You can use AI to help sort workers’ compensation records while limiting exposure, but the safest approach is to share only what the task requires—and only with a service your organization has approved. First identify who controls the records and which rules apply; then choose a tool based on its actual data handling, not its “secure” or “private” label. For sensitive files, a local or organization-managed workflow may reduce exposure, but it still needs appropriate access controls and human review.
Can you upload workers’ compensation paperwork to AI?
Sometimes, but there is no blanket answer. It depends on your role, the information in the files, the service’s data practices, your organization’s approval, and applicable laws and contracts. Do not upload identifiable claim or medical documents to a public chatbot simply because it accepts file uploads or says it protects privacy.

HIPAA does not automatically govern every employer or workers’ compensation insurer. The HHS Office for Civil Rights says the Privacy Rule does not apply to workers’ compensation insurers, administrative agencies, or employers unless they are covered entities for another reason. That does not mean the information is unprotected: state workers’ compensation laws, other privacy laws, contracts, workplace policies, and professional duties may still restrict its use or disclosure. HHS notes that state-law requirements vary. See HHS guidance on disclosures for workers’ compensation purposes.
For covered providers, HIPAA permits certain disclosures for workers’ compensation purposes under specified legal bases, such as authorization, applicable workers’ compensation laws, or other law. Where the minimum-necessary standard applies, the disclosure should be reasonably limited to what the workers’ compensation purpose requires, subject to what applicable law authorizes. Do not treat a claim file as unrestricted just because it is used in a workers’ compensation process.

Choose an AI approach by its data flow
“AI” can mean software running on a managed device, an organization-managed service, or an external cloud tool. Those arrangements can expose data to different systems and people. Before choosing, compare the actual service and workflow on these points:
- Where content goes: Does the document stay on a managed device or organizational environment, or is it sent to an external provider or its subprocessors?
- What happens to inputs and outputs: Are files or prompts stored, logged, retained, or used to improve models? How are deletion requests handled?
- Who can access the workspace: Are access permissions, authentication, and audit records available and appropriately restricted?
- What agreements apply: Has the organization approved the service, and are required privacy and security agreements in place?
- How well it handles these records: Can staff reliably review its OCR, date extraction, and document labels for the specific file types involved?
- What review costs: Will the time needed to check results outweigh the time saved by automation?
Do not infer answers from a marketing phrase such as “private AI.” Check the service’s current terms and your organization’s approved configuration. The available official guidance does not establish the current retention, training, deletion, or subprocessor terms of any named AI vendor.

When a cloud provider handles ePHI
If a cloud service creates, receives, maintains, or transmits electronic protected health information on behalf of a HIPAA-covered entity or business associate, HHS says the provider is a business associate and an appropriate business associate agreement (BAA) is required. A BAA is not, by itself, proof that every part of a workflow is safe or compliant; the relationship, purpose, data, service configuration, and other applicable HIPAA obligations matter. HHS also states that a provider does not escape business-associate obligations simply because it stores encrypted ePHI without the decryption key. Read HHS cloud-computing guidance and have the responsible privacy or security staff assess the arrangement.
Use this workflow to limit exposure
- Identify the records and who is responsible for them. A file may combine health information, claim identifiers, employment details, financial information, or privileged correspondence. Determine whether you are handling records for a covered entity or business associate, and check internal policy and applicable state requirements before processing them.
- Define the narrow task. Decide whether you need a folder label, a document date, a duplicate flag, or an index. Do not provide more context or detail than that task requires.
- Remove information the task does not need. If a name, date of birth, address, claim number, Social Security number, provider identifier, or signature is unnecessary, keep it out of the prompt and any file sent to the service. Use your organization’s approved redaction or de-identification process. Merely deleting a name may leave identifying details in the document body, scan, or metadata; transforming a file does not automatically establish legal de-identification.
- Verify the service and configuration. Confirm where the content is processed, whether it is retained or used for model improvement, how deletion works, whether subprocessors are involved, and whether your organization has approved the tool. If HIPAA applies to the relationship, confirm that required agreements and safeguards are in place before ePHI is processed.
- Ask for structured, minimal output. For example: “Return a table with the document date, document type, and source filename. If a field is unclear, mark it for review. Do not reproduce medical details.” Use only a suitably minimized document, and avoid asking for narrative summaries that repeat sensitive information unnecessarily.
- Keep access limited and preserve the originals. Restrict the folder or workspace to people who need it, use authentication, and maintain audit records where appropriate. Keep the source records intact so staff can check each result against the original.
- Review every result before relying on it. Compare extracted dates, labels, and duplicate flags with the source document. Correct errors and document AI use when organizational policy requires it. NIST recommends monitoring AI-generated content for privacy risks and possible exposure of personally identifiable information or sensitive data; its guidance is risk management, not a guarantee that a product prevents leakage. See the NIST Generative AI Profile.
- Follow the applicable records schedule. Do not delete source files, prompts, or AI outputs based on a generic online retention tip. Requirements can depend on jurisdiction, record type, and legal holds. Ask the organization’s records officer or counsel which schedule applies.
Keep AI’s role to organization, not claim decisions
AI can assist with mechanical tasks such as suggesting a folder, extracting a date, or flagging a possible duplicate. Treat these as suggestions that require comparison with source records. Do not use an AI-generated index or summary as a substitute for the underlying documents.

Do not ask an AI to determine entitlement, causation, disability, or a claim outcome based only on a set of files. Those are consequential judgments, not simple document-organization tasks. Keep decisions with the people and processes authorized to make them.

Physical safeguards do not protect digital copies. HHS gives locking records and restricting access to keys or passcodes as examples of physical safeguards. A lockable cabinet or box can help secure paper files, but it does nothing to protect scans uploaded to a cloud service, local copies on an unsecured device, or an AI workspace with overly broad access. For regulated ePHI, HHS’s Security Rule guidance covers risk analysis and safeguards such as access controls, audit, authentication, transmission security, physical security, and protection of confidentiality, integrity, and availability. The Rule is scalable and technology-neutral; it does not prescribe one universal product. See HHS’s Summary of the HIPAA Security Rule.

What to do if the tool or rules are unclear
- You do not know whether HIPAA applies: Ask the organization’s privacy officer or counsel to assess your role and the entity’s status. Do not assume either that HIPAA applies to every employer or that no privacy duties apply.
- You cannot confirm what a vendor retains or does with uploads: Do not send identifiable records until the service’s terms and the organization’s approval establish an acceptable arrangement.
- You cannot safely redact the file: Use an approved internal process or a restricted, approved system rather than relying on deletion of a name alone.
- The AI output is uncertain or consequential: Mark it for human review and consult the original document; do not let an uncertain extraction drive a claim decision.
