If an AI tool may have contributed to a harmful or unfair decision about you, act promptly: preserve the notice and relevant records, ask the organization in writing what role the system played, request correction and a review by someone empowered to change the outcome, and check the appeal and regulator deadlines for your country and situation. An AI recommendation is not always the decision itself, and the right to a human review depends on the law and circumstances.
First, protect yourself from an urgent consequence
If the outcome could immediately affect your safety, health, housing, job, benefits, finances, or access to an essential service, contact the organization’s human service or emergency channel that can address that consequence. Ask whether it can pause an irreversible action while the decision is reviewed. This is a practical step, not a guaranteed legal remedy.

Preserve the record and build a short timeline
Save the decision notice and stated reasons, and record when and how it arrived. Keep relevant application, transaction, employment, or service records, along with messages exchanged with the organization. Write down the concrete effect of the decision and the facts that make you think it was wrong or unfair. Keep only information you are entitled to retain, and handle other people’s personal information carefully.

A concise timeline and relevant attachments are also useful if you later complain to a regulator. For example, the European Commission’s AI Act complaint tool asks for the country and a detailed incident description, allows supporting documents, and issues a reference number.

Ask the decision-maker for an explanation and reconsideration
Write to the organization that made the decision or relied on an AI-generated recommendation. Identify the decision and date, state what you believe is wrong, attach relevant evidence, and specify the correction or other outcome you want. Keep a copy of your request and note when it was sent.
Useful questions include:
- Was an automated system involved, and did it make the decision or provide a recommendation to a person?
- What information, criteria, or factors materially contributed to the outcome?
- Is any personal information inaccurate or incomplete, and how can I correct it?
- Can a reviewer consider my explanation and relevant context?
- Who has authority to change the outcome, how do I appeal, and what deadline applies?
- Can the disputed action be paused while the review is pending?
Ask for information relevant to understanding and correcting the outcome; do not assume you are entitled to the system’s source code or every model detail. The European Commission’s data-protection guidance describes rights and safeguards in particular circumstances, not an unlimited right to technical disclosure.
Check whether the human review can actually change the result
A review is meaningful only if the reviewer can assess the evidence rather than simply approve the system’s recommendation. Ask whether that person can consider your information independently and alter the decision. The UK Information Commissioner’s Office (ICO) says meaningful intervention should be active, competent, and carried out by someone with authority and capability to change the outcome. The ICO also warns that automation bias can affect reviewers, so a nominal sign-off may not be an independent review.

European Commission guidance says people generally have a right not to be subject to certain solely automated decisions with legal or similarly significant effects, subject to legal exceptions and safeguards. That is not a universal right to human review whenever AI has influenced a decision. In relevant permitted cases, the Commission says an organization must inform people of the right to human intervention and make the required procedural arrangements.

Choose an escalation route that fits the decision and your location
A regulator may investigate compliance, review a particular type of complaint, or refer a matter; it may not be able to reverse an individual outcome. Identify the country, sector, decision-maker, and suspected harm before choosing a channel.
| Route | When it may fit | What to know before filing |
|---|---|---|
| EU AI Act complaint tool | Alleged AI Act infringement within the European Commission AI Office’s exclusive competence. | The tool asks for your country and an incident description, accepts supporting documents, and provides a reference number. It is not anonymous. With your prior consent and when appropriate, the Commission may refer the complaint to a national market-surveillance authority or an authority overseeing relevant EU-law protections. Other AI Act matters may fall outside this tool; check the Commission’s FAQ and the relevant national competent authority. |
| EU data-protection authority | A concern about personal data or a solely automated decision with legal or similarly significant effects. | European Commission guidance describes rights and safeguards for qualifying cases, subject to legal basis, exceptions, and circumstances. Contact the competent national data-protection authority; the applicable filing deadline is not stated in the cited Commission guidance. |
| UK ICO | A data-protection concern involving AI use in the United Kingdom. | The ICO publishes guidance on safeguards and individual rights, but its guidance page says it is under review following changes made by the Data (Use and Access) Act. Check current ICO material and the relevant law; the cited guidance does not establish a general filing deadline. |
| U.S. EEOC or state/local Fair Employment Practices Agency | Possible employment discrimination involving hiring or work and a protected characteristic. | Federal employment discrimination laws still apply when AI is used. The EEOC says the general charge deadline is 180 calendar days, potentially extended to 300 calendar days where a qualifying state or local agency enforces a law prohibiting discrimination on the same basis. Federal employees and applicants follow a separate process. |
The EU AI Office complaint tool and its whistleblower option are different routes. The whistleblower route may be available to people professionally connected to an AI provider or deployer who meet its eligibility requirements; it permits anonymous reporting. Check the Commission’s separate information for that channel rather than assuming the public complaint tool is anonymous.

For other countries or sectors—including finance, education, housing, health, consumer services, or public benefits—identify the relevant regulator or ombuds service only after checking the facts. The EU AI Office, UK ICO, and U.S. EEOC do not cover every AI-related dispute.
Do not let an internal appeal make you miss an outside deadline
Internal review and external filing are separate tracks. The cited sources do not establish that asking the organization to reconsider pauses a statutory filing deadline, so check the relevant limit independently and promptly. For U.S. employment matters covered by EEOC-enforced laws, confirm whether the 180-day period, a possible 300-day period, or a different federal-employee process applies. Contact the EEOC or the relevant state or local agency to confirm the correct route and timing.
An adverse outcome alone does not establish discrimination. Explain the specific error or unequal treatment you suspect, preserve supporting facts, and identify the relevant protected ground if you believe discrimination occurred. The legal standard and available remedy depend on the jurisdiction and type of decision.
