Protect interview privacy by deciding whether a recording is necessary, identifying the applicable legal basis and rules, explaining the process to participants, limiting collection and access, checking transcription-provider practices, verifying the transcript, and deleting or anonymising files when they are no longer needed and other obligations permit. UK and EU data-protection guidance supports this workflow, but recording laws, employment rules, research ethics, confidentiality duties and publication requirements vary by context and jurisdiction.
Why interview audio and transcripts need protection
A voice recording and its transcript can contain personal data that identifies a participant or reveals details about them. Interview material may also include sensitive or special-category information, so consider the consequences of unauthorised access, disclosure or retention before collecting it. The European Union Agency for Asylum (EUAA), in its guide to audio recording personal interviews, stresses that governance and information security matter for both audio files and written records: EUAA Practical Guide on the Audio Recording of Personal Interviews.

Data-protection principles are not a complete answer to whether a particular recording is permitted. Check the rules that apply where the interview takes place and to your role and purpose. Depending on the situation, separate recording, wiretapping, employment, research-ethics, confidentiality or publication rules may also apply.
Before recording: establish purpose, rules and notice
Decide whether you need a recording
Write down what the recording and transcript will be used for, who needs them, and why note-taking or another less intrusive method would not be sufficient. Collect only the material needed for that defined purpose. This is a practical privacy safeguard; which steps are legally required depends on the jurisdiction and interview context.

Identify responsibility and a lawful basis
Determine which organisation or person is responsible for processing the material and identify an applicable lawful basis before collection. Consent is one possible basis, not a universal requirement or automatic solution. UK and EU guidance recognises multiple lawful bases; the right choice depends on the circumstances. If the interview may contain special-category data, check whether an additional condition is required. The UK Information Commissioner’s Office (ICO) explains these issues in its guidance on employment records; that page concerns workers and UK data-protection contexts, not every kind of interview.
Give clear privacy information before collection
Explain the process in accessible, plain language before recording or collecting interview information. As relevant, tell participants:
- who is responsible for handling the material and how to contact them;
- why audio and a transcript are needed and the lawful basis being used;
- who may receive or access the material, including any service provider;
- how long it will be kept, or the criteria used to decide that period;
- what rights participants have and how to exercise them; and
- if consent is the basis, how to withdraw it and what withdrawal means for future processing.
The EU’s Your Europe GDPR guidance describes transparency obligations, while the ICO’s employment-records guidance gives a UK-specific example. Tailor the notice to the actual processing rather than relying on a generic statement.

If relying on consent, make it specific and keep evidence
Ask for consent separately from general terms, explain what will happen to the recording and transcript, and provide a practical withdrawal route. Keep a record of who consented, when, what notice or script they saw, how they gave consent, and any later withdrawal. The ICO quotes GDPR Article 7(1): “Where processing is based on consent, the controller shall be able to demonstrate that the data subject has consented to processing of his or her personal data.” See the ICO’s consent guidance.
Consider whether a DPIA is needed
Assess whether the project is likely to create high risk for people and whether a data protection impact assessment (DPIA) is required under the rules that apply. The EUAA guide says a DPIA should be undertaken for projects likely to involve high risk under the GDPR. The actual legal trigger depends on the applicable law and circumstances.
During recording and transcription: limit capture and exposure
Notify participants before recording starts
Tell participants before enabling recording or transcription, and give them a clear opportunity to ask questions. The UK Department for Work and Pensions (DWP) policy assigns organisers responsibility for informing attendees before those features are enabled. That policy is an operational example for DWP users and systems, not a universal rule for every interview.

Use only an appropriate, deliberately configured tool
Choose approved recording and transcription tools that are suitable for the interview’s sensitivity. Check recording defaults, sharing settings and permissions before the meeting or interview begins. Avoid capturing unrelated conversation or information that is not needed for the stated purpose.

Check provider access, reuse and deletion terms
Before uploading audio, find out where audio and transcripts are processed and stored, who can access them, whether humans review them, whether they are used to improve models or services, how long files and backups remain, and how deletion works. Check subcontractors and transfer arrangements where relevant, along with access controls and encryption. Confirm that the service is approved for the sensitivity of the material.
Do not assume that every transcription service handles recordings alike. Microsoft discloses that employees and vendors working on its behalf may review voice clips contributed for speech-recognition improvement; for that use case, it also describes de-identification and encrypted storage. This is specific to Microsoft’s stated voice-clip improvement practice and should not be generalised to all Microsoft products or other providers. Review the applicable Microsoft privacy statement and the terms and settings of the service you actually plan to use.

Check transcript accuracy before relying on it
Automated transcription can mishear or omit words. Review the transcript against the audio before using it for a decision, record or publication, and correct errors. DWP’s policy explicitly calls for transcript verification; the details of your own review process should reflect the consequences of an error.

Store files in an approved, access-controlled location
Keep the audio and transcript in an organisation-approved location with access limited to people authorised for the stated purpose. Avoid casual sharing or leaving copies in personal accounts or unmanaged devices. DWP policy calls for correct storage locations, retention labels and access permissions; follow the controls and policies that apply to your own organisation.

Set retention by purpose and applicable obligations
Define a retention schedule linked to the purpose for keeping the material and any legal, research or records-management obligations. UK data-protection law does not prescribe one general retention period for employment records. The ICO advises erasing or anonymising records when they are no longer needed, subject to other applicable requirements. A retention period must therefore be based on your circumstances, not borrowed as a universal number.

Plan deletion across all copies
Include working copies, exported transcripts, cloud copies, logs and backups in the retention and deletion plan. The guidance does not establish a universal interval for backup deletion, so check the storage provider’s capabilities and your organisation’s policy. If consent is the basis for processing, retain the evidence of consent and the version of the notice or script used, together with any withdrawal record, in accordance with applicable obligations.
Questions to ask before choosing a transcription or storage service
Use these questions to compare providers. They are due-diligence checks, not claims that a particular service meets a standard:
- Purpose and reuse: Are interview files used only to provide the requested service, or also to improve models or for other purposes?
- Human access: Can employees, contractors or subcontractors listen to audio or read transcripts? In what circumstances?
- Location and transfers: Where are the files processed and stored, and what transfer arrangements apply?
- Security: What access controls and encryption are available, and can you configure permissions appropriately?
- Retention and deletion: How long do source audio, transcripts, logs and backups persist, and what does deletion remove?
- Data handling: Can you correct or export records, and is the service approved for the sensitivity of your interview?
