How to Request a Bathroom-Break Accommodation at Work

A practical guide to asking for more frequent or flexible bathroom breaks at work, with the key differences between pregnancy-related and disability-related accommodations.

Tell your manager, HR, or the workplace contact who handles accommodations that a medical or pregnancy-related limitation affects your work and that you need more frequent or flexible bathroom breaks. You can ask in person or in writing; no special legal phrase or form is required. What documentation an employer may request depends on whether the need is pregnancy-related under the Pregnant Workers Fairness Act (PWFA), disability-related under the Americans with Disabilities Act (ADA), or covered by state or local law.

How do you ask for more bathroom breaks?

Make the request to your manager, HR, or the person named in your employer’s accommodation policy. Explain the work-related limitation and the change you need. You do not have to say “reasonable accommodation” or name a law to start the discussion. The EEOC gives this example for a pregnancy-related request: “I need more bathroom breaks because of my pregnancy.” (EEOC guidance on the PWFA; EEOC ADA guidance.)

You may ask orally or in writing. An email is not mandatory, but it can help record when you asked and what arrangement you proposed. You need not provide a detailed diagnosis in your initial message; focus on how the limitation affects work and what change would help.

A simple message you can adapt

Subject: Request for bathroom-break accommodation

Hi [manager or HR contact], I have a [brief description of limitation, if you are comfortable sharing] that affects my work, and I need more frequent or flexible bathroom breaks. Could we discuss an arrangement that lets me use the restroom when needed while meeting my job responsibilities? I can explain the work-related limitation and discuss options. Please let me know the next step in the accommodation process.

Use only the detail you are comfortable sharing at this stage. The employer may ask follow-up questions or, in some circumstances, request supporting information; the rules differ for pregnancy-related and disability-related requests.

What should you explain about the schedule or work barrier?

Describe the practical problem as clearly as you can: for example, that a fixed break schedule does not work for your condition, or that a task requires coverage before you can step away. If you know what would help, say whether you need breaks to be more frequent, longer, or flexible. You do not need to propose a perfect timetable to make a request.

There is no universal EEOC schedule for restroom breaks. The useful question is whether the arrangement lets you use the restroom when medically needed and can be implemented alongside the job’s essential duties. If coverage or timing is a concern, discuss how the workplace might handle those moments rather than assuming that a particular schedule is required.

Which law may apply: pregnancy, disability, or both?

Pregnancy-related needs under the PWFA

The PWFA covers known limitations related to, affected by, or arising out of pregnancy, childbirth, or related medical conditions. For a covered worker, the employer generally must provide a reasonable accommodation unless it would cause undue hardship. The EEOC specifically lists additional, longer, or more flexible restroom breaks as possible accommodations. Covered employers include private and state or local public employers with 15 or more employees, as well as Congress and federal agencies, employment agencies, and labor organizations. The law took effect June 27, 2023. The EEOC’s final implementing regulation was issued April 15, 2024, and took effect June 18, 2024. Eligibility and how the law applies still depend on the facts and employer coverage.

Disability-related needs under the ADA

Pregnancy itself is not an ADA disability, though some pregnancy-related conditions may meet the ADA’s definition of disability. More generally, the ADA may protect a qualified worker with a disability who needs a workplace change to perform essential job functions or access employment benefits. Whether the ADA applies depends on the individual’s condition, job, and circumstances. (EEOC ADA guidance.)

Under ADA guidance, an employer may seek reasonable supporting medical information when the disability or need for accommodation is not obvious or already known. If the exact arrangement requested is not workable, the employer may discuss an effective alternative; the relevant question is whether it meets the worker’s accommodation need.

Can an employer require a doctor’s note?

Not always. The EEOC says it is not reasonable to require documentation when a currently pregnant employee needs bathroom breaks. That specific PWFA guidance should not be treated as a blanket rule for every pregnancy-related request or every disability-related request. (EEOC PWFA questions and answers.)

For an ADA request, an employer may ask for reasonable supporting medical information if the disability and the need for the requested change are not obvious or already known. The ADA and PWFA documentation rules are not interchangeable. State or local law may also affect rights and procedures.

What happens after you make the request?

The employer should respond promptly and discuss the known limitation and the adjustment needed. The EEOC describes the PWFA interactive process as communication between employer and employee about the limitation and the work change needed. In an ADA discussion, the parties likewise consider what is needed and why; if a different option is proposed, it should effectively accommodate the worker. (EEOC PWFA guidance; EEOC ADA guidance.)

When comparing options, discuss whether you can use the restroom when needed, how the arrangement fits your duties and any coverage requirements, and whether it may need review if the condition changes. These are practical points for the conversation, not a required EEOC checklist.

What if your employer delays or says no?

Ask what information or next step is needed and keep a record of the request and responses. Explain the barrier a proposed arrangement leaves in place and, if you can, suggest another workable option. The EEOC’s pregnancy-related worker infographic recommends explaining the barriers, sharing ideas about what could help, and contacting the EEOC for help deciding what to do if the employer says no. Check state and local protections as well as federal law; some jurisdictions provide broader pregnancy-accommodation rights. The EEOC accepts charges under the PWFA, but filing deadlines and procedures depend on jurisdiction, claim type, and facts. The available federal guidance does not establish one deadline that applies to every worker, so get jurisdiction-specific advice promptly if you are considering a formal complaint.
