First check whether the notice invokes section 68 of the Income-tax Act, 1961, or section 102 of the Income-tax Act, 2025; do not assume the same provision governs every tax year or proceeding.
A notice is an allegation or request for an explanation, not by itself a final finding that a credit is bogus. Equally, showing that money passed through a bank account does not alone establish that the transaction was genuine. The facts and evidence in your case matter.

Read the notice before preparing a reply
Use the notice itself as your checklist. Record the exact provision and Act named, the assessment or tax year, the proceeding type, the credit and amount in question, the information or evidence referred to, the response channel, and the deadline. Note every question asked and any specific document requested. Do not rely on a generic description of a “Section 68 notice” to determine what the Department is asking you to answer.
Different notice types and stages can require different responses. The Income Tax Department describes faceless communications and electronic responses, but the notice controls the immediate request and due date. If any part is unclear, seek clarification through the stated channel promptly; do not let that delay a response that is due.

Check which law applies: section 68 or section 102
Section 68 is the unexplained-credit provision in the Income-tax Act, 1961. The Income-tax Act, 2025 labels the corresponding provision section 102, “Unexplained credits.” Department materials list the 2025 Act alongside 2026 rules and transition guidance. The numbering change does not mean you should substitute section 102 for section 68 in a live response: which provision applies depends on the tax year and procedural history.
| Issue | Section 68, 1961 Act | Section 102, 2025 Act |
|---|---|---|
| Provision name and setting | Unexplained credits in books maintained for a previous year. | “Unexplained credits” in books maintained for a tax year. |
| What to check | Whether this is the provision and Act actually named in the notice. | Whether this is the provision and Act actually named in the notice. |
| How to respond to the transition | Do not assume an older or ongoing matter changes provisions merely because a new Act exists. | Check the statute cited in the notice and official transition rules before using this provision. |
The Income-tax Act, 1961, section 68 says a sum credited in an assessee’s books for a previous year may be charged as that year’s income if the assessee offers no explanation of its nature and source, or the Assessing Officer considers the explanation unsatisfactory. For a loan or borrowing, the section also requires an explanation of the nature and source from the person in whose name the credit is recorded, satisfactory to the Assessing Officer. The section has distinct conditions for certain share credits in closely held companies.
The Income Tax Department’s 2026 tutorial summarizes the section 68 threshold as books maintained, a credit during the year, and no explanation or an unsatisfactory one. The label “accommodation entry” does not settle those factual questions. Sections 69 and 69A–69D address other kinds of unexplained items; a credit recorded in books and money or assets not recorded in books may raise different provisions and questions.

Prepare a separate explanation for each credit
Make a transaction-level reconciliation rather than sending a general denial. A working schedule can help you and your adviser track the answer and its evidence; it is a practical aid, not a prescribed statutory form.
| Schedule field | What to record |
|---|---|
| Identification | Date, amount, ledger account, payer or payee, and bank reference or transfer details. |
| Nature | What the credit represents—for example, a loan, share capital, sale proceeds, refund, or another stated category. |
| Context | The transaction’s purpose and commercial context, explained plainly. |
| Reconciliation | How the book entry matches the bank trail and related records, on both sides where those records are available. |
| Evidence index | Attachment name and page number supporting each part of the explanation. |
For every amount, connect the explanation to the records rather than asking the officer to infer the link. If an amount, date, account name, or transfer reference differs across documents, explain the discrepancy directly. If a record is missing, say what is unavailable and why; do not fill a gap with an unsupported assertion.
What documents may help support the explanation?
Choose documents that answer the notice’s questions and support the particular transaction. Depending on the facts, relevant records may include:

For a loan or borrowing under section 68 of the 1961 Act, address the lender’s own explanation of the nature and source, not just the fact that you received a transfer. A confirmation or PAN may help establish identity, but neither alone answers every question about capacity, source, or what actually occurred. No document list guarantees that an explanation will be accepted.

In Udayan Grover, the ITAT discussed creditor identity, capacity or creditworthiness, and transaction genuineness, and considered lender financial statements, bank statements, ledgers, and confirmations in that case. That is an example of factors and records examined on a particular record, not a guarantee that the same bundle will establish every taxpayer’s case.

- Identify the notice and credit. State the provision and year cited, then identify the specific entry or entries being addressed.
- Explain the nature and source. Describe what each credit represents, who provided it, why it was received, and the source relevant to the allegation.
- Connect the evidence. Refer to the corresponding ledger, bank, agreement, invoice, or other record by attachment and page number.
- Answer each request. Address every question in the notice. Explain inconsistencies, unavailable records, or limits in what you can provide rather than leaving them unexplained.
- List the enclosures and submit on time. Use the channel stated in the notice, retain the final response and uploaded files, and save the submission acknowledgement.
Avoid blanket statements that the counterparty alone is responsible, unsupported claims that a transaction is genuine, or altered or reconstructed documents presented as contemporaneous records. An organized bank trail is useful evidence, but it does not by itself resolve the nature, source, or genuineness of a credit.

If a proposed addition relies on an investigation statement or other third-party material that was not supplied to you, identify the material and explain why it is needed to answer the allegation. You may request a copy and an opportunity to rebut it; where appropriate, you may also request an opportunity to cross-examine the maker. Make the request in the context of the specific material and the way it is being relied on.
In Blue Circle Organics, the ITAT discussed reliance on a statement that had not been provided to the assessee and the opportunity to test it. The case illustrates a possible procedural issue; it does not mean every undisclosed statement automatically invalidates an addition.

If the proposed legal basis changes
Read any later communication for changes to the alleged facts or provision. A credit recorded in books under section 68 is not the same allegation as money not recorded in books potentially addressed under section 69A. If the proposed basis changes, explain why the new allegation calls for a different factual answer and address it specifically; do not assume your earlier reply covers it.
Vishal Jhajharia distinguishes those provisions and discusses the opportunity to respond to a changed basis in its circumstances. Its application depends on the record and procedural history of the individual case.
Understand the possible tax consequence without assuming a personal bill
The Income Tax Department’s 2026 tutorial describes section 115BBE as providing a 60% tax rate for specified income under section 68 and related provisions. It also describes a 25% surcharge and 6% penalty and gives an 84% final-rate calculation including cess, subject to the conditions discussed in the tutorial. These are the Department tutorial’s published figures and explanation, not a calculation of what any particular taxpayer owes.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsWhether the provision applies, how surcharge and cess are calculated, and whether a penalty applies depend on the facts, tax year, applicable law, and relevant amendments. The Department’s tutorial advises checking the Acts, Rules, and notifications. Do not treat “84%” as a universal rate or a substitute for advice based on your notice and records.
When to get professional help
Consider a chartered accountant or Indian tax lawyer if the amount is substantial, the deadline is close, the funding trail is complex, an entry operator is alleged, third-party material has not been provided, or the proposed statutory provision has changed. The governing Act, available objections, evidence needed, any extension, tax and penalty exposure, and possible appeal steps are individual-specific; a general article cannot determine them.
