How to Request or Challenge ALPR Data About Your Vehicle

A practical guide to identifying the right agency, requesting ALPR records, challenging a suspected misidentification, and understanding state-specific limits on access and retention.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

To find out whether an agency recorded or used automated license plate reader (ALPR, also called LPR) data about your vehicle, contact the agency that operated the camera, searched the system, or acted on an alert. Make a specific written request for records the law allows it to disclose, and promptly ask the agency to review and preserve information if you suspect a misidentification. There is no single nationwide form or guaranteed right to receive your identifiable scan history; the rules depend on your state, the agency, the records involved, and whether they relate to an investigation or proceeding.

What to request—and what may be separate

ALPR systems read license plates and can create records associated with a plate, a time, and a location. An agency may hold several kinds of related records, and a request for one kind does not necessarily cover the others.

As an Amazon Associate I earn from qualifying purchases.

  • Vehicle-specific ALPR data: scans, alerts, or other identifiable records associated with your plate, if disclosure is allowed.
  • Policies and schedules: the agency’s ALPR usage and privacy policy, retention schedule, and any public-facing procedures.
  • Incident or enforcement records: reports, citations, dispatch records, or other records connected to a stop or case.
  • Audit, access, export, or sharing records: logs showing system use or data transfers, if those records are subject to disclosure.

Agencies may treat policies or non-identifying records differently from a request for identifiable scan history. A public-records request does not guarantee access to a personal travel history.

How to make a focused request

  1. Identify the likely agency

Start with the police department, sheriff, state police, or other public agency that may have operated the camera, searched the system, or responded to an alert. If you are unsure who holds the records, ask the agency’s records officer who maintains ALPR records and which request channel applies.

  2. Give enough detail to locate the records

In writing, include the plate number and issuing state, the relevant date or date range and approximate time, the location, and a description of the vehicle. Add a citation, incident, or case number if you have one. Be as precise as you can: a narrow time and location can help distinguish a particular event from a broad request for scans.

  3. Separate the record categories

List the records you want as distinct items: any vehicle-specific ALPR record the agency may disclose; its usage or privacy policy and retention schedule; related incident or enforcement records; and available access, audit, export, or sharing records. This makes it clearer which parts of the request concern your identifiable data and which concern general policy or an incident.

  4. Ask for an explanation if records are withheld

If the agency denies or redacts a record, ask it to identify the legal exemption it is applying and whether a non-identifying or otherwise segregable portion can be released. The scope of access depends on the applicable law; do not assume that a general public-records statute entitles you to identifiable ALPR scans.

How the rules differ: Washington, Virginia, and California

These official examples show why the state and agency matter. They are not a survey of every state, and an agency’s own policy may also be relevant.

Jurisdiction and source Retention and audit trails Disclosure and policy What it means for a vehicle owner
Washington
Chapter 10.130 RCW, effective March 30, 2026
Ordinary ALPR data has a 21-day retention ceiling, subject to statutory exceptions including judicial process, parking enforcement, traffic studies, commercial vehicle enforcement, and evidence of specified unlawful conduct. Audit trails must be retained for two years and include required details such as user, access time, query, purpose, case number, camera location, and exports or sharing. Identifiable ALPR data is exempt from the Washington Public Records Act, except for qualifying bona fide research without individually identifiable information. Do not assume a request will produce your scans or a named-person audit trail. The statute also limits ALPR use and says a positive match alone is not reasonable suspicion for a stop.
Virginia
Code § 2.2-5517
System data must be purged after 21 days and audit-trail data after two years, with exceptions for ongoing investigations, prosecutions, or civil actions through final disposition. Audit trails cover queries, responses, data access, entry, update or sharing, date and time, plate or query elements, purpose, case number, and user. System data and audit-trail data are exempt from the Virginia Freedom of Information Act. A FOIA request does not necessarily provide identifiable scan history. The statute restricts law-enforcement system use to specified investigation, missing or endangered person, and alert purposes.
California
California DOJ Division of Law Enforcement Information Bulletin 2023-DLE-06, published October 27, 2023; SB 34, Civil Code § 1798.90.5 et seq.
Retention period: not stated in the cited DOJ guidance. The guidance describes SB 34’s rules for ALPR collection, storage, sharing, and use, and highlights agency privacy and usage policies. It says agencies must provide the public with a written usage and privacy policy. The guidance does not establish a blanket right to a person’s identifiable scan history or a universal correction process. Request the agency’s written policy to learn its stated rules. Check current state law and agency procedures for access to particular records.

Washington’s statute also states: “A positive match by an automated license plate reader system alone does not constitute reasonable suspicion as grounds for a state or local law enforcement officer to stop the vehicle.” That is a Washington-specific rule, not a nationwide standard.

How to challenge a suspected incorrect hit

Contact the agency that acted on the alert, not only the agency that may have operated the camera. Send a concise written request for review with the date, location, case number if known, plate jurisdiction, and identifying details that distinguish your vehicle. Attach relevant supporting evidence, such as registration or accurate vehicle details, while avoiding unnecessary personal information.

Ask the agency to review how the plate match was made, whether the alert was confirmed, and whether the information was retained or used in an investigation. You can also ask for correction or annotation if the agency has a process for it, and request preservation of the relevant records while the issue is reviewed. A request to correct data does not, by itself, establish a legal right to correction or guarantee that the records will be preserved.

If an ALPR alert led to a stop or enforcement action

Keep the citation, incident report, case number, agency correspondence, and your own notes of the time and location. Ask which alert or database was involved, how the plate match was verified, and whether the information was retained or used in an investigation. If a criminal or civil matter is pending, get advice from a lawyer familiar with the jurisdiction and case; records-access requests are not a substitute for case-specific legal advice.

Why timing matters

Retention periods can be short, and a preservation request should be made as soon as you identify a relevant event. The Washington and Virginia examples above each have a statutory default period for system data, but their exceptions differ; neither period should be treated as a nationwide rule. Ask the agency to confirm the deadline and applicable retention rule. Do not assume that submitting a request automatically suspends deletion.
