions, and orders in related proceedings can produce a real document with the wrong legal significance.
- Search the complete citation, then search the case name without the citation to catch typographical errors.
- Compare the court, docket number, decision date, panel or judge, and document type with the citation.
- Save or bookmark the opinion and docket materials you actually reviewed.
- Check whether the text is an opinion, order, memorandum, slip opinion, amended decision, or later proceeding.
If an exact search produces nothing, try alternate reporter formats, docket searches, and the court’s own archive. Do not “repair” a missing citation by guessing. Ask the AI for another citation only as a search lead, never as confirmation.

Statutes and regulations
Open the official code or government regulatory publication. Confirm the jurisdiction, section, subsection, effective date, and any version that was in force when the relevant conduct occurred. Historical versions matter: a current section may not govern an earlier event. Read definitions, exceptions, cross-references, and implementation provisions instead of copying only the subsection that appears in a search result.
Other authorities
For court rules, agency decisions, guidance, contracts, or secondary sources, identify the issuing body and the document’s date and status. A guidance document may explain an agency position without having the force of a statute or regulation. A blog post may be useful for finding a case but is not a substitute for the case.

A plausible citation is not evidence of a real authority. Check each bibliographic element against the source itself. For cases, verify the full caption, court, date, docket or reporter information, and whether the opinion is published, unpublished, withdrawn, superseded, or amended. For statutes and regulations, verify the title, section, subdivision, jurisdiction, and effective date.
Watch for subtle identity errors:
- A case with the same parties but a different appeal or later order.
- A citation that combines the reporter volume from one case with the page or docket number from another.
- An opinion that was vacated, replaced, or withdrawn.
- A state decision presented as federal law, or a decision from another jurisdiction presented as controlling.
- A regulation or rule from a different edition or effective period.
When the source cannot be located after reasonable searching, remove the citation from work intended for reliance or filing. Do not leave it in with a note that the AI supplied it.
Read the source in context, not just the snippet
Search-result snippets and AI summaries omit qualifiers. Read the entire section of the opinion or text surrounding the relevant passage, including the issue presented, facts material to the rule, analysis, disposition, and any limiting language. Determine whether the statement is a holding, dicta, a party’s argument, a quotation from another decision, or a hypothetical.

Test the proposition against the reasoning
- Write the proposition you need to establish in one sentence.
- Locate the court’s actual rule statement and the factual conditions attached to it.
- Read the application section to see how the rule was used to decide the issue.
- Compare those conditions with the facts and procedural posture of your matter.
- Record any limitation, exception, concurrence, dissent, or later treatment that changes the proposition.
A case may discuss a legal test without applying it to the issue your draft addresses. It may also reject a broad argument while adopting a narrower rule. Do not cite a passage merely because it contains the words used in your search.
Verify quotations and pinpoints character by character
Copy a quotation from the authoritative document, not from the AI output. Compare spelling, capitalization, brackets, ellipses, footnote calls, and punctuation. Confirm that the pinpoint page, paragraph, or line actually contains the quoted words. If the source uses a different pagination system, use the citation format permitted by the applicable court rules.
ABA litigation commentary reproduces this warning from the Noland court: “No brief, pleading, motion or any other paper filed in any court should contain any citations—whether provided by generative AI or any other source—that the attorney responsible for submitting the pleading has not personally read and verified.” Treat that as a practical filing rule and consult the underlying opinion before quoting or characterizing it in legal analysis.
Check precedential status and jurisdictional fit
After confirming that a source exists and says what you think it says, decide what legal weight it has for the forum. Identify the issuing court, the court hearing your matter, and the hierarchy between them. A decision may be binding, persuasive, nonprecedential, unpublished, superseded, or limited to a particular procedural question.
Use the jurisdiction’s accepted citator or subsequent-history method to look for later treatment. Check for reversal, vacatur, rehearing, amendment, negative treatment, statutory changes, and later decisions narrowing the rule. The exact tools and required sources vary by jurisdiction; no single citator practice should be assumed to apply everywhere.

Corroborate factual assertions independently
Legal analysis can fail because a factual premise is wrong even when the cited legal rule is accurate. Check dates, parties, procedural events, quotations from testimony, and descriptions of records against the docket, filings, exhibits, transcripts, agency records, or other underlying materials. Do not ask the same AI system to “confirm” a fact and treat agreement as corroboration; that simply repeats the same unverified process.
Use at least one independent source for material facts and more than one when the fact is contested or outcome-determinative. Distinguish facts established by the record from allegations, arguments, findings, and assumptions. Preserve the page, docket entry, exhibit, or paragraph supporting each important factual statement.
Apply confidentiality and professional obligations
Before using an AI service, determine whether entering the material would disclose confidential, privileged, personal, sealed, or work-product information. Follow your organization’s approved-tool policy and the jurisdiction’s professional-responsibility guidance. Redaction or anonymization may not be enough if the combination of details can identify a client or matter. If the tool’s retention, training, access, or deletion terms are unclear, do not upload protected material without informed approval and an appropriate safeguard.
Independent verification does not transfer responsibility to the software provider. The lawyer remains responsible for competence, diligence, candor to the tribunal, protection of client information, and the accuracy of a filing or advice.
Check the court’s specific AI requirements
Search the assigned judge’s standing orders, local rules, general orders, filing instructions, and any case-management order for requirements concerning artificial intelligence, citations, declarations, or certifications. Requirements differ by court and can change.
For example, a Northern District of California civil standing order dated July 16, 2025, says parties and counsel must not present materials containing AI-hallucinated legal citations or uncorroboratable assertions and warns that failure to confirm AI-created citations or assertions may be grounds for potential sanctions. That is a court-specific order, not a nationwide rule; verify whether it applies to your case and read the current version before filing.
An April 2026 agenda-book attachment from the federal Advisory Committee on Civil Rules discusses a proposed certification concerning checks on AI-generated citations and content. The document describes a proposal; its later adoption status is not established here. Treat proposals as alerts to monitor, not as operative rules, until the governing authority confirms them.
Keep a review record that another lawyer can follow
Create a verification log for work that may be shared, relied upon, or filed. Include the AI output’s date, the prompt or task description where appropriate, each material claim, the source opened, the passages checked, status or subsequent-history results, and the reviewer and date. Store downloaded opinions or stable references according to your firm’s document-retention policy.
The log is not a substitute for checking. Its value is that it makes the process auditable, exposes unresolved gaps before filing, and lets another lawyer reproduce the check. Mark unresolved items prominently and remove unsupported claims rather than allowing a deadline to turn uncertainty into an assertion.
A practical pre-use checklist
- Have I listed every case, statute, regulation, quotation, holding, procedural fact, and material factual assertion?
- Did I locate each authority in a reliable source and confirm that it is the exact document cited?
- Did I read the relevant passage and surrounding analysis in the source itself?
- Do every quotation and pinpoint match the source exactly?
- Is the authority current, and have I checked reversal, vacatur, amendment, and subsequent treatment?
- Is it binding or persuasive for this court, and does its factual and procedural posture fit?
- Did I corroborate important facts from the underlying record or an independent source?
- Have I checked confidentiality, privilege, and approved-tool requirements?
- Have I reviewed the applicable local rules, standing orders, and judge-specific instructions?
- Could I explain and reproduce the checks if the court, client, or opposing counsel asked?
What to do when you find an error
Stop using the affected proposition and determine where it has traveled. Remove or correct the false authority, unsupported quotation, or inaccurate fact in every draft, work product, message, or filing that contains it. If it has already been shared or filed, follow the applicable court procedure and notify the responsible lawyer promptly. The appropriate response may involve a corrected filing, disclosure, or other remedial step; the governing rules and circumstances control.
Do not quietly leave a known error because the broader argument still seems sound. ABA litigation commentary emphasizes diligence and candor and discusses sanctions arising from hallucinated authorities. Prompt, accurate correction is safer than allowing a court or client to discover that a known false statement remained in use.
How to use AI safely after verification
Once sources are verified, AI can help reorganize notes, generate alternative issue lists, compare arguments, or identify questions for further research. Keep the verified source text and your own analysis as the controlling record. Instruct the system to quote only supplied authorities, label uncertainty, and avoid inventing citations; then independently check any new output before relying on it.

Judge P. Kevin Castel’s statement, quoted in federal rules agenda material discussing Mata v. Avianca Inc., is a useful distinction: “there is nothing inherently improper about using a reliable artificial intelligence tool for assistance,” but lawyers retain “a gatekeeping role … to ensure the accuracy of their filings.” Read the opinion and the current rules for full context. Assistance is compatible with professional duties only when the lawyer performs that gatekeeping function.
