How to Protect Borrower Data When Automating Mortgage Workflows

Protect borrower data across the full mortgage workflow with data inventories, least-privilege access, encryption, MFA, provider oversight, and secure retention and disposal.

Protect borrower data by treating the entire mortgage workflow—not just the loan-origination system—as a security boundary. Inventory the information and its movement, limit access, encrypt stored and transmitted data, assess every application and service provider, use multifactor authentication, and set defensible retention and incident-response procedures. Which legal duties apply depends on the lender’s role, regulator, contracts, and applicable federal and state law.

What borrower information should a mortgage lender protect?

Mortgage application information is sensitive financial information. The Federal Trade Commission’s GLBA Privacy Rule compliance guide identifies information a consumer provides to obtain a financial product—including a name, address, income, and Social Security number—as nonpublic personal information (NPI). NPI also includes transactional and service-related information.

Protect the documents and data that reveal or support a borrower’s financial relationship, not only fields labeled “confidential.” That can include application details, records exchanged during settlement, and information created or used while servicing a loan. The exact data set varies by workflow and institution.

Why does protection have to cover the whole mortgage workflow?

A mortgage moves through application, origination, settlement, and servicing. The Consumer Financial Protection Bureau’s Regulation X overview describes these stages; information can pass among borrowers, employees, brokers, settlement providers, servicers, software applications, and other service providers along the way.

Automation connects those people and systems, so a control limited to one platform can leave gaps at integrations, document transfers, vendor accounts, or downstream storage. Map the full path from collection through use, sharing, retention, and disposal.

Which rules and contracts may apply?

There is no single compliance checklist that applies identically to every mortgage business. GLBA privacy obligations and the FTC Safeguards Rule’s coverage depend on entity status and regulator; contractual duties may also apply. State privacy and breach-notification laws, other regulators’ requirements, lender-specific contracts, and system architecture need separate applicability review.

For entities covered by the FTC Safeguards Rule, the FTC calls for a written, risk-appropriate information security program with administrative, technical, and physical safeguards suited to the organization’s size, complexity, activities, and the sensitivity of the information. Its Safeguards Rule business guidance also says covered companies handling or maintaining another financial institution’s customer information have obligations regarding that information.

Fannie Mae seller/servicer requirements are a separate contractual consideration for relevant relationships. Its Selling Guide A3-4-01 addresses confidentiality, safeguards, secure destruction, and disclosure of borrower NPI. The Selling Guide A3-2-01 also addresses compliance with applicable law, including borrower privacy. Confirm which guide and contract terms govern the institution rather than assuming they apply universally.

How to build safeguards into automated workflows

1. Inventory information, systems, and movement

For every workflow step, record the information collected, the documents created or received, where each item is stored, which staff and service-provider accounts can access it, which systems exchange it, and when it can be deleted. The FTC identifies an information-ecosystem inventory as a Safeguards Rule program element.

  • Include applications, integrations, file transfers, vendor platforms, backups, and downstream repositories in the map.
  • Record the business purpose for each transfer and the organization responsible for each system or account.
  • Use the inventory to identify unnecessary copies, broad permissions, and unclear retention ownership.

2. Minimize and regularly review access

Give each employee and service-provider account only the permissions needed for its role. Review access regularly, remove it when the need ends, and make sure role changes and offboarding trigger prompt updates. FTC guidance calls for access controls and recurring review.

3. Encrypt data and assess the software path

Encrypt customer information both in storage and in transit. Assess applications that store, access, or transmit customer information, including third-party applications; an automated connection does not eliminate the need to review the security of the systems on either side.

4. Require multifactor authentication

Use MFA for access to borrower information and connected systems. FTC guidance recognizes knowledge, possession, and inherence as factor types and calls for at least two factors, subject to an exception for an equivalent control approved in writing. A hardware security key can serve as a possession factor, but no single device is a complete security program or a compliance shortcut.

When choosing an MFA implementation, assess its compatibility with the identity platform and account-recovery process, strength and usability for employees and vendors, centralized enrollment and revocation, auditability, and fit with the institution’s written risk assessment and policy.

5. Define retention and secure disposal

Set retention rules for each workflow and repository, including copies held by providers. FTC guidance says covered information should be securely disposed of no later than two years after its most recent use to serve the customer, subject to exceptions for legitimate business or legal retention needs and cases where targeted disposal is infeasible. Apply the full rule alongside other record-retention duties before deleting information.

6. Govern provider access and data sharing

Map the information service providers handle, the access they receive, and the security measures supporting that access. Review relevant contracts and applicable law rather than treating outsourcing or automation as a transfer of accountability.

For Fannie Mae seller/servicer relationships, its confidentiality guide generally requires borrower authorization before disclosing NPI unless applicable law permits the disclosure. Before automating a data share, verify the purpose, applicable rule, contract, and any required authorization.

7. Prepare for incidents and required notices

Document who assesses an incident, who makes escalation decisions, and how required notifications are handled. For a Fannie Mae business partner subject to the Information Security and Business Resiliency Supplement, verify the applicable partner category and effective date. Fannie Mae’s Supplement page describes a 36-hour reporting period to Fannie Mae after identification for covered cybersecurity incidents. That is a requirement for covered partners, not a universal statutory breach-notification deadline.

What should teams do first?

  1. Map the workflow: list the stages, information, documents, applications, recipients, and retention points.
  2. Check applicability: identify the institution’s regulator, legal obligations, relevant Fannie Mae or other contractual duties, and state requirements.
  3. Close access gaps: verify least-privilege permissions, regular reviews, account removal, and MFA across employee and provider access.
  4. Review system protections: confirm encryption in transit and at rest and assess applications and integrations handling customer information.
  5. Set lifecycle and incident rules: document retention and disposal decisions, provider responsibilities, escalation paths, and applicable notice deadlines.

The FTC’s Safeguards Rule announcement quoted Samuel Levine, Director of the FTC’s Bureau of Consumer Protection: “Financial institutions and other entities that collect sensitive consumer data have a responsibility to protect it.” The practical implication for automated lending is to make security controls follow borrower information wherever the workflow sends it.
