Download the authoritative public copy, keep it untouched, and create a separate searchable derivative. First test whether the downloaded PDF already supports text selection and search. If it is image-only, add an OCR text layer without replacing or degrading the scanned page images. Then verify every page against the untouched master, record provenance and a file hash, and store both files together. Use a validated PDF/A profile when long-term preservation matters more than ordinary working reference.
The preservation model: one master, one searchable derivative
A reliable court-document package has two related files:

- Untouched master: the exact file downloaded from the court or PACER, retained read-only and never re-OCRed, compressed, cropped or edited.
- Searchable derivative: a copy with an embedded text layer when needed. Its page images, layout, seals, stamps, exhibits and redactions must remain visually identical to the master.
Keep a short README beside both files. It should identify which file is authoritative and describe every transformation used to create the derivative. This separation lets you search and copy text efficiently without confusing an OCR result with the court’s original file.

Use the filing court or PACER
Start with the court that filed the document or with PACER for a federal case. The U.S. Courts describes PACER as the access point for federal case files, and many federal opinions are available free in text-searchable form. Download the document itself rather than relying on a browser preview, a third-party mirror or a screenshot.

Public access is not universal. PACER does not make sealed documents available to the public, and documents released to the public have certain identifiers redacted before release. If a docket entry is sealed or restricted, do not attempt to bypass that restriction; preserve only the copy you are lawfully able to obtain.
Record acquisition details immediately
At download time, write down the court, case name and number, docket or document number, source URL, download date and the filename supplied by the court. Save the downloaded bytes before opening them in software that might rewrite metadata. If the court later replaces a docket file, treat the replacement as a new acquisition and retain both hashes and dates.
2. Classify the PDF before changing it
Check for a real text layer
A PDF can look perfectly normal while containing only page images. Open the file and test several actions:
- Drag across a sentence and copy it into a plain-text editor.
- Use the viewer’s in-document search for a distinctive name, date or docket term.
- Try text selection on a page with a table, footnote or exhibit caption, not just the cover.
If copied text is coherent and search finds expected terms, preserve the existing text layer. Re-OCR can introduce recognition errors, alter character mapping or discard useful metadata without improving the record.
Recognize image-only and mixed files
An image-only file usually selects an entire page or nothing at all, and search returns no matches. A mixed file may contain searchable text for the filing but scanned exhibits or handwritten pages as images. Process only the pages that need a text layer; do not flatten or replace pages that already contain reliable text.

3. Create OCR without changing the source appearance
Use an image-preserving OCR mode
Choose an OCR workflow that places recognized text behind or over the existing page image. The resulting page should render exactly like the source while allowing selection and search. The National Archives and Records Administration states that “PDF records that contain embedded searchable text based on Optical Character Recognition (OCR) must be identical in content and appearance to the source document.” Its transfer guidance rejects processes that substitute OCR text for the original image or use lossy compression.
Do not deskew aggressively, crop margins, remove blank pages, optimize images with lossy compression or “clean up” stamps and handwriting during preservation OCR. Those may be useful for a working copy, but they are transformations and must never overwrite the master.

Preserve uncertain recognition
OCR is an index, not a new authoritative transcription. Scanned type, faint carbon copies, unusual fonts, two-column layouts, seals, marginal notes and handwritten marks can produce mistakes. Keep the original image visible so a reader can inspect the source whenever a copied word, number or punctuation mark matters.
Keep OCR settings with the derivative
Record the OCR software name and version, language settings, page range, preprocessing choices and output date. If you rerun OCR with a different engine or language, create a new derivative and document the difference instead of silently replacing the prior one.
4. Validate every page against the master
Completeness and visual checks
Compare the derivative with the untouched master page by page. Confirm that:

- the page count is identical unless a documented process created an additional cover or index;
- page order and orientation are correct;
- seals, exhibits, signatures, stamps, handwritten marks and redactions remain visible;
- tables, footnotes, marginalia and clipped edges are present and legible;
- no page is blank because an OCR or rendering step failed; and
- the first, middle and final pages match the master in appearance.
UK National Archives guidance emphasizes that the full content and context of the original record must be captured, that all text must be included and legible, and that the chain of custody must be clear. Those principles are especially important when another person may rely on the copy as evidence.

Test search quality deliberately
Search for a distinctive party name, a date in several formats, a docket number, a section heading and a term printed inside an exhibit. Inspect each hit in the image, because OCR may confuse characters such as “1” and “l,” “0” and “O,” or punctuation in case numbers. Search results should help you find the source page; they should not be treated as proof that the OCR is correct.
5. Choose an appropriate preservation format

PDF/A is preservation-oriented, not automatically better for every working copy. NARA identifies PDF/A-4f and PDF/A-3 as preferred formats for PDF collections and requires fonts to be embedded in those collections. Preserve the ordinary court download even if you also create a PDF/A derivative; a conversion can change metadata, attachments or rendering behavior.
6. Remove access barriers without altering content
Check whether passwords or permission flags prevent opening, viewing or printing. NARA requires such restrictions to be deactivated for PDFs intended for permanent transfer. For a reference copy, remove a restriction only when you are authorized to do so and can document the operation. Do not defeat encryption on a document you are not entitled to access, and do not treat removal of a permission flag as permission to edit the record.
7. Build a provenance package
Use a stable folder or records-management entry containing:

- the source URL, court, case number and docket/document number;
- download date and, if relevant, the time zone;
- a cryptographic hash of each file;
- OCR software and version, language and settings;
- any PDF/A conversion or validation result;
- a list of transformations, including security-setting changes; and
- a README explaining which file is authoritative and how the derivative was checked.
A SHA-256 hash lets you detect accidental replacement later. On systems that provide the command, you can record one with:

sha256sum court-document-searchable.pdfStore the output in the README or a separate manifest. A hash authenticates the bytes you stored; it does not establish that the court’s copy was itself authentic, which is why the source and docket identifiers must also be recorded.
8. A repeatable end-to-end procedure
- Locate the filing. Open the court or PACER record and confirm the case and docket/document number.
- Download once. Save the public file locally and make it read-only. Record its source and date.
- Hash the master. Calculate and record a SHA-256 hash before processing.
- Test text. Select, copy and search on representative pages.
- Decide whether OCR is needed. Leave a usable text layer alone; identify image-only pages in a mixed file.
- Create the derivative. Use image-preserving OCR and retain the original page images.
- Validate visually. Check page count, order, orientation, exhibits, seals, redactions, tables and legibility against the master.
- Validate search. Search names, dates and docket terms, then inspect the underlying image for each important hit.
- Choose a preservation profile. Keep a normal searchable PDF for routine use and add validated PDF/A when collection policy calls for it.
- Document and store. Hash the derivative, record software and transformations, and keep the master, derivative and README together.
Common failure modes and fixes

Performance, storage and access considerations
OCR and PDF/A conversion can be CPU- and storage-intensive for long filings, so process in a controlled workspace and retain enough space for the original and derivative. A searchable text layer normally adds less data than a second set of page images, but image resolution and compression choices still affect size and legibility. Prefer lossless or preservation-appropriate settings when the document may be relied on as evidence.
Public access also depends on jurisdiction and case status. A federal opinion may be freely searchable while another docket document requires PACER access, and a sealed filing is not publicly available through PACER. Your provenance note should state what you actually obtained, not imply that the entire case file is public.

Questions that arise in practice
Should the OCR PDF be the only file I distribute?
For ordinary internal searching, the derivative may be convenient. When authenticity, evidence or a records transfer matters, provide the untouched master as well and explain the relationship in the README. The recipient can search the derivative and verify disputed passages against the master image.

Preserve the redaction exactly as delivered. Do not attempt to infer hidden text from OCR artifacts, remove the marking or recreate the underlying content. Searchable text must never expose information that the public court copy intentionally withholds.
Is PDF/A mandatory for every court download?
No. A normal searchable PDF is suitable for routine reference when it preserves the source image and text layer. PDF/A is a preservation-oriented option for collections or formal transfer, and the original court file should still be retained.
How can I show that my working copy came from a public docket?
Keep the source URL, court, case and docket/document numbers, download date, original hash and a read-only copy. Those details establish your acquisition trail and make later comparison possible even if the public page changes.
Frequently Asked Questions
Can OCR make a scanned filing accessible to screen readers?
It can provide selectable text that assistive technology may interpret, but recognition quality and reading order still need testing. Tables, columns, handwritten notes and seals may require manual accessibility remediation in a separate working copy.
What if the court publishes a replacement file with the same docket number?
Download the replacement as a new version, record its acquisition date and hash, and retain the earlier master. Do not silently overwrite the first public copy.
Can I rely on OCR text when quoting a legal document?
Use the OCR layer to locate the passage, then verify the exact wording, punctuation and numbers against the rendered source image in the untouched master.
