Before you submit confidential information to an AI tool, identify the exact product and account you will use, then review its contract, privacy documents, and active settings together. A promise that data is “not used to train models” answers only one question: it does not, by itself, tell you how long data is retained, whether people can review it, or whether it is used for other purposes.
Start with the exact product and account
AI services can apply different rules to consumer chat, a business workspace, an enterprise contract, a direct API account, or access through a cloud marketplace or reseller. Do not assume that a policy for one route applies to another.

Record the product name, plan, account owner, region, deployment route, and any connected tools. Then collect the documents and controls that govern that particular account:

- Business or commercial agreement, order form, and data processing addendum (DPA), if applicable
- Product-specific terms, security documentation, and retention settings
- Applicable acceptable-use or AI policies
- Marketplace or reseller terms, if the service is purchased or accessed through another provider
Look for language that incorporates documents by reference, explains which document takes precedence if terms conflict, or permits amendments. Preserve relevant promises and disclosures: the U.S. Federal Trade Commission says providers may be accountable for commitments made in places such as website terms, promotional materials, or marketplaces, and that material omissions about data collection and use can matter too. Map each kind of data to each use
Do not review “your data” as if it were a single category. Make a simple inventory of what you plan to send or generate and compare it with every purpose named in the applicable documents.

For each purpose, note whether use is mandatory or optional, what action changes it, whether the change applies prospectively, and what exceptions remain. Ask specifically whether deleting a chat removes it from future training, from stored systems, or both. Those are separate outcomes. “Not used to train models” does not mean “not retained,” “not reviewed,” or “not used for another purpose.”

Vendor policies illustrate why the precise plan and exception language matter. Anthropic’s August 28, 2025 update applied to its consumer Free, Pro, and Max plans, not services under its Commercial Terms such as Claude for Work and API routes. For those named consumer offerings, it said data could be used to improve models when a user enabled the setting, with stated retention of five years when training was allowed and 30 days when it was not. Anthropic’s consumer terms update. A separate Anthropic Privacy Center article dated March 16, 2026 says chats may also be used when flagged for safety review and describes up to five years of retention for feedback. Check retention, deletion, and exceptions
Find out how long each relevant category remains in primary systems, logs, backups, and any fine-tuning workflow. Check whether a deletion setting covers the features and endpoints you use, when deletion reaches backups, and which legal, safety, security, or harm-prevention exceptions apply. A control shown in documentation is not proof it is enabled for your account; verify the configuration and any approved exception in writing.

OpenAI’s enterprise privacy disclosure describes workspace-admin control over retention for listed business workspaces and deletion within 30 days for specified deleted business conversations, subject to stated exceptions. Separately, it says API inputs and outputs may be retained for up to 30 days for service provision and abuse identification, with zero data retention available for eligible use cases. OpenAI enterprise privacy disclosure. These are distinct business-workspace and API contexts, not a universal retention period.
OpenAI’s API documentation says Zero Data Retention and Modified Abuse Monitoring require prior approval and additional requirements, and explains that endpoint behavior can differ under ZDR. Review access, confidentiality, security, and contract changes
Read the confidentiality promise alongside the limits on how the provider may use information. Identify who may access content and for what reasons, including support staff, safety reviewers, contractors, subprocessors, affiliates, and legal authorities. Also check security commitments, incident notification, audit evidence, data location and transfers, deletion assistance, and what happens when the contract ends.
If the provider can use de-identified or aggregated data, check how those terms are defined and whether the permitted use is limited. Review rights to change terms, notice periods, and whether you can export or delete data or terminate after a material change.

For example, OpenAI’s business agreement incorporates its DPA when personal data is processed and refers to security measures and audit reports; the agreement and service-specific terms are part of the review. OpenAI Services Agreement. Its enterprise privacy disclosure also describes access limits and security measures for business data. These are provider statements; confirm the current wording and applicability to the specific plan and contract.
Make regulated and third-party information an approval gate
Do not infer that a business or enterprise plan is automatically suitable for health, financial, student, legal, export-controlled, or client-confidential information. Check the applicable law, professional duties, customer contract, and any required provider addendum. If the information belongs to a client or another organization, confirm that disclosure to the AI provider is authorized and does not conflict with obligations on use, retention, or access.
OpenAI’s Services Agreement says a customer may not process protected health information unless it has signed the Healthcare Addendum, and notes that not all OpenAI services are designed for PHI. OpenAI Services Agreement. That example does not settle requirements for other products, data categories, or jurisdictions. When suitability or authorization is unclear, pause and involve legal, privacy, or security staff rather than treating a general business plan as approval.
Record the decision and revisit it when things change
Keep a short approval record that identifies the product and account reviewed, the governing documents and relevant clauses, the settings checked, approved and prohibited data categories, known exceptions, the review date, and the person responsible for rechecking. If terms conflict or a promise is ambiguous, treat the question as unresolved and ask the provider for written clarification or route it to legal, privacy, or security review.
