How to Protect Your Privacy When Using a Brain-Computer Interface

Protecting BCI privacy starts with tracing data from device to app to server—and verifying what the provider collects, shares, stores and lets you delete.

Before connecting a brain-computer interface (BCI), find out what it records or infers, where that information goes, who can access it, and whether you can limit or delete it. Privacy depends on the complete path from device to companion app to any server—not just on whether a device reads brain signals or also stimulates or modulates neural activity. There is no single privacy profile for every BCI.

What information can a BCI collect?

A BCI uses brain signals to help control a computer or another device. The U.S. Government Accountability Office (GAO) uses a broad definition that includes systems implanted in the brain or worn on the head. A product may handle more than neural signals: device telemetry, account details, performance or behavioral data, and inferences derived from those inputs may also matter to your privacy. Do not assume a particular device collects every category—or that it collects only raw signals. Check its own documentation.

Follow the information through each stage: what the device captures, what it sends to an app, what the app processes, and what may be uploaded to a provider’s servers. Ask whether the provider uses the data for product improvement, model training, advertising, research, or another purpose. Also distinguish raw signals from processed data and profiles inferred from them; a deletion option may not necessarily cover all three.

How do BCI types change the privacy questions?

BCIs differ in invasiveness, purpose, capabilities, users, and processing arrangements. A noninvasive EEG wearable that measures neural activity alongside eye, muscle, or heartbeat signals does not present the same considerations as an implanted health device that records and modulates brain activity. A device that can affect neural activity raises concerns beyond keeping information confidential, including the security of the system’s operation. The following distinctions are illustrative, not claims about every product in either category.

What might it be used for? Consumer and other nonmedical uses are developing; do not infer a specific purpose or capability from the wearable form alone. (GAO, December 17, 2024.) Medical versus nonmedical use matters too. A clinical-trial system, a workplace or defense application, and a consumer product may have different purposes and oversight. The label “BCI” alone does not tell you which privacy rules or controls apply.

What should you check before enrolling or connecting a BCI?

Read the device terms, privacy notice, and companion-app settings together. Terms may not make the practical answers clear: GAO reported that experts found a user’s access to data and the purposes for which it is used can be unclear in user agreements. Look for concrete answers to these questions before you enroll or connect the device:

  • Collection: Does the system collect raw or processed neural signals, associated sensor data, device telemetry, account details, performance or behavioral data, or derived inferences?
  • Purpose: Which data are needed to operate the service, and which may be used for product improvement, model training, advertising, or research?
  • Storage and access: Is processing on the device, in the companion app, on a server, or split across them? Where is information stored, and which staff members or service providers can access it?
  • Sharing: Which third parties receive data, and for what purpose? Can you decline optional sharing without losing core functionality?
  • Retention and deletion: How long is each category kept? Can you request deletion of raw signals, processed data, account information, and derived profiles? Ask what may remain in backups or research copies.
  • Export and continuity: Can you export your data? What happens to support and access if a trial ends or the provider stops operating?

Check whether controls for collection, analytics, sharing, and research participation are separate, and whether you can change them in both the app and device. Prefer a meaningful choice—such as local storage where available—over a broad privacy promise. Save the terms and settings presented at enrollment so you can compare them if the provider changes its practices. Do not assume any particular control exists until you verify it for your model and app.

Which privacy and security safeguards should you ask about?

The Future of Privacy Forum and IBM’s November 2021 report recommends privacy and security practices across on-device, companion-app, and server processing. These are recommendations to developers, not proof that a particular BCI uses them. Ask the vendor to explain:

  • Whether collection can be paused or disabled and, where appropriate, whether the hardware has an off switch.
  • Whether processing is local, cloud-based, or split between the two, and whether you can choose local storage.
  • Whether sensitive neurodata is encrypted in transit and at rest, who holds the encryption keys, and who has operational access.
  • Whether the provider minimizes collection and designs privacy into the system, rather than collecting first and relying only on later controls.
  • Whether privacy-enhancing techniques such as differential privacy are used where appropriate, and what protections they provide in that product’s context.
  • Whether de-identification is used where appropriate, and what other information could still be linked to a user.

Encryption, data minimization, privacy by design, de-identification approaches, and differential privacy are not interchangeable guarantees. Ask what is applied to your data, at which stage, and with what limits. For a system that modulates neural activity, also ask how the provider secures the device and its operation: a breach could raise concerns beyond exposure of stored information.

What do U.S. laws and medical-device guidance establish?

Privacy law and medical-device regulation address different questions. GAO’s report, published December 17, 2024, said experts had identified no mandatory, unified U.S. framework covering both medical and nonmedical BCIs. It described state laws that may extend to BCI-associated data, while noting ambiguity for some nonmedical developers and over whether data qualify as sensitive, identifiable, biometric, or biological. GAO cited California and Colorado as examples and identified the NIST Privacy Framework 1.0 as voluntary, cross-sector risk guidance.

That is a dated overview, not a current fifty-state legal survey or legal advice. Coverage depends on location, use, and facts; avoid assuming that all BCI data is either protected or unprotected. Check current rules that apply to your jurisdiction and situation.

The U.S. Food and Drug Administration (FDA) issued final guidance on May 20, 2021, on implanted BCI devices for patients with paralysis or amputation. It addresses nonclinical testing and clinical considerations. That medical-device guidance does not, by itself, establish privacy protections for a particular product or show that every nonmedical BCI follows the same pathway.

Is there a BCI-specific privacy standard?

ISO lists ISO/IEC WD 27505.2, “Privacy in brain computer interface (BCI) applications,” as a working draft under development. Its abstract says: “This document provides requirements and guidelines on privacy for brain computer interface applications.” The abstract describes privacy guidance based on ISO/IEC 29100 and ISO/IEC 27701. The ISO status information showed working-draft activity and committee progression in 2026; this is not a published international standard, and its status can change.

The American Psychological Association’s resolution describes this type of data as highly sensitive and says individuals should have a basic right to mental privacy. That is the APA’s policy position, not a statement of binding law or a guarantee that a legal right applies in a particular place.
