How to Securely Transfer Sensitive Files Between EU Organisations

Share only what is needed through an approved, access-controlled channel. Check recipients, encryption, retention, and where files may be accessed or processed; EU-based organisations may still need to assess onward access outside the EEA.

Use an organisation-approved transfer channel, send only what the recipient needs, and restrict access to the intended people. Encrypt files when appropriate to the risk, verify the recipient and receipt through trusted channels, and check where the file may be accessed or processed—not just where the two organisations are based. An exchange between EU organisations is not automatically a restricted international transfer under GDPR, but access or onward processing outside the European Economic Area (EEA) can change the analysis.

1. Identify what the files contain and minimise them

First determine whether the material includes personal data, special-category personal data, credentials, commercial secrets, or information governed by another regulatory or contractual requirement. “Sensitive files” is broader than GDPR special-category data, and confidential non-personal information may be subject to other rules.

Remove fields, documents, and records the recipient does not need. Prefer a limited extract over a complete dataset, and plan to retain the transfer copy only as long as necessary. The European Commission’s guidance on data protection by design and by default describes limiting processing, retention, and access to what is necessary.

2. Confirm the recipient and each party’s role

Validate the receiving organisation and the named people who should receive the files using contact details or a channel you already trust. Do not rely solely on a new or unexpected message requesting sensitive material.

  • Certified to FIPS 197 - High-level information security standard approved by the U.S. Government
  • Brute-Force Password Attack Protection - Data is automatically erased after 6 failed access attempts. The data and encryption key are securely destroyed and the crypto drive is reset
  • Rugged Double-Layer Waterproof* Design - Protects the crypto drive against knocks, drops, break-in and submerging in water. The electronics are shielded by a hardended inner case. The rubberised silicone outer casing provides a final layer of protection
  • Auto-lock - The crypto drive will automatically encrypt all data and lock when removed from a PC/Mac or when the screen saver or "computer lock" function is activated on the host PC/Mac
  • Secure Entry - Data cannot be accessed without the correct high-strength alphanumeric 8-16 character password. A password hint option is available. The password hint cannot match the password

Clarify whether the organisations are separate controllers or whether one is processing personal data on behalf of the other. That distinction affects responsibilities and contractual terms, including which standard contractual clauses may apply if there is also an international transfer. The Commission’s security and data-protection-by-default guidance supports risk-based protections and limited access; it does not set one universal recipient-verification procedure.

3. Choose and configure an approved transfer channel

Use a service or workflow that the organisations have assessed and approved for this type of information. There is no single EU-mandated file-transfer protocol established by the Commission guidance cited here. Select controls according to the risks and the organisations’ security requirements.

  • Certified to FIPS 197 - High-level information security standard approved by the U.S. Government
  • Brute-Force Password Attack Protection - Data is automatically erased after 6 failed access attempts. The data and encryption key are securely destroyed and the crypto drive is reset
  • SuperSpeed USB 3.0 - Transfer all your confidential files and folders faster than ever before. Works on both PC & Mac
  • Restrict access to named recipients and give each person only the permissions they need.
  • Use encryption appropriate to the risk, including protection in transit and, where supported and appropriate, at rest.
  • Check who controls the encryption keys and whether the service provider or its support staff could access the contents.
  • Use expiry or revocation controls where available, and review audit logs if the service provides them.
  • Check hosting, support access, backups, subprocessors, retention settings, and the service’s incident-response and recovery arrangements.
  • Confirm that the organisations’ contractual data-processing terms and internal policies cover the workflow.

These are practical ways to apply the Commission’s risk-based security and minimisation principles, not a certification checklist or a claim that one particular service is approved. The Commission identifies encryption as one possible technical measure in its security guidance.

4. Share secrets separately and confirm receipt

If a file is encrypted with a password or other secret, do not send that secret in the same message or channel as the file. Pass it through a separately verified channel. Ask the intended recipient to confirm they can access the correct file, then remove temporary access and delete working copies in line with the organisations’ retention rules.

Integral 4GB Crypto-197 256-Bit 3.0 USB Flash Drive Encrypted - FIPS 197 Certified, Brute Force Password Attack Protection & Waterproof Double Layer Design
  • Certified to FIPS 197 - U.S. Government Approved High Level Information Security Standard.
  • Protection against brute force password attacks - Data is automatically erased after 6 unsuccessful access attempts. The data of the USB flash drive type c encryption with dual connectors is destroyed and the cryptographic drive is reset.
  • Durable dual-layer waterproof design* — Protects the crypto reader from bumps, drops, run-in and immersion in water. The electronics are protected by a hardened internal case. Rubberized silicone outer case provides a final layer of protection.
  • Auto-Lock —The cryptographic key automatically encrypts all data and locks when removed from a PC/Mac or when screen protection or "computer lock" is enabled.
  • Secure Entry —Data on these flash drives cannot be accessed without the correct alphanumeric password of 8 to 16 characters. A password indication option is available for this flash drive. The hint cannot match the password.

These are prudent operational safeguards, not a single method mandated by the cited Commission pages. For removable media, such as an encrypted USB drive, follow both organisations’ policies for physical custody, encryption, key exchange, and deletion; encryption alone does not resolve the handling risks.

5. Check the full geography of access and processing

The location of the two organisations does not necessarily identify every location involved in a transfer. Check where the file is hosted, where support staff or subprocessors may access it, whether it is shared onward, and where backups are kept.

The European Commission defines the EEA as the EU countries plus Iceland, Liechtenstein, and Norway. Its international data-transfer rules describe mechanisms for personal data transferred outside the EEA. An EU-to-EU exchange is not automatically a third-country transfer, but an access or processing arrangement outside the EEA may require a separate assessment.

6. If personal data goes outside the EEA, assess the transfer

Check whether an adequacy decision covers the destination and the particular transfer. If it does not, identify an applicable safeguard, such as the relevant standard contractual clauses (SCCs) or binding corporate rules. The European Data Protection Board’s tools for transfers and derogations explains the available routes and notes that derogations are exceptional, not a routine mechanism for regular business transfers.

7. Match international SCCs to the parties’ roles

Do not treat all SCCs as interchangeable. The Commission distinguishes clauses for controller-processor relationships from clauses designed for transfers of personal data to third countries. Its international SCCs have four modules:

  • Controller to controller
  • Controller to processor
  • Processor to processor
  • Processor to controller

Choose the module that matches the parties’ roles, and assess the destination country’s laws and practices for the transfer. The Commission’s SCC questions and answers explains the distinction and role-based modules. It gives end-to-end encryption as an example of a supplementary technical measure that may be relevant where the assessment shows additional protection is needed.

When to involve privacy or security specialists

Ask the organisations’ privacy and security leads to assess the transfer when the files contain regulated or high-impact information, the recipient’s role is unclear, or access and processing locations cannot be established. This overview does not decide national secrecy obligations, sector-specific rules, contractual restrictions, or the right safeguards for a particular transfer.
