How to Verify a Pennsylvania Budget Waiver Against Its Source Documents

Compare Pennsylvania’s Act 146 waiver request letter and approval memo, verify agency and fiscal-year details, and find out what to do if records are missing.

To verify a Pennsylvania budget waiver, compare the official agency request letter with its matching approval memo, then cross-check the fiscal year and appropriation details against the Commonwealth’s budget publications. The two waiver records are the primary evidence; a budget summary provides context, not a substitute for either document.

What the two waiver records show

Pennsylvania Treasury’s Act 146 Waivers listing on OpenBookPA identifies two central records for a waiver:

  • Request or notice letter: A letter from the Budget Secretary to the chairs of the House and Senate Appropriations Committees. It gives notice of an agency’s request, includes the agency’s justification, and gives the committees an opportunity to raise objections.
  • Approval memo: A memo issued to the agency by the Budget Secretary after the request. Treasury says it is issued 10 days after the initial request.

The letter documents what the agency asked for and why; the memo documents the approval. Read both rather than treating one as proof of the other’s contents.

How to check a request against its approval

  1. Find the right fiscal-year listing and agency. Start with the Act 146 Waivers listing on OpenBookPA. Use the fiscal-year section and agency named on the record. Treasury’s September 30, 2026 announcement describes the FY 2025–26 publication.
  2. Read the request letter. Note the agency, request date, requested action, justification, and any amount, funding description, appropriation number, or program identifier that appears. The letter’s purpose is notice and justification, not a universal standardized data form, so a field may not appear in every file.
  3. Find the corresponding approval memo. Compare its agency, funding description, request date, appropriation or program identifiers, and other identifiers with the letter. Treasury describes the memo as following the initial request by 10 days; use the dates printed in the documents rather than assuming a match from timing alone.
  4. Compare what was requested with what was approved. Check whether the action described in the memo corresponds to the request. If the records differ or an identifier is missing, flag the discrepancy and seek clarification or additional records instead of assuming it is harmless.

Check fiscal-year and budget context

Treasury says Pennsylvania appropriations typically run from July 1 through June 30, and Act 146 waiver authority enables agencies to spend unspent funds beyond the June 30 lapse date. Use this as calendar context, not as a substitute for the named fiscal year and dates in the records. For a particular waiver, the actual documents and governing text control.

Use the Office of the Budget’s Commonwealth Budget index to locate enacted budget documents for the relevant fiscal year. Compare any appropriation or program identifiers and funding descriptions that appear in the waiver records. A general budget publication can help establish context, but it does not replace the request letter or agency approval memo.

What if a document is missing or unclear?

If the records are not available online, the Office of the Budget directs users to the Office of Open Records for guidance on making a Right-to-Know request. Identify the specific documents sought and describe them clearly enough for the office to locate them. The Office of the Budget says it responds within five business days, though specified conditions may allow an interim response. See its Right-to-Know information for the request route and details.

How many waiver records are listed?

In a September 30, 2026 announcement, Pennsylvania Treasury reported approximately 100 letters and corresponding memos for FY 2025–26 on OpenBookPA. That is a dated approximate count, not a fixed total. The announcement describes the publication and the memo timing; consult the listing for the records themselves.
