To run a merch giveaway, publish clear official rules before inviting entries, keep entry free on YouTube, explain who can participate and where you will ship, and choose and contact the winner exactly as promised. You—not Twitch or YouTube—are responsible for administering the promotion and delivering the prize. Requirements vary by location, so check the rules that apply where you and your entrants are before launch.
Decide what you can give away and deliver
Choose merchandise you can actually supply, then describe it precisely enough that entrants know what the prize is. Specify the item or bundle, number of winners, available sizes or colors, any permitted substitution, and the places you will ship. Include an approximate value when useful, but do not present it as a typical merch-giveaway budget.

Apparel can work well when it fits your channel and audience. An official Twitch-hosted promotion’s 2023 rules, for example, listed T-shirts, sweatshirts, socks, and hats among its merchandise prizes. That particular promotion offered six prizes, each with an approximate retail value of $535, and restricted delivery to the United States or Canada; those figures and limits describe that promotion only, not a benchmark for yours. Write the rules before opening entries
Put the full rules somewhere entrants can access before they enter, and make the stream announcement match them. Twitch requires official rules; YouTube requires rules and says the contest must be conducted and prizes awarded as stated. The platform requirements differ, so follow the policy for the service hosting your giveaway.
- Organizer: Identify yourself or your organization as the promoter.
- Dates: Give the opening and closing date, time, and time zone.
- Eligibility: State age and residency requirements, excluded people, and any guardian process that applies to minors.
- Entry: Describe the free entry action, entry limit, and disqualifying conduct.
- Prize: State what is awarded, how many winners there are, relevant variants, and where it can be delivered.
- Winner process: Say whether selection is random or judged, give the judging criteria if relevant, and explain the notification method and response deadline.
- Unclaimed or ineligible prize: Explain whether you will select an alternate winner and what happens if a winner cannot accept or receive the prize.
- Privacy: Explain what information you collect, why you need it, and how it will be handled. YouTube requires a legally compliant privacy notice.
- Platform notice: Include the required statement that the platform does not sponsor the promotion and any required release of platform liability.
Link to the YouTube Community Guidelines in YouTube contest rules, as required by YouTube’s contest policies. Its policy also requires the rules to comply with YouTube’s terms and include required legal disclosures. This is not a legal template: adapt the rules to the actual prize, eligibility, and locations.

Make entry clear, free, and fair
Use one plainly described action that counts as entry and tell viewers how many entries are allowed. On YouTube, entry must be free, and the contest cannot manipulate views, likes, dislikes, or subscriber metrics to misrepresent genuine engagement. Do not make paid engagement the entry mechanism.
In the United States, FTC guidance warns that purchase-required sweepstakes-type promotions are illegal. State requirements can also include disclosures, licensing, or bonds, and vary by state. Do not assume that a mechanic permitted in one place is lawful everywhere or that a platform policy resolves local legal requirements. Read the FTC endorsement guidance and check applicable rules for your promotion.

For YouTube, do not require a purchase, subscription, donation, like, or other engagement as a condition of entry unless you have confirmed the specific mechanic is lawful and consistent with platform rules. The policy’s free-entry and engagement-integrity requirements are especially important; a disclaimer does not make a non-compliant entry method acceptable.
Run the giveaway on Twitch or YouTube
On Twitch
Twitch treats the streamer as the promoter. You are responsible for compliance, official rules, administration, winner selection, issuing the prize, permissions, and any required registration or bond. Twitch may remove a promotion it reasonably believes violates its terms or law, and it does not sponsor or endorse the promotion.

When promoting, administering, or conducting a promotion on Twitch, display or read its required disclaimer: “This is a promotion by [Your Name]. Twitch does not sponsor or endorse this promotion and is not responsible for it.” Replace the bracketed text with your name. If a brand supplies a prize in exchange for promotion, assess Twitch’s branded-content requirements: Twitch says creators must use its Branded Content tool for sponsored content, which displays an “includes paid promotion” disclosure when enabled. Whether a particular brand mention constitutes sponsored content depends on the arrangement; check current guidance rather than treating every mention alike.
On YouTube
YouTube requires contests to comply with applicable federal, state, and local laws; have free entry; avoid manipulating engagement metrics; and not suggest YouTube is involved or endorses the contest without written consent. Your rules must state that YouTube is not a sponsor and release YouTube from contest liability, along with required legal disclosures and a legally compliant privacy notice. You must run the contest and award the prize according to those rules. YouTube’s policy page is informational, not legal advice.
If a company gave you a free product or other value in exchange for promotion, disclose the relationship where required. The FTC says free products or other value exchanged for promotion can trigger endorsement requirements; an incentive such as contest entry may matter if it affects how viewers assess an endorsement. Select, notify, and ship the prize
- Close entries at the stated time. Do not accept late entries unless your rules permit it.
- Apply the published selection method. If selection is random, use a consistent drawing process; if judged, apply the criteria you announced.
- Contact the selected entrant using the stated channel. Give the response period in your rules and follow the same process for every winner.
- Verify eligibility and arrange delivery privately. Collect only the details needed to contact the winner and ship the prize. Do not ask for a home address in public chat.
- Use the alternate-winner process if needed. If the person does not respond, is ineligible, or cannot receive the prize, follow the rule you published.
- Keep a record. Retain the announcement, rules, winner-selection record, and delivery confirmation so you can show that you administered the promotion as promised.
State who pays shipping by setting the delivery geography and shipping terms in advance. Do not promise worldwide delivery until you have checked shipping cost, restrictions, and fulfillment for the countries you plan to include. A Twitch-hosted official-rules example limited delivery to the United States or Canada and described alternate-winner procedures; treat it as an illustration, not a template for every giveaway.
What to check before launch
- Does the prize exist, and can you supply the announced quantity and variants?
- Do your dates, time zone, eligibility, entry limit, and selection method make sense together?
- Can you deliver to every location listed, and have you accounted for shipping and fulfillment?
- Are the rules accessible before entry and consistent with what you say on stream?
- Have you included the platform disclaimer, required YouTube disclosures, and privacy notice where applicable?
- Have you checked local law for registration, licensing, bond, age, or other requirements? The FTC’s general guidance is not a state-by-state or international legal determination.
