If an H-1B petition is delayed, track the case, preserve every filing and notice, and check USCIS’s current processing-time estimate for the correct Form I-129 category and office. If USCIS denies it, read the written decision promptly and have the petitioner consult qualified immigration counsel about the options and deadlines stated in that specific case. A processing estimate is not a promise, and no general guide can determine an individual’s work authorization, lawful status, or departure obligations.
First, distinguish the H-1B petition from a visa
People often say “H-1B visa” when they mean the petition filed with U.S. Citizenship and Immigration Services (USCIS). The petition and a visa document are distinct steps. This guide addresses a delayed or denied USCIS petition; it does not cover a separate decision about visa issuance.

What a processing-time estimate can—and cannot—tell you
USCIS describes processing times as a reference point, not an individual-case promise. Its estimates use recently completed cases and can vary with workload, staffing, responses to USCIS requests, incomplete submissions, and operational or policy changes. See USCIS’s explanation of case processing times and its processing-time FAQs.

For historical context only, USCIS reported the following FY2026 national medians through June 30, 2026. These are not forecasts or service promises for an individual H-1B petition.
#1 Best Overall
| Form I-129 processing type | FY2026 historical median through June 30, 2026 | Source and qualification |
|---|---|---|
| Non-premium nonimmigrant petition | 5.3 months | USCIS historical processing-time table; national median, not an individual estimate |
| Premium nonimmigrant petition | 0.5 months | USCIS historical processing-time table; national median, not an individual estimate |
Those figures describe past processing, not the current estimate for a particular classification, service center, or filing. For a decision about timing, check the current USCIS processing-time tool using the petition’s actual category and office. Premium-processing eligibility, fee, and terms are not established by these historical figures; verify current USCIS instructions before relying on them.
If the petition is delayed, take these steps
-
Assemble the case record
Keep the I-797 receipt notice and receipt number, a copy of the petition, delivery tracking, USCIS account updates, and every request or notice together. The USCIS Case Status Online service uses the receipt number to track a case.
-
Check the case and the right processing category
Use Case Status Online and the current processing-time tool for the relevant Form I-129 category and office. USCIS’s service-center information can help identify the office context. Treat the processing-time result as an estimate, not a deadline for your individual petition.

Look for a USCIS request or recent update
Review case status and correspondence for a request for evidence or other request, then check whether the response was delivered and recorded. USCIS identifies response time, workload, staffing, and incomplete submissions among factors that can affect processing duration.
-
Follow up if a mailed notice did not arrive
If eligible, submit a notice non-delivery inquiry through USCIS e-Request. USCIS lists requests for evidence, additional-information notices, and original-document notices among the notices that may be involved. Save the inquiry confirmation and continue monitoring the case and correspondence.
-
Keep the petitioner’s contact information current
Make sure the petitioner’s address and contact details are up to date so USCIS correspondence can reach the right place. USCIS warns that address updates help ensure timely receipt of correspondence and may help avoid delay or denial.
-
Sign up for available case updates
Register for available email or text notifications and retain the account updates alongside the paper record. Notifications are useful for monitoring, but keep the receipt notice and correspondence as the underlying case documents.

If USCIS denies the petition
-
Read the entire written decision immediately
Record the decision date, each stated reason, any service instructions, and any deadline or response route named in the notice. Do not rely on a general deadline found elsewhere: procedures and time limits depend on the notice and the case’s posture.
Best Value
-
Compare the decision with the filing history
Review the complete petition record against the decision, including any earlier request for evidence and the response. Preserve the decision and all related notices with the original filing and delivery records.
-
Have the petitioner seek case-specific legal review promptly
The employer or other petitioner should ask qualified immigration counsel to assess whether an appeal, motion, refiling, or another course is available. Do not assume a deadline can be extended or that the same procedure applies to every denial. A 2024 USCIS Administrative Appeals Office non-precedent H-1B decision describes dismissal of untimely motions where the petitioner did not establish the required basis for excusing delay; it is an individual decision, not a universal rule. Read the August 9, 2024 decision.
Do not infer personal work or immigration status from the petition status
A pending or denied petition alone is not enough to determine a beneficiary’s lawful status, work authorization, or obligation to leave the United States. Those questions depend on the person’s circumstances and case documents. Do not make plans about continued work, travel, or departure based only on a processing estimate or a general article; get advice from qualified immigration counsel familiar with the individual case.
