Establish a review process before use, limit the data staff and students may enter, check vendor terms and safeguards, explain data practices, and assign responsibility for ongoing oversight.
Start with a review process, not a blanket rule
A useful school AI policy should define which tools and users it covers, distinguish approved school use from personal accounts and unapproved tools, and identify who can approve a system. Apply the process to both staff-facing and student-facing AI, including tools embedded in other products when they handle school or student information.

Pennsylvania’s Department of Education advises schools to understand a tool’s terms, data control, permitted uses, vendor obligations, third-party sharing, liability, misuse, and breach handling before introducing it. OECD guidance likewise emphasizes privacy, cybersecurity, bias testing, and monitoring. These are policy-design recommendations; the legal requirements for a particular school depend on its jurisdiction and circumstances.
Record the purpose and approval
For each proposed tool, document its educational purpose, intended users, vendor, data categories, contract or applicable terms, approval date, and the staff member or office accountable for the decision. Require review before use, rather than allowing a tool to become routine first and assessing it later.

Set a clear route for exceptions, incident reporting, and suspension or revocation of approval. Reopen the review if the tool’s features, data practices, terms, or intended use change.
Limit the student data an AI tool can receive
Make data minimization a practical rule for everyday use: prompts and uploaded files should contain only what the task requires. Pennsylvania’s Department of Education puts it this way: “As a rule of thumb, AI tools should only be allowed to collect, process, and retain the minimum amount of data necessary to deliver the service they are providing.”
Specify which data are permitted, which require additional approval, and which must never be entered into an unapproved system. In particular, prohibit staff and students from entering identifiable student records into unapproved tools. Tell users to remove names and other identifying details when those details are not necessary to the task.

For every approved tool, record retention expectations, how deletion can be requested, and whether the vendor may use prompts, uploads, or outputs for model training or another secondary purpose. Do not assume that data are private, promptly deleted, or excluded from training unless the applicable terms or agreement establish that.
Check the vendor and the legal basis for access
In the United States, FERPA generally restricts disclosure of personally identifiable information from education records without written consent, subject to specified exceptions. Some disclosures to service providers may be allowed only when relevant conditions and safeguards are met. The U.S. Department of Education explains the disclosure rule, exceptions, and contractor arrangements in its Privacy and Data Sharing guidance.
Do not treat a vendor’s claim that it is “FERPA compliant” as a substitute for determining what information the school will disclose, which exception or other basis applies, and what safeguards are required. Have qualified district counsel assess the facts and applicable conditions. Other federal, state, local, or sector-specific requirements may also apply.

Review the terms and safeguards
Use the vendor review to answer concrete questions before approval:
- What data does the tool collect, and who controls or owns those data?
- How long are prompts, uploads, and outputs retained, and how can the school request deletion?
- Can the vendor use school data for model training or another secondary purpose?
- Are data shared with third parties or subprocessors, and under what conditions?
- What security practices, access controls, and breach-notification commitments apply?
- What contract protections cover permitted use, confidentiality, deletion, and vendor obligations?
- Who at the school can access the tool and its outputs, and is that access appropriate?
Document the answers, unresolved questions, and approval conditions. Use a written agreement where applicable law or the chosen exception requires one, and make sure contractual protections match the tool’s actual use.

Explain AI data practices to students and families
Make the school’s privacy notice and other communications clear about where AI is used, what information it handles, and how people can raise questions or concerns. The UK Department for Education specifically says school privacy notices should explain how generative AI tools collect, process, and store data. That is UK guidance, not a statement of U.S. law; schools should follow the notice rules that apply in their own jurisdiction.
Give users a practical contact for privacy questions and a way to report unexpected data use or other concerns. Where the tool’s role or data handling changes materially, review whether the school’s notice and communications remain accurate.

Approval should account for more than the privacy notice and vendor contract. OECD guidance calls for strong underlying cybersecurity, testing for algorithmic bias, and monitoring effects on equity and quality. UNESCO’s guidance for education policymakers also frames AI as a source of educational opportunity and risk, supporting a governance approach that considers both.

Set appropriate access controls, train staff on permitted use and data minimization, and assign a human decision-maker accountable for the school’s use of AI. Evaluate whether the system is accessible and suitable for its intended students, and monitor for bias or uneven effects rather than assuming that a tool performs equally for everyone.
Include a response path for suspected privacy or security incidents, including who must be notified internally and who decides whether use should be paused. Reassess approved tools periodically and when terms, features, users, or data practices change. A tool’s approval is not a permanent finding that every future use is appropriate.
