Under the central CGST Act, an aggrieved person generally has three months to appeal to the Appellate Authority under section 107, while an appeal to the Appellate Tribunal under section 112 also generally has a three-month period. The rules for condonation and proof of filing differ by stage, so use the correct clock for the particular order and route.
How do I track GST appeal deadlines and avoid missing them?
Use one record for each order. Store the order and evidence of its communication together, then track the applicable appeal stage, statutory period, internal due date, reminders, and filing acknowledgements. This creates a defensible record of what triggered the clock and what was submitted.

- Create a matter record: note the taxpayer or GSTIN, issuing authority, order identifier, order date, and the date and method by which the order was communicated. Save the communication itself and any available delivery, portal, or email evidence.
- Identify the next route: determine whether the matter is an appeal to the Appellate Authority under section 107, an appeal to the Appellate Tribunal under section 112, or another route confirmed by a qualified GST adviser.
- Record the statutory period and its source: write down the relevant section and period beside the internal due date. The Act states periods in months; do not substitute a universal number of days.
- Have the date checked: applicable time-computation rules, holidays, notifications, service facts, jurisdiction, and case circumstances can affect the actual last date. Ask a qualified GST professional to verify it when any of these are uncertain.
- Set reminders and ownership: schedule multiple alerts before the verified last date, assign a responsible person, and name a backup. Do not plan to rely on condonation as extra filing time.
- Preserve filing evidence: for an APL-01 appeal, retain the provisional acknowledgement, proof of timely certified-copy submission where applicable, and the final acknowledgement showing the appeal number.
- Recheck before submission: confirm current rules and portal instructions, then save the submission records and acknowledgements in the matter file.
A spreadsheet or calendar can help organize these records, but it cannot determine the legally correct deadline on its own. The date in the tracker should be a verified date, not an automatic calculation from the order date.

The period depends on who is appealing and which stage applies. These are statutory periods in the central CGST Act, not a single deadline for every GST matter.

| Route and appellant | Clock starts | Ordinary period | Possible delayed admission | Form or filing evidence |
|---|---|---|---|---|
| Section 107 appeal by an aggrieved person to the Appellate Authority | Communication of the decision or order to that person | Three months | The Appellate Authority may allow a further period of one month for sufficient cause under section 107(4); this is discretionary | FORM GST APL-01; retain the provisional acknowledgement, certified-copy submission proof where applicable, and final acknowledgement with appeal number |
| Section 107 departmental application to the Appellate Authority | Communication of the decision or order | Six months for the Commissioner to direct an officer to apply | Section 107(4) refers to a further period of one month for sufficient cause | Not stated here; confirm the applicable procedure and filing evidence for the matter |
| Section 112 appeal by a person to the Appellate Tribunal | Communication of the order | Three months | The Tribunal may admit an appeal within a further three months after expiry if sufficient cause is established | Confirm the applicable Tribunal form and filing procedure under current rules |
The table summarizes the central CGST framework. State or Union Territory legislation, notifications, amendments, and the facts of service may matter in an individual case. Verify the current provisions before relying on a date.
When does the GST appeal time limit start?
For the taxpayer’s section 107 appeal, section 107(1) measures the three months from the date the decision or order is communicated to the person. The relevant trigger is therefore the communication date, not simply the date printed on the order. Section 112(1) likewise gives a person three months from communication of the order to appeal to the Tribunal.
Keep the evidence that establishes when and how communication occurred. If the portal record, delivery record, email, or other service history is incomplete or inconsistent, do not resolve that uncertainty by choosing the most convenient date; get the date reviewed before calculating the deadline.

For a section 107 appeal, section 107(4) gives the Appellate Authority discretion to allow a further period of one month if satisfied that sufficient cause prevented the appeal from being presented within the ordinary period. The section says: “The Appellate Authority may, if he is satisfied that the appellant was prevented by sufficient cause from presenting the appeal within the aforesaid period of three months or six months, as the case may be, allow it to be presented within a further period of one month.” This is the wording of section 107(4) in the CBIC-hosted Act text.

For a section 112 Tribunal appeal, section 112(6) provides a separate possibility: the Tribunal may admit the appeal within three months after expiry of the ordinary period if sufficient cause is established. Neither provision makes delayed filing automatic or guarantees that a request will be accepted. Treat the ordinary deadline as the deadline to meet.

For an appeal to the Appellate Authority, the rules specify FORM GST APL-01 and a certified-copy timing requirement that can affect which date counts as the filing date. Preserve each record rather than relying on a screenshot of an in-progress submission.
- The provisional acknowledgement issued for the APL-01 filing.
- Proof of submission of the certified copy within seven days if relying on the provisional acknowledgement date as the filing date.
- The final acknowledgement indicating the appeal number. Under the applicable rule, the appeal is treated as filed when this final acknowledgement is issued; the certified-copy timing provision determines whether the provisional acknowledgement date remains the filing date.
Check the current version of the rules and portal instructions for the particular filing. Acknowledgement records show what the system recorded; they do not by themselves establish that the selected legal route or deadline calculation was correct.
Quick Recap
What to verify before relying on a tracked date
- Confirm that the correct appellant and appeal stage are selected; the taxpayer’s section 107 period is not the department’s six-month period or the section 112 Tribunal period.
- Verify the communication date from evidence, not only the order’s printed date.
- Check current amendments, notifications, applicable state or Union Territory provisions, time-computation rules, and holidays.
- Check portal instructions and preserve the relevant acknowledgements and certified-copy proof.
- Get professional review if service history, jurisdiction, the proper route, or the calculated last date is unclear.
