How to Respond to a GST Show-Cause Notice Under Section 74

Learn how to analyse a GST Section 74 notice, reconcile the demand, answer the fraud allegation with evidence, file FORM GST DRC-06, request a hearing and assess payment and limitation consequences.

Do not answer a Section 74 GST notice with a generic denial or an unexplained payment. First preserve the notice and service evidence, identify every proposed tax, interest, penalty, refund or input-tax-credit adjustment, and separate the underlying tax dispute from the allegation of fraud, wilful misstatement or suppression of facts to evade tax. Reconcile the figures to your returns and books, prepare a document-backed response to each allegation, file it through the route specified in the notice (usually FORM GST DRC-06 where Rule 142(4) applies), and request a hearing in writing where appropriate. The notice, tax period, State GST provisions, current rules and your records determine the correct response and whether any payment option is sensible.

What a Section 74 notice means

Section 74 of the Central Goods and Services Tax Act, 2017 is the fraud-related demand route. It can be used where the proper officer alleges that tax was unpaid or short-paid, an erroneous refund was issued, or input tax credit was wrongly availed or utilised by reason of fraud, wilful misstatement or suppression of facts to evade tax. The notice seeks a response to why the specified tax, interest under Section 50 and penalty should not be paid. Section 74(1) describes the notice as “requiring him to show cause as to why he should not pay the amount specified in the notice”.

A numerical mismatch alone does not establish the Section 74 ground. Your reply should deal with two separate questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Is the proposed tax, refund or input-tax-credit computation factually and legally correct?
  • Do the evidence and facts establish fraud, wilful misstatement or suppression of facts to evade tax?

A notice may be defective, overstated or based on incomplete information, but that conclusion must be tied to the exact allegations, dates, calculations and documents in your case. State GST enactments generally operate alongside the CGST framework, yet the relevant State provisions and portal instructions should be checked for the registration concerned.

Break the notice into identifiable issues

Item to identify Questions to answer
Nature of demand Is it alleged unpaid or short-paid tax, an erroneous refund, or wrongly availed or utilised input tax credit?
Tax period Which financial year, return period, refund application or transaction is covered?
Legal basis Which charging, exemption, classification, credit, interest, penalty and Section 74 provisions are cited?
Amount How were tax, interest and proposed penalty calculated, and do the totals reconcile?
Fraud-related ground What specific conduct is said to be fraudulent, wilfully misstated or suppressed to evade tax?
Evidence Which invoices, statements, returns, e-way bills, ledgers or other records does the officer rely on?

What to do immediately after service

  1. Preserve the complete record. Save the notice, annexures, portal download, email or other service message, issue date, reference number and any earlier communication such as a DRC-01A intimation. Keep the files in their original form and make a working copy for annotation.
  2. Record the response deadline exactly as stated. Do not assume a universal number of days. Calculate from the notice and applicable law, taking account of how and when it was served, and check any portal-generated due date.
  3. Check the scope. Confirm that the registration, tax period, places of business, transactions and amounts belong to you. Mark allegations that concern another period or entity.
  4. Protect evidence. Collect electronic and paper records before routine retention or system changes remove them. Keep an index and a read-only copy of anything filed.
  5. Obtain case-specific advice early. A chartered accountant or GST lawyer can test the Section 74 allegation, limitation, computation and payment consequences against the live file.

Build an allegation-and-evidence matrix

Use one row for every distinct allegation rather than answering the notice as one block. This prevents a calculation issue from being mistaken for an admission of fraud and exposes missing evidence.

Notice allegation Your factual position Documents to check Response status
Tax, refund or credit item and period What happened, when and with whom? Invoices, contracts, ledgers, returns, refund records Admitted, disputed, incomplete or incorrectly described
Calculation Which figure is wrong and why? Reconciliations, payment challans, credit notes, workings Accept, partially accept or contest with alternative computation
Fraud, wilful misstatement or suppression What fact is said to have been hidden or misstated? Filings, correspondence, disclosures, internal approvals Address each asserted element separately
Officer’s supporting evidence Is it complete, authentic and attributable to this registration? Annexures, third-party data, statements and source records Explain omissions, contradictions or lack of linkage

Reconcile the proposed demand to your records

For alleged short-paid or unpaid tax

Compare the officer’s transaction list with sales registers, tax invoices, credit and debit notes, contracts, outward-supply returns, tax-payment records and the general ledger. Test place of supply, rate, exemption or reverse-charge treatment, timing, amendments and duplicate entries. Show the reconciliation by tax period and preserve the workings behind every total.

For an alleged erroneous refund

Match the refund application, statements, invoices, shipping or export records where relevant, payment evidence and the order or sanction details. Identify whether the alleged excess arose from a clerical error, a later adjustment, a duplicate claim or a different interpretation of eligibility. Do not describe a document as filed or available unless it is actually in your possession.

For wrongly availed or utilised input tax credit

Reconcile the credit ledger with purchase registers, tax invoices, supplier information, receipt and use of goods or services, payment records, reversals and subsequent amendments. Distinguish credit that was never availed from credit that was availed but not utilised, because the notice may treat those situations differently. Explain invoice-level exceptions instead of relying only on an aggregate reconciliation.

How to draft a defensible reply

1. Identify the notice and state your position

Begin with the GSTIN, notice number, issue date, tax period and the communication being answered. State whether each allegation is admitted, denied, partly admitted or cannot be answered because information is missing. If you need a short extension or additional material, say so promptly and explain why; do not let that request replace a substantive response where the deadline is running.

2. Answer every allegation in the notice’s order

Use numbered headings that mirror the notice. For each proposed demand, set out the relevant facts, the amount you accept or dispute, the legal reason, and the document or annexure supporting it. If the notice combines several transactions, provide a transaction-level schedule. Explain errors in period, classification, rate, credit matching, attribution, arithmetic or duplicate counting.

3. Address the Section 74 ground separately

Do not assume that disproving the tax amount automatically answers the fraud allegation. Explain why the cited conduct does or does not show fraud, wilful misstatement or suppression of facts to evade tax. Point to disclosures in returns, invoices, books, prior correspondence, audit material or other records where those records genuinely exist. If the notice identifies no specific act or evidence, say precisely what is missing and why that omission matters.

4. Provide a clear alternative computation

Where you accept part of the demand, show the accepted principal, the method used for interest and the disputed balance. A transparent schedule is more useful than a bare assertion that the officer’s total is wrong. Reconcile each subtotal to the return, ledger or payment record cited.

5. Include an indexed annexure set

Number every document and cross-reference it in the text. Use legible scans, preserve page order and identify the relevant invoice, entry or paragraph. Separate confidential material where permitted, and do not submit irrelevant records that obscure the issues.

6. State the relief requested

Ask for the notice to be dropped to the extent the demand or Section 74 ground is not established. If an amount is accepted, state the treatment sought for the balance and interest. Request inspection or clarification of relied-upon material when necessary, and make a written hearing request where you want to present oral submissions.

Filing the reply through the GST system

Rule 142(4) provides that a representation or reply to a notice whose summary has been uploaded electronically in FORM GST DRC-01 is furnished in FORM GST DRC-06. The live portal may change labels or navigation, so follow the notice’s filing instructions and the current GST portal workflow rather than an old screenshot or checklist.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Open the notice from the registration’s electronic liability or notices area and verify that it is the correct DRC-01 communication.
  2. Select the available reply or representation option and confirm that FORM GST DRC-06 is the prescribed form for that notice.
  3. Enter a concise issue-wise summary in the form and attach the signed detailed reply, computation schedules and indexed evidence in the permitted file formats and size limits.
  4. Submit using the authorised signatory’s required authentication method. Check that the final text and every attachment are the versions you intend to file.
  5. Download the acknowledgement, ARN or filing reference, the submitted form and the complete attachment set. Record the date and time and keep an unchanged copy.

The CGST Rules text commonly circulated for this procedure is amended through 1 January 2022. Later amendments, portal changes and notice-specific directions must be verified before filing. If the portal fails, preserve screenshots, error messages and attempted-submission times, then use the official support or alternative channel identified in the notice.

Hearing, order and what follows

Section 75 contains hearing safeguards. Request a hearing in writing when you need to explain evidence, challenge relied-upon material or present an alternative computation. Retain proof that the request was made. The adjudicating order should state the relevant facts and the basis for the decision; compare its findings with each issue and submission in your reply.

If the order confirms a demand, note the date of service immediately and obtain advice on payment, rectification, review or appeal under the applicable statutory route and deadline. Preserve the notice, reply, hearing record, relied-upon documents and order as one indexed case file. A missed appeal period can be difficult to cure.

Payment routes and their consequences

Payment can be available before notice, after notice or after determination, but paying is not automatically the best strategy. First decide whether the liability, the Section 74 allegation and the amount are defensible; then compare the statutory consequence and cash-flow effect of each route with professional advice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Stage Statutory position Practical consequence
Before service of notice or statement Section 74(5) allows payment of tax with applicable interest on self-ascertainment or the officer’s ascertainment, followed by information to the proper officer. Check the exact amount, documentation and whether payment could affect a later dispute. Do not describe a payment as resolving a fraud allegation without confirming the applicable provision and facts.
Within 30 days of issue of the show-cause notice Under Section 74(8), payment of the specified tax and interest within 30 days results in no penalty being payable and proceedings in respect of that notice being deemed concluded. Confirm the statutory trigger, amount, issue date and proof of payment. The route may be unsuitable if you dispute liability, computation or the Section 74 basis.
After representation and determination Section 74(9) provides for an order determining tax, interest and a penalty equivalent to the tax where the case proceeds to determination. Review the order and any available statutory remedy immediately; do not assume that later payment carries the same consequence as the 30-day route.

Rule 142 discusses electronic intimation of payments in FORM GST DRC-03 and related acknowledgements or orders. Because the available rules text has since undergone amendments, verify the current form, accounting treatment, portal process and whether the payment is linked to the specific notice. Keep challans, debit evidence and acknowledgements with the case file.

Limitation and the Section 73 consequence

Section 75(2) provides that where an appellate authority, tribunal or court concludes that a Section 74 notice is unsustainable because the fraud, wilful-misstatement or suppression charge was not established, determination is to proceed as if the notice had been issued under Section 73. That does not guarantee that the demand survives.

CBIC Circular 185 explains that, in the situations it discusses, if the original Section 74 notice was already beyond the applicable Section 73 notice deadline, the proceedings may have to be dropped rather than saved by recharacterising them as Section 73 proceedings. The circular discusses a two-years-and-nine-months notice period for those described circumstances. This is not a universal deadline for every Section 74 case. Check the relevant financial year or erroneous-refund date, statutory extensions, issue and service dates, court stays and amendments against the live file.

Why Section 128A is not a general Section 74 waiver

Section 128A and Rule 164 concern a conditional waiver of interest or penalty, or both, for specified Section 73 demands. CBIC Circular 238/32/2024-GST describes coverage for Section 73 demands relating to financial years 2017-18, 2018-19 and 2019-20 and refers to 31 March 2025 as the notified full-payment date for the cases it discusses. That provision is not a blanket waiver for a demand that remains under Section 74.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If a case is changed or redetermined under Section 73, eligibility would require a separate check of the current Act, rules, notifications and circulars. Do not claim the relief merely because the underlying tax period falls within those financial years.

Common mistakes that weaken a response

  • Sending a one-line denial without answering the calculation or identifying supporting records.
  • Treating a tax difference as proof of fraud without analysing the distinct Section 74 elements.
  • Ignoring an allegation because it concerns only one invoice, credit note or return period.
  • Using a reconciliation total that cannot be traced to ledgers, returns or payment evidence.
  • Uploading unreadable scans, unindexed annexures or a draft that differs from the signed copy.
  • Missing the notice-specific deadline while waiting for an informal extension.
  • Relying on an old DRC-03, DRC-06 or portal procedure without checking current instructions.
  • Paying to end the matter without understanding whether the payment route removes penalty, concludes proceedings or preserves any challenge.
  • Failing to request a hearing in writing or losing proof that the request and reply were submitted.
  • Assuming Section 128A automatically applies to a Section 74 notice.

Final filing checklist

  • Notice, annexures, service proof, reference number and deadline saved.
  • Every allegation mapped to a period, amount, legal provision, evidence and response.
  • Returns, invoices, ledgers, e-way bills, contracts, correspondence, credit records and payment data reconciled as relevant.
  • Fraud, wilful-misstatement or suppression allegation answered separately from the tax computation.
  • Alternative computation and accepted or disputed amounts clearly shown.
  • Reply signed by the authorised person, with a legible index and cross-referenced annexures.
  • FORM GST DRC-06 and any payment form used only after confirming the current portal and notice instructions.
  • Hearing requested in writing where needed, with proof retained.
  • Acknowledgement, submitted files, payment evidence and later order monitored in one case record.
  • Limitation, appeal and any relief provision checked against the current law before making a final strategic choice.
