Before sending funds to an Ethereum token presale, verify who is offering it, what rights the token gives you, how the money will be used, and whether the contract and legal disclosures match the project’s claims. Treat a whitepaper, audit, registration-related claim, or popular social account as evidence to check—not proof that the sale is safe. No specific issuer or contract is identified here, so this is a due-diligence framework, not a verdict on an individual presale.
1. Identify the issuer and the actual offering
Start with the offering, not its promotion. Find the project’s primary website and original sale documents independently; do not rely on a link in a direct message, an advertisement, or a social post. Then record the details that let you check whether all the materials refer to the same sale:
As an Amazon Associate I earn from qualifying purchases.
- The issuer’s legal name, jurisdiction, and accountable people.
- The token’s exact name and the Ethereum network on which it is being sold.
- Sale dates, payment recipient, and the documents governing the purchase.
- The contract addresses, if published, and which contract performs each role.
If the issuer, recipient, sale terms, or network is hard to identify—or different project materials give conflicting answers—do not send funds until you can resolve the discrepancy through independently verified channels.

Use of proceeds and token rights
Read the whitepaper, business plan, roadmap, and token terms. Look for a clear account of how contributions will be used and what legal or practical rights the token gives its holder. A token’s name or marketing description is not a substitute for those terms. The SEC’s Investor Bulletin: Initial Coin Offerings advises prospective buyers to ask what the money will be used for and what rights the tokens provide.

Refunds, restrictions, and allocation
Check the written terms for refund conditions, vesting or lockups, resale restrictions, and the allocation reserved for founders, employees, or other insiders. Determine what happens if the project misses milestones, changes its plans, or is abandoned. If an important condition is absent or vague, treat it as unknown rather than assuming the project will act in your favor.
3. Check the legal disclosures for the sale
Depending on the facts and circumstances, a token offering may involve securities. Read what the issuer says about registration or a claimed exemption, and independently verify any filing it cites. A filing is not the same as SEC approval or an endorsement of the investment.
The SEC’s educational page Transactions Involving Crypto Assets, dated April 22, 2026 and last reviewed or updated April 29, 2026, explains that a crypto asset may be offered subject to an investment contract even if the asset itself is not a security. Classification depends on the transaction’s facts. This is U.S.-focused information; it does not determine the law in another country or classify an unnamed presale. For a specific offering, jurisdiction and individual circumstances matter, so consult a qualified legal professional if you need advice about your obligations or rights.

Match the address and network
Find each contract address in original project documentation, then compare it with the address displayed on an explorer for the stated network. Do not assume that a token with a familiar name or ticker is the same asset: names can be duplicated. Check whether the sale contract and token contract are separate, and confirm which one receives funds and which one governs token behavior.

Inspect published code and administrator powers
Look for source code published for the relevant contract and compare its verified address and code with the project’s claims. If you cannot interpret the code yourself, do not treat an explorer’s verification label as a safety assessment; seek help from someone qualified and independent of the issuer.
Review whether an administrator can mint tokens, pause transfers, blacklist addresses, change fees, upgrade the contract, or withdraw funds. Compare those powers with the written sale terms. The SEC’s ICO investor bulletin specifically recommends asking whether the blockchain is public, whether code has been published, and whether there has been an independent cybersecurity audit.
5. Evaluate the audit as a limited review
Read the audit report itself, rather than relying on a logo or claim that the project was “audited.” Check the auditor’s identity, the report date, the exact contract address and code version reviewed, the scope of the work, and any unresolved findings. Establish whether the deployed code changed after the review; an audit of an earlier version does not establish that later code was examined.

6. Verify the people, product, and outside claims
Check team identities and experience using independent, attributable sources. Look for evidence that the claimed product or network exists. If the project names a partner, exchange listing, user, or endorser, look for confirmation from that other party—not just a project announcement.
Follower counts, testimonials, celebrity endorsements, polished websites, and professional-looking documents are not independent verification. The SEC’s investor materials warn about testimonials and impersonation or fake materials in crypto-related scams. Be especially careful when an account or support contact cannot be authenticated outside the project’s own channels.
7. Recognize pressure tactics and suspicious payment demands
- Guaranteed high returns or claims of little or no risk: treat these as warning signs, not evidence of likely performance.
- Urgency or unsolicited offers: pause rather than letting a countdown, private message, or limited-time claim rush your decision.
- Instructions to send crypto to a wallet: verify the recipient and payment terms independently before any transfer; a transfer may be difficult or impossible to reverse.
- Extra fees or taxes demanded to withdraw a displayed balance: do not send more money simply to unlock funds or recover losses.
A May 29, 2024 SEC Office of Investor Education and Advocacy alert describes schemes that use a supposed crypto “pre-sale” to promote a memecoin before selling, along with fake interfaces, additional withdrawal-fee demands, and recovery scams. A balance shown on a website or app is not by itself proof that funds exist or can be withdrawn.
8. Protect your wallet before interacting
Never give an issuer, promoter, support agent, or recovery service your seed phrase or private key. The SEC’s Crypto Asset Custody Basics for Retail Investors (December 12, 2025) emphasizes that self-custody makes the holder responsible for protecting private keys and warns against sharing keys or seed phrases.

Do not sign a wallet transaction unless you understand what it authorizes, which contract it interacts with, and who receives the funds. If the requested permissions or recipient are unclear, stop and verify them through a trusted, independent channel. A legitimate-looking support conversation does not make a wallet request safe.
9. Compare offerings on the same evidence
If you are assessing more than one presale, use the same questions for each rather than letting a high-profile claim or token price dominate the comparison. These dimensions organize evidence; they are not a scoring formula or an endorsement.
| What to compare | Evidence to look for |
|---|---|
| Issuer and accountable team | Disclosed legal entity, jurisdiction, responsible people, and independently attributable identity or experience. |
| Token economics and rights | Use of proceeds, token rights, insider allocation, vesting or lockups, and clear refund and resale terms. |
| Legal disclosures | Jurisdiction and the issuer’s stated registration or exemption position, with any cited filing independently checked. |
| Contract and audit | Matching network and address, published code, administrator powers, audit scope and date, and unresolved findings or later code changes. |
| Project progress and claims | Evidence of a product or network and confirmation from named partners, users, exchanges, or endorsers. |
| Payment and pressure | Clear sale mechanics and recipient, with no reliance on urgency, guaranteed returns, or unexplained extra payments to withdraw. |
10. Decide whether you can accept the downside
A presale token may be illiquid, never become tradable, or lose value; the project may fail, change terms, or lose access to funds. The SEC’s Exercise Caution with Crypto Asset Securities: Investor Alert identifies risks including volatility, illiquidity, technical failures, opaque control, and limited recovery. Consider whether you could withstand losing your entire contribution, and do not borrow or use money needed for essentials.
There is no reliable presale-specific success or fraud rate established by the official sources cited here. A general checklist cannot predict an individual project’s outcome. If material terms, controls, or claims remain unverifiable, that uncertainty is part of the decision—not a reason to assume the best.
