If you think your job may be eliminated, prepare in this order: secure copies of records you are allowed to keep, write down the dates that control your benefits, compare health-coverage options before making an election, preserve retirement-plan information, check unemployment rules with your state, and treat the job search as a benefits decision as well as a salary decision. At separation, keep every written notice and act from the deadlines in those notices. This guide is U.S.-focused; state law, employer policies, plan documents, contracts and your personal circumstances determine the precise result.
Start with the decisions that have deadlines
A layoff creates several separate clocks. The most urgent are usually health coverage, unemployment filing and any special-enrollment opportunity through a spouse or other employer. Make a one-page date log as soon as you receive a warning or separation notice.

| What to record | Why it matters |
|---|---|
| Last day worked | May determine when payroll, severance or other employer processes begin. |
| Last day active health coverage | Starts the practical comparison of replacement coverage and may be one of the dates used for a COBRA deadline. |
| Date each notice was received | Keep the envelope, email or portal timestamp with the notice; election periods can be measured from notice and coverage events. |
| Response deadlines printed in notices | Use the plan’s stated deadline rather than relying on a calendar estimate. |
| First day of any new coverage | Lets you identify a gap and decide whether temporary coverage is needed. |
Save the separation letter, benefits notices, pay statements and plan correspondence in a personal location you can access after your work account is disabled. Keep only records you are entitled to retain. Do not copy confidential customer information, trade secrets, internal company files or other employer data.
What to do before a layoff, if you have time
Collect benefits and employment records lawfully
Request or download documents that explain benefits while you still have access. Useful records include the health-plan summary, enrollment confirmation, retirement-plan Summary Plan Description, recent individual benefit statement, beneficiary designations, stock or incentive-plan statements if applicable, and any current benefits booklet. The U.S. Department of Labor’s guidance on protecting benefits after job loss explains why these records matter: keep retirement and health-benefit information after a job loss.

Use a personal email address and storage location for your own records, but follow workplace rules when exporting files. A document showing your compensation or account balance is different from a file containing company or customer information.
Find the health plan’s rules and administrator
Locate the plan’s Summary Plan Description and identify who sends continuation-coverage notices. Write down the plan administrator’s mailing address, phone number and secure website. Confirm the date employment-based coverage ends; some plans end coverage on the last day worked, while others use the end of the month or another plan-defined date. Do not assume your employer’s payroll date is the coverage date.
Make a list of household members on the plan, their doctors, recurring prescriptions and any treatment that cannot be interrupted. That list will make a network and prescription comparison concrete instead of relying only on the monthly premium.

Possible routes include COBRA continuation, special enrollment in a spouse’s or other eligible employment-based plan, Marketplace coverage and public programs for which a household qualifies. The Department of Labor recommends comparing choices before deciding; its job-loss benefits information describes the main options.
Prepare a comparison sheet with these columns:
- Who is eligible and which family members can enroll.
- Monthly premium, including any employer contribution that would disappear.
- Deductible, coinsurance, copayments and the annual out-of-pocket maximum.
- Covered services, prescription formularies and ongoing-treatment rules.
- Whether your current doctors, hospitals and pharmacies are in network.
- Coverage effective date and any gap between plans.
- Election or enrollment deadline and the person or agency that receives it.
Ask a spouse’s plan administrator whether loss of your coverage creates a special-enrollment event and what proof is required. The plan, not a general internet checklist, supplies the controlling deadline and effective date.

Prepare for an unemployment claim
Find your state’s unemployment-insurance agency and read its current filing instructions before separation. Federal guidance says workers unemployed through no fault of their own may qualify if they meet state requirements; it does not decide an individual’s claim. The Department of Labor’s Termination guidance explains that state law and additional eligibility conditions control.
Gather the information an agency commonly asks for, such as employer name and address, dates worked, wages, separation date and the reason supplied by the employer. Use the agency’s own portal or phone instructions, and keep confirmation numbers. If you receive severance, pay in lieu of notice or vacation payout, ask the state agency how it affects timing or eligibility rather than guessing.
Review retirement choices before moving money
Download the Summary Plan Description and your latest account statement. Request an individual benefit statement if you cannot access one, confirm your mailing address and beneficiaries, and note the plan administrator’s contact details. The Department of Labor’s Changing Jobs and Job Loss guidance outlines why these documents should be retained.
Do not rush into a rollover or distribution because of a termination email. Plans differ on whether former employees may leave money in the plan, transfer it directly to another plan or individual retirement account, or take a distribution. Tax withholding, possible penalties, investment options, fees and creditor protections can differ. Ask the plan for its distribution and rollover rules and obtain tax advice for an individualized decision.
Understand COBRA before you elect it
The deadline and coverage period
Under the Department of Labor’s general COBRA explanation, an eligible worker has 60 days to elect continuation coverage, measured from the later of the date coverage ends or the date the election notice is provided. Read the notice immediately and calculate the deadline from the dates it states. Keep proof of when you received it. The usual continuation period is up to 18 months, although certain qualifying events can extend coverage.

COBRA generally lets you keep the same group health plan rather than switching networks immediately. That continuity can be valuable during active treatment, but you normally pay the entire group premium yourself, potentially plus a 2% administrative fee. The amount can therefore be much higher than the employee deduction on your old paycheck. The Department of Labor’s COBRA FAQ for workers describes the federal rules and common payment questions.

Retroactivity and the first payment
COBRA coverage can be retroactive to the date employer coverage ended if you elect and pay as required. That may prevent a gap, but it also means you could owe premiums for the entire retroactive period. Verify the initial-payment amount, due date, grace period and accepted payment methods in the election packet. If a notice is missing, late or inconsistent, contact the plan administrator promptly and keep a written record of the question and response.
Compare COBRA with alternatives
| Comparison point | Questions to answer |
|---|---|
| Cost | What is the full monthly premium, including any permitted administrative fee, and what would the alternative cost after subsidies or employer contributions? |
| Continuity | Will current doctors, hospitals, prescriptions and treatment authorizations remain available? |
| Timing | When can each option start, and is there a gap before the replacement plan becomes effective? |
| Eligibility | Can every household member enroll, or does a spouse, child or other dependent have a separate route? |
| Risk exposure | How do deductibles, coinsurance and the out-of-pocket maximum compare for the care your household expects? |
| Action required | Which form, portal or administrator receives the election, and what is the exact deadline? |
A spouse’s employment-based plan may offer special enrollment after loss of your coverage. DOL benefits guidance generally describes a 30-day request period after losing eligibility for the original plan, but you must confirm the rule, documentation and effective date with that plan. Marketplace and public-program eligibility depends on household facts and current program rules, so verify directly with the relevant Marketplace or agency.
What to do on the separation date
- Secure the written packet. Keep the separation letter, benefits termination notice, COBRA materials, retirement information and final-pay documentation. Save copies outside your former employer’s systems.
- Write the date log. Record your final work date, coverage end date, notice-receipt dates, COBRA deadline shown on the notice, special-enrollment deadline supplied by another plan and any unemployment filing instructions.
- Check access and contact details. Confirm a personal mailing address, phone number and email with the health and retirement plan administrators. A missed notice can create avoidable problems.
- Ask focused questions in writing. Request clarification of coverage end, premium amount, first-payment instructions, retirement distribution choices and any missing document. Keep the reply.
- File or prepare the unemployment claim. Follow your state’s instructions and retain the submission confirmation. Report facts accurately, including any severance or other payments the form asks about.
Protect your retirement account after job loss
Documents to retain
- Summary Plan Description and amendments.
- Latest individual benefit statement and contribution history.
- Beneficiary designation confirmation.
- Distribution, rollover and loan information supplied by the plan.
- Plan administrator’s current address, phone number and secure contact method.
Update your address before the employer’s systems close. If the plan sends a distribution or rollover notice, read the tax and timing disclosures. A direct trustee-to-trustee rollover is different from receiving the money personally; the plan’s instructions and your tax adviser can explain which method fits your circumstances. Avoid authorizing a transaction until you understand withholding, deadlines, fees and investment consequences.
Apply for unemployment without assuming the outcome
Eligibility is determined by the state where you worked, under that state’s rules. A layoff often differs from a voluntary quit or discharge for misconduct, but the agency evaluates the facts and any additional requirements. Federal DOL wording is deliberately conditional: workers unemployed through no fault of their own, as determined under state law, and who meet other requirements may be eligible.

Submit the claim as soon as your state’s instructions allow. Use the separation reason stated in the employer’s notice, answer follow-up questions by the deadline and continue any required weekly or biweekly certifications. Keep a log of filing dates, requests for information, interviews and confirmations. If the agency denies a claim, follow the appeal instructions and deadline printed in its determination; do not treat this general guide as a substitute for the agency’s process.

A higher salary can be outweighed by a large premium, a narrow network or a long wait for coverage. During interviews and offer discussions, ask for the plan summary and compare the same categories you used for COBRA.
| Benefit question | What to verify |
|---|---|
| Premium | Employee contribution per pay period and whether dependent coverage costs more. |
| Coverage | Medical, prescription, mental-health and other services important to your household. |
| Provider access | Whether your doctors, hospitals and pharmacies participate in the network. |
| Waiting period | The date you become eligible and the date coverage actually starts. DOL says a new plan’s waiting period generally cannot exceed 90 days after the employee becomes eligible; confirm how the employer applies that rule. |
| Out-of-pocket exposure | Deductible, coinsurance, copayments and annual maximum, not just the premium. |
Ask for the Summary of Benefits and Coverage or equivalent plan material before accepting when possible. Confirm whether a gap exists between your old plan and the new one and whether a temporary option is needed. Keep a simple application log with employer, role, date applied, contact, interview stage and follow-up date; it is an organizational aid, not a legal requirement.
A practical layoff timeline
| When | Action |
|---|---|
| As soon as risk appears | Collect lawful personal records, locate plan documents, identify administrators, review retirement choices and list household medical needs. |
| Before the final day | Confirm the health-coverage end rule, compare likely replacement options, check spouse-plan special enrollment and find your state’s unemployment instructions. |
| On separation | Save every written notice, record all dates, verify contact information and ask for missing benefit or retirement documents. |
| When the COBRA packet arrives | Read the election and payment terms immediately, compare options using premium, cost sharing, network and effective-date criteria, and submit the chosen election through the specified channel. |
| During the first weeks | File or complete the state unemployment claim, monitor mail and email, respond to agency requests, and preserve retirement records. |
| While interviewing | Request benefit summaries, compare coverage and waiting periods with salary, and verify the exact start date before relying on a new plan. |
Common mistakes and how to avoid them
Waiting for a cheaper option without checking the deadline
COBRA and special enrollment are deadline-driven. You can compare options before electing, but do not let an assumption about Marketplace availability or a spouse’s plan cause a missed election. Use the written notice and administrator confirmation.
Comparing only monthly premiums
A low premium may come with a high deductible, limited network or expensive prescriptions. Include expected care, provider access and the annual out-of-pocket maximum in the comparison.
Best Value
Assuming the employer’s final paycheck date is the coverage date
Coverage termination is controlled by the plan’s terms. Obtain the date in writing and keep the notice.
Taking a retirement distribution before reading the plan rules
Distribution and rollover choices can affect taxes, withholding, fees, investment selection and creditor protections. Obtain the Summary Plan Description and distribution materials first.
Assuming federal unemployment language guarantees payment
The state agency decides eligibility, filing timing and benefit amount. File according to its instructions and appeal through its process if necessary.
Taking confidential work files while saving personal records
Retain your own pay and benefit documents, not employer or customer data. When in doubt, ask human resources which records you may keep or request copies through an approved process.
Personal records checklist
- Separation letter and any written explanation of the layoff.
- Final pay statement and records of accrued leave or other payments, subject to state law and employer policy.
- Health-plan enrollment confirmation, Summary Plan Description and coverage-end notice.
- COBRA election notice, premium schedule, payment instructions and proof of submission.
- Spouse-plan or Marketplace correspondence and effective-date confirmation.
- Retirement Summary Plan Description, account statement, beneficiary record and administrator contact.
- Unemployment application, confirmation number, agency messages and certification records.

Severance, final-pay, unused-leave, notice and contract rights vary by state, locality, contract and employer facts. The documents and agencies governing your situation are the authority for those questions. When a deadline, tax issue or disputed payment could materially affect you, consider advice from a qualified benefits, tax or employment professional.
