There is no single nationwide form, eligibility rule, deadline, fee, or appeal process. A clear request identifies existing records, gives enough detail to find them, and says whether you want to inspect them, receive copies, or both.
1. Identify the office and the right process
Start with the prosecutor’s public-records page and confirm that the office is likely to hold what you want. A prosecutor’s office may have its own policies, correspondence, contracts, reports, or some case-related records. Police, courts, sheriffs, and other agencies may hold other material. If you need a court-filed document or transcript, contact the court with jurisdiction over the case; California DOJ, for example, directs transcript requests to the court rather than its public-records process (California Department of Justice public-records guidance). Criminal discovery is a separate process from a public-records request.

Check the office’s current instructions for the records officer, submission channel, form, eligibility requirements, fees, and appeal procedure. The methods differ: Pennsylvania’s Office of Attorney General accepts requests by web form, mail, fax, or email (Pennsylvania Right-to-Know); Arizona’s Attorney General points requesters to its online public-records center and other methods (Arizona public-records request guidance); Nashville’s District Attorney General specifies a written form for copies or inspection (Nashville open-records requests). Follow the instructions for the particular office rather than assuming another agency’s method applies.

2. Write a request the office can search
Ask for existing records, not an answer to a question, legal advice, or a new analysis. Texas’s Attorney General distinguishes a records request from a question and recommends submitting the request in writing to the entity believed to hold the information (Texas guidance on requesting public information).
Describe the records with enough detail to make them identifiable. Include, when known:
- The record types you want, such as policies, correspondence, logs, or reports.
- The person, organization, subject, or matter involved.
- A date range.
- A case, matter, or incident number.
- The likely unit or office that holds the records.
Pennsylvania, California, and Arizona all advise requesters to provide enough detail or specificity to identify the records. A focused date range and known identifier can help distinguish a useful request from a broad request for everything about a person or case.

Adaptable wording
Use the office’s required form if it has one. Otherwise, you can adapt this wording, after checking local requirements:

To the Public Records Officer: Under [state law or office procedure, if known], I request [inspection, copies, or both] of existing records concerning [specific subject, person, entity, or matter] for [start date–end date]. Please include [record types] held by [unit, if known]. The matter, case, or incident number is [identifier, if known]. If any portion is withheld, please identify the legal basis and release any reasonably segregable non-exempt portions. Please contact me before fees exceed [amount]. My contact details are [details required by the office].

The wording is a practical template, not a guarantee that an office accepts every phrase or that every state requires an explanation for withheld material or honors a fee cap. Check the office’s form and rules, and provide any contact or identity information it requires.
3. Check eligibility, delivery options, and costs
Do not assume you must explain why you want records—or that every requester can remain anonymous. Pennsylvania says a reason is not required. Ohio’s general guidance says a requester may be anonymous. Nashville’s policy calls for evidence of Tennessee citizenship, while Idaho requires a residency declaration and applies different processing periods based on residency. These are jurisdiction-specific examples, not rules that can be transferred to another prosecutor’s office.

Where the office allows it, state whether you want to inspect records, receive copies, or both. Ask about electronic delivery if that matters to you, and consult the current fee schedule before requesting extensive copying. Published figures below are examples from agency pages; they are not national rates and may change:
| Agency and source | Response or decision timing | Fee example | Appeal timing |
|---|---|---|---|
| Pennsylvania Office of Attorney General (Right-to-Know; year not stated on page) | Written requests receive a response within five business days, according to the page. | $0.25 per printed page for the first 1,000 pages, then $0.20 per page, according to the displayed schedule; page gives no year. | Appeal a denial or deemed denial within 15 business days, according to the page. |
| California Department of Justice (Public Records; year not stated on page) | Ten days to determine whether to disclose; a limited 14-day extension may apply. | $0.10 per page as direct duplication cost, according to the page. | not stated (California DOJ page) |
| Idaho Office of the Attorney General (Public Records; effective July 1, 2024) | Up to 10 working days for Idaho residents; up to 35 days for nonresidents. | not stated (Idaho OAG page) | not stated (Idaho OAG page) |
| Ohio Attorney General (Public Records Act; accessed October 4, 2026; publication date not stated) | No fixed period stated in the guidance; it describes prompt access for inspection and a reasonable period for copies. | not stated (Ohio Attorney General page) | not stated (Ohio Attorney General page) |
California’s and Pennsylvania’s pages do not state a year for the cited figures, and published schedules can change. Verify the target office’s current fee schedule and timing before relying on any figure. For other states and local prosecutor offices, the current office page and governing law control; the examples above do not establish a national deadline or price.

4. Submit and keep a record
- Use the prosecutor’s current public-records page to select its required form and permitted submission method.
- Complete required identity, residency, address, or contact fields. Do not substitute a different agency’s form or eligibility rules.
- Send the specific record description and indicate inspection, copies, or both where the office permits that choice.
- Save the submitted request, confirmation, email, receipt, and any mailing or delivery tracking information.
- Record the office’s stated response or appeal date, if provided, and monitor its response channel.
5. Understand possible redactions and denials
A public-records law does not necessarily make every record held by a prosecutor available. Depending on the governing law and the record, an office may withhold or redact material involving active investigations, privileged communications, attorney work product, confidential legal advice, drafts, litigation, or other legally protected information. Pennsylvania and California list examples of protected records; Arizona cautions that records held by its law office may be protected by attorney-client privilege or work product doctrine. Those examples do not decide whether a particular record is exempt.
An office may release some portions while withholding others. If it denies access or redacts material, read the written explanation and follow the appeal or complaint instructions promptly. Procedures and deadlines are local: Pennsylvania’s page, for example, gives 15 business days to appeal a denial or deemed denial. Do not apply that deadline to a request in another state; check the notice and governing procedure for your office.
