How to Prepare an Immigration Document File Before a U.S. Tech Layoff

Build a private, dated immigration file before a tech layoff: preserve status and employment records, verify the effective end date, distinguish employment-based and OPT rules, and get category-specific advice before deadlines expire.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Start before your access disappears: identify your immigration category, write down the legally relevant last day of employment, and save complete copies of your status, work-authorization, and employment records in a private location. A layoff does not trigger one universal immigration checklist. Employment-based nonimmigrants and F-1 students on OPT follow different reporting rules, deadlines, and work-authorization limits, so use your category and dates—not the fact that you work in technology—as the organizing principle.

1. Make a private status-and-deadline sheet first

Create a one-page record while you can still access your employer systems. Put the source for every date next to it (for example, an I-94 record, an I-797 notice, an EAD, or an I-20), and keep the sheet separate from any shared company folder.

Item to record What to write down Why it matters
Immigration category Exact current category and any employment authorization category Rules differ for employment-based nonimmigrants, F-1 students on OPT, dependents, and people with pending applications.
Employer Legal employer name, petitioning entity, and worksite listed in your records A petition, a job offer, and the company that issued your paycheck may not be described identically.
Effective last day The date employment actually ends, as stated in the written notice or separation agreement The cessation date can start a deadline. Do not substitute the date severance is paid.
Authorized validity I-94 “admit until” date and the end date on relevant approval notices or other status records For certain covered employment-based categories, the available period is limited by whichever comes first: the applicable grace-period maximum or the authorized validity end date.
Work authorization EAD category and expiration date, if you have an EAD An EAD has its own validity period; a grace period or a pending filing does not automatically authorize employment.
Pending matters Receipt numbers, filing dates, biometrics notices, requests for evidence, interview notices, and attorney contact information A layoff can affect a case that is already pending, but the effect depends on the filing and your facts.
Family records Dependent names, categories, I-94 dates, approval notices, and EAD dates where applicable Your options and travel plans may affect dependents differently from the principal worker.

Check the dates against the original notices rather than an HR portal or a calendar reminder. If a notice, I-94, or termination letter appears inconsistent, preserve both versions and ask qualified immigration counsel (or your designated school official if you are on F-1 OPT) which date controls.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

2. Build a complete, readable digital file

Save color scans or clear photographs of every page, including pages that appear blank but contain a page number, stamp, or continuation. Use descriptive filenames with the document date, and keep the original paper documents. USCIS form instructions commonly identify the following as evidence examples; they are not a universal layoff checklist, and an officer may request different evidence for a particular filing.

  • Compact & Travel-Friendly: The ultra-compact design allows the adapter to stay plugged into your device without blocking adjacent ports or adding bulk, reducing wear and tear on your original USB ports.
  • 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.

Identity, admission, and status records

  • Passport biographical page and all pages containing U.S. visas, admission stamps, or immigration annotations.
  • Most recent Form I-94 record, including the admission number and “admit until” date.
  • Every available Form I-797 approval notice and receipt notice connected to your status, petition, extension, or change of status.
  • Copies of the petition and supporting documents that you are entitled to receive or already possess, such as the job description, certified labor condition material where provided, and filing correspondence.
  • For F-1 students, the current Form I-20, including the page showing the OPT recommendation or endorsement and any updated I-20s.
  • Employment authorization documents (EADs), front and back, plus approval notices and renewal receipts.

Employment and layoff records

  • Offer letter, employment agreement, verification letters, and records showing your job title, duties, worksite, and start date.
  • Written layoff or termination notice, including the stated effective date and the person or department that issued it.
  • Severance agreement, release, benefits continuation notice, and final-pay documentation.
  • Recent pay statements showing the employer, pay period, and dates worked.
  • W-2 forms and relevant tax records. USCIS lists pay stubs, W-2s, tax records, and employer letters among examples of evidence used in immigration filings.
  • Correspondence that confirms the last day employed, any garden-leave arrangement, or a change from active work to paid non-work status.

Case-management records

  • Attorney engagement letter, legal invoices that identify the matter, and the attorney’s secure contact details.
  • USCIS or other agency notices, online-account screenshots that show case status, and copies of anything submitted on your behalf.
  • A list of dependents’ documents and any travel or filing dates already scheduled.

Do not edit a document to make it easier to read, remove pages, or combine unrelated notices into a file that obscures their order. Keep an untouched original and, if useful, a separate working copy with notes.

3. Store the file securely before your access ends

Use a personal, access-controlled account rather than an employer-managed drive. Turn on multifactor authentication, use a unique password, and maintain a second encrypted backup in a different location. Avoid placing passport, I-94, or EAD scans in an unsecured shared folder or sending them to a broad company mailing list.

  • Download records from HR, payroll, benefits, and immigration portals while your credentials work.
  • Verify that each PDF opens and that every page is legible before deleting a local copy.
  • Keep a paper set in a private location if you prefer; an accordion organizer is optional and is not required by USCIS.
  • Record the date you downloaded each item and the URL or portal name where you obtained it, without retaining passwords in the same file.
  • Give an attorney or trusted family member access only through a secure transfer method and only to the documents they need.

4. Pin down what “laid off” means for immigration purposes

Ask for a written statement of the effective employment end date. Save the notice, separation agreement, final pay statement, and any message that changes or clarifies the date. A later severance payment is not, by itself, proof that immigration employment continued. If the notice says you remain on payroll, are on garden leave, or are relieved of duties before a later termination date, do not choose the date yourself; have counsel analyze the arrangement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep records of the last day you actually performed services, the last day you were paid for work, and the date your employer says the employment relationship ends. Those dates can differ, and the distinction may matter to a filing or grace-period calculation.

5. Understand which deadline applies to your category

Employment-based nonimmigrant workers

For specified covered employment-based categories, the regulation quoted in USCIS nonimmigrant employment materials provides up to 60 consecutive days after cessation of employment, or until the authorized validity period ends if that happens sooner. It is not a universal 60-day entitlement for everyone who holds an immigration document. Your category, the approved validity dates, prior status history, and the exact cessation date all matter.

The period is a time to pursue an eligible filing or other lawful plan; it is not a blanket permission to work for a new company. Do not begin work for a prospective employer merely because the 60 days have not elapsed, because an application is pending, or because you are receiving severance.

USCIS Director Ur M. Jaddou explained the purpose of the period in a January 25, 2023 letter to Representative Anna G. Eshoo: “The 60-day grace period not only gives nonimmigrant workers time to find new employment, but also permits them the option to change their status to another nonimmigrant status, among other options, in the event their employment search takes longer than 60 days.” The statement describes possible options, not an approval or eligibility guarantee for an individual case.

F-1 students on post-completion OPT

ICE/SEVP practical-training guidance says an F-1 student must report specified changes, including loss of employment, to the designated school official within 10 days. Contact the DSO promptly, ask what information the school needs, and keep proof of the report.

The F-1 60-day period after program completion or post-completion OPT serves a separate departure or new-program purpose. Do not combine it with the employment-based cessation-of-employment period: they arise in different contexts and have different reporting and work-authorization implications. Follow the OPT unemployment and reporting rules that apply to your record, including any instructions from your DSO.

Dependents and other categories

A dependent’s status may have a different expiration date and may not change automatically when the principal worker is laid off. Record each dependent’s I-94, approval notice, EAD, and passport information separately. People in categories not covered by the employment-based grace-period regulation should not assume that the 60-day rule applies; obtain category-specific advice.

6. Ask counsel to map realistic options

Contact qualified immigration counsel as soon as the employment end date is known. USCIS describes several routes that may be available to some recently unemployed nonimmigrant workers, but eligibility, filing effects, and work authorization differ. Use this table as a question list, not as a prediction.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Possible route Questions to ask Work-authorization point Family or travel issues
New-employer petition Can a new employer file for this category, and what filing date and evidence are required? Ask exactly when work may begin and whether the filing or approval changes that answer. Confirm how dependents’ status and any planned travel are handled.
Change of status Is another nonimmigrant status available based on your facts, and must the filing be made before a specific date? A change-of-status filing does not automatically authorize employment in the new role. Ask what happens if you travel while it is pending and how dependents would be included.
Adjustment of status Are you eligible to file or maintain a pending adjustment case, and how does the layoff affect the underlying employment basis? Determine whether an EAD is needed and when it would be valid; do not assume a pending adjustment permits work. Travel and dependent filings can have separate consequences.
Compelling-circumstances EAD Do the facts meet the regulatory standard, and is this the correct filing for the situation? Ask when the EAD could be used and what employment limitations apply. Confirm effects on status, dependents, and international travel before filing.

Bring the status-and-deadline sheet, the complete document set, and a concise employment timeline to the consultation. Ask the lawyer to identify the controlling deadline, the filing that must occur first, whether you may work during each stage, and what happens if the case is denied or you travel.

7. Use a layoff timeline instead of relying on memory

  1. Before the announcement: Download notices, I-94 records, passport and visa pages, I-797s, EADs, I-20s, petition copies, pay records, and tax documents from personal or authorized sources.
  2. On the day you receive notice: Save the written notice and separation documents. Write down the stated effective date, your last day performing services, and who can confirm the date.
  3. Within 24–48 hours: Check the I-94 and approval validity dates, update the status-and-deadline sheet, and contact counsel. If you are on OPT, notify your DSO and ask for the required reporting method.
  4. Within 10 days if you are on F-1 OPT: Report the loss of employment to the DSO under ICE/SEVP guidance and retain confirmation.
  5. Before any applicable employment-based period or authorized validity ends: Decide with counsel whether to pursue a new-employer petition, change of status, adjustment-related filing, compelling-circumstances EAD, departure, or another category-specific solution.
  6. After each filing or report: Save the complete submission, delivery proof, receipt, and any instructions. Update the sheet when a date changes.

8. Common mistakes and how to correct them

Assuming every worker gets the same 60 days

Why it fails: The regulation covers specified categories and the period can end sooner when authorized validity ends.

Correction: Identify the category and compare the cessation date with the I-94 and approval dates with counsel.

Treating the grace period as work authorization

Why it fails: Time to file or change status is not the same as permission to perform services for a new employer.

Using the severance-payment date as the employment end date

Why it fails: Payroll continuation and immigration employment are not necessarily the same thing.

Correction: Preserve the employer’s effective-date statement and ask counsel to analyze garden leave, paid notice, and severance separately.

Missing the OPT reporting obligation

Why it fails: ICE/SEVP guidance gives F-1 OPT students 10 days to report specified changes, including loss of employment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correction: Contact the DSO immediately, follow the school’s reporting process, and save confirmation.

9. Questions to put in your attorney or DSO meeting

  • What is my controlling immigration category today?
  • What exact event starts my deadline, and what date should I use?
  • Does the specified employment-based grace period apply to me, and when does it end if my authorized validity ends sooner?
  • May I perform any work during the period before a new filing is approved?
  • Which documents establish my status, employment, pay, and last day worked?
  • Would a new-employer petition, change of status, adjustment-related filing, compelling-circumstances EAD, or departure be legally available?
  • How would each option affect dependents, international travel, and pending applications?
  • What should I report to my DSO, employer, or another agency, and by what date?
  • What happens if a filing is rejected, denied, withdrawn, or delayed?
