How to Make a Household Emergency Plan for Possible Immigration Detention

A step-by-step household emergency plan for possible immigration detention, including caregivers, records, contacts, finances, state-specific legal limits, and privacy safeguards.

A household emergency plan gives your children and other dependents a safe, lawful handoff if a parent or caregiver is detained or otherwise cannot come home. Start by choosing a willing backup caregiver, documenting daily and medical needs, organizing records, listing trusted contacts, and arranging access to money. Then have a local legal-aid organization or attorney review the child-care and financial documents for your state. No single power of attorney or caregiver form works nationwide, and a form does not guarantee that family separation will be avoided.

What the plan needs to accomplish

The plan should let a trusted adult take over ordinary care quickly, help household members reach the right people, and keep essential records and money available without exposing sensitive information. Treat it as an operational file, not only a legal document.

  • Immediate care: someone has agreed to pick up children, provide a place to stay, and follow their routines.
  • Decision-making: the caregiver knows what authority is available for school, medical care, travel, and emergencies.
  • Continuity: records, medicines, contacts, transportation information, and funds can be found.
  • Communication: household members know who to call and what to do if the parent cannot be reached.
  • Privacy: the plan is shared only with trusted people. The Legal Aid Justice Center advises not sharing it with ICE.

Immigration detention is not certain for any particular person, and this plan is not a prediction or a substitute for legal advice. It is a way to reduce confusion during an unexpected absence.

Step 1: Choose and brief a backup caregiver

Pick someone who has actually agreed

Choose a trusted adult who is willing and realistically able to care for each child. Ask about availability, housing, transportation, work schedules, language, and whether the person can handle school pickup and medical appointments. Do not list someone merely because they are a relative; confirm that they understand the responsibility and would accept it.

Ohio Legal Help’s family-preparedness guidance tells parents to consider a prospective caregiver’s immigration status. That is Ohio-specific guidance, not a universal legal requirement. In every state, ask local legal aid or a qualified attorney how a caregiver’s status could affect the arrangement and the child’s practical care.

Write down the care instructions

Meet with the caregiver and walk through an ordinary week. Record school names, pickup permissions, bus routes, after-school programs, bedtime, food restrictions, religious or cultural practices, preferred language, and important comforting routines. Include the child’s clothing sizes, activity schedules, and who may collect the child from school.

For health needs, list doctors, pharmacies, diagnoses, allergies, medicines and doses, insurance information, and the location of treatment plans. Note the child’s communication, mobility, behavioral, or mental-health needs in plain language. Keep emergency instructions current rather than relying on memory.

Plan for a second option

Identify an alternate caregiver in case the first person is traveling, ill, unreachable, or unable to accept placement. Tell both people how they will confirm that the handoff is authorized and who will pay immediate expenses. If children have different needs, make sure the proposed arrangement keeps siblings together when that is safe and practical.

Step 2: Confirm what legal authority is available in your state

Child-care documents differ sharply by jurisdiction. A document may authorize a person to make school or routine medical decisions without creating legal guardianship. Some arrangements are temporary; others require a court order. Ask a local family-law attorney or legal-aid provider to review the exact form, signing rules, duration, and limits before relying on it.

Example jurisdiction Arrangement described by the source What it may address Important limit
Ohio Limited power of attorney for child care A short-term way to authorize care while a parent is unavailable Ohio Legal Help notes that guardianship or custody questions may require an attorney; the document is not a nationwide solution.
California Guardianship proceedings Legal guardianship through the court The Immigrant Legal Resource Center says California guardianship cannot be transferred informally or through a power of attorney; court action is required.
Massachusetts Caregiver authorization affidavit Authority for specified education and medical-care decisions Massachusetts Legal Help describes an affidavit, but its execution requirements and scope are state-specific.
New York Designations for immediate care or standby guardianship Different options for short-term or planned future care LawHelpNY says to follow the signing instructions for each form; do not assume one option covers every decision.
Illinois and Indiana State-specific planning guidance Child-care and family-law options explained in local context National Immigrant Justice Center guidance stresses that family law varies by state.

Ask the reviewer five concrete questions

  1. Does this document authorize school enrollment, pickup, routine medical care, emergency treatment, or travel?
  2. Is it a temporary authorization, a standby arrangement, or a court-created guardianship?
  3. Who must sign, witness, notarize, file, or receive a copy, and when does the authority end?
  4. Can the caregiver access benefits, insurance information, or school records?
  5. What happens if the parent is detained longer than expected or cannot be contacted?

Keep the current signed version with the plan and give the caregiver a copy. Replace outdated versions rather than leaving several conflicting forms in circulation.

Step 3: Build a records packet and secure backups

Make copies while protecting originals

Ohio Legal Help recommends copies of children’s birth certificates, Social Security cards, and passports. Keep originals in a secure location and provide copies to the designated caregiver and, if appropriate, another trusted household location. Do not carry every original document in the emergency folder.

Add the records a caregiver would need to keep daily life moving:

  • School enrollment, pickup permissions, individualized education or accommodation plans, and activity contacts.
  • Medical summaries, immunization records, insurance cards, prescriptions, allergy information, and provider details.
  • Contact information for relatives, neighbors, employers, landlords, utilities, and transportation providers.
  • Copies of relevant court orders, custody papers, adoption records, or existing authorizations.
  • Pet-care instructions, lease or mortgage information, and information about vehicles or other essential property.

Use an organizer without creating a single point of failure

A labeled paper organizer can keep copies together, but it is optional and is not a substitute for backups or for telling the caregiver where materials are stored. Keep one protected digital copy if it can be secured with a strong password and two-factor authentication. Avoid leaving scans in an unprotected shared account or on an unlocked device.

Tell the caregiver and one trusted household member exactly where the packet is located and how to retrieve it. Review access after a move, a change of school, a new diagnosis, a passport renewal, or a change in the caregiver.

Step 4: Create the emergency contact and communication plan

Make one short contact sheet

List names, relationships, phone numbers, alternate numbers, languages, and the order in which people should be called. Include:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Primary and alternate caregivers.
  • School offices, teachers, daycare, coaches, and transportation contacts.
  • Doctors, therapists, pharmacies, and health-insurance contacts.
  • A local immigration legal-aid organization or immigration attorney.
  • A family-law legal-aid provider or attorney for child-care documents.
  • Relatives or friends who can provide a bed, rides, meals, translation, or emergency funds.
  • Employers, landlords, utility providers, and anyone who must be notified about an absence.

Household members should know where the contact sheet is and how to use it if the parent cannot answer. Keep a paper copy in the records packet and a secure digital copy. The Illinois Legal Aid Online and Legal Aid Justice Center guidance both emphasize accessible contacts and a current plan.

Explain the plan without frightening children

Use age-appropriate language: identify the adults who can pick them up, where they may stay, and whom they can call. Rehearse the practical steps, not frightening scenarios. Tell children never to share private family information with strangers or online. Make clear that asking a trusted adult for help is not their fault.

Adults should agree on a simple check-in method and a backup if phones are lost or disconnected. Keep the plan confidential from people who do not need it. Update it whenever a phone number, address, school, medical need, or relationship changes.

Step 5: Arrange money and ongoing household responsibilities

List what must be paid or managed

Write down rent or mortgage, utilities, childcare, transportation, insurance, school costs, medication, debt payments, payroll information, and property obligations. Note due dates, account identifiers, automatic payments, and customer-service numbers without placing unnecessary passwords in an unsecured folder.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Separate care money from general finances

Discuss how the caregiver will pay for food, transport, school supplies, medical copayments, and other child expenses. If someone else will handle bills or accounts, document how that person will reimburse the caregiver. A financial power of attorney or another arrangement may be appropriate, but its scope, signing requirements, and effect depend on state law and the account involved.

Do not assume that a child-care authorization permits access to bank accounts, wages, tax records, property, or government benefits. Ask a qualified professional whether separate authority is needed and whether a bank, employer, or agency has its own form.

Protect account access

Use strong, unique passwords and secure recovery methods. Keep a written inventory of accounts and recurring obligations in the protected records system, but do not distribute complete login credentials widely. Tell the person responsible for finances how to reach the institution’s official support channel and what identification it may require.

A short action card helps the caregiver act before everyone has time to read the full file. Put these steps at the front of the packet:

  1. Contact the primary caregiver and, if needed, the alternate.
  2. Notify the school or childcare provider who is authorized to pick up the child.
  3. Collect medicines, identification copies, comfort items, and essential clothing.
  4. Call the listed legal contacts for immigration and family-law questions.
  5. Record who has been contacted, what information was received, and what decisions were made.
  6. Protect the child’s privacy and do not post details about the situation on social media.

U.S. Immigration and Customs Enforcement’s “Detain” page, updated March 27, 2025, links to agency information for attorneys, language access, and parents. Common mistakes and how to correct them

Relying on a generic online form

Problem: A form from another state may use different witnesses, notarization, terms, or expiration rules.

Correction: Have a local legal-aid provider or attorney confirm the current form and execution requirements before signing.

Assuming a power of attorney equals guardianship

Problem: The caregiver may be unable to enroll a child in school, consent to treatment, or make a long-term placement decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correction: Ask specifically what authority the document grants and whether a court proceeding is required. California’s guidance is an explicit example of why this distinction matters.

Keeping originals in an inaccessible place

Problem: The caregiver knows the documents exist but cannot retrieve them.

Correction: Secure originals, provide usable copies, and tell trusted people the precise location and access method.

Giving the caregiver no way to pay expenses

Problem: Even a willing caregiver may not be able to cover food, transport, or medicines.

Correction: Decide who manages funds, how expenses are reimbursed, and whether separate financial authority is needed.

Making a plan once and forgetting it

Problem: Phone numbers, schools, diagnoses, addresses, and relationships change.

Correction: Schedule a review at least annually and after every major family or legal change. Ask the caregiver to confirm that the plan still works.

Sharing sensitive information too broadly

Problem: Wider circulation can expose immigration, financial, medical, or location information.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correction: Limit access to people who need it, use secure storage, and follow the Legal Aid Justice Center’s advice not to share the plan with ICE.

When and where to get qualified help

Use two kinds of review when possible: an immigration legal-aid organization or immigration attorney for immigration questions and rights, and a family-law attorney or legal-aid provider for caregiver, custody, guardianship, and authorization documents. The Immigrant Legal Resource Center’s Step-by-Step Family Preparedness Plan, published March 10, 2026, covers child-care options, trusted immigration services, and rights. The National Immigrant Justice Center’s guidance for Illinois and Indiana likewise warns that family law is state-specific.

Ask any provider whether they serve your state, whether advice is available in your preferred language, what documents to bring, and how to verify the provider’s credentials. The ICE “Detain” resource page can point to agency information, but it does not determine which private legal arrangement is valid for your family.

Printable household checklist

  • Primary caregiver has agreed and knows the children’s routines.
  • Alternate caregiver has agreed and has the contact sheet.
  • Local professional has reviewed the proposed child-care document.
  • Copies of birth certificates, Social Security cards, passports, medical and school records are stored securely.
  • Originals are protected and their location is known to trusted people.
  • School, medical, legal, family, and emergency contacts are current.
  • Care instructions include medicines, allergies, transportation, and accessibility needs.
  • Bills, benefits, work, property, and account responsibilities are assigned.
  • Caregiver expenses and any separate financial authority are addressed.
  • Adults and children have discussed the plan in age-appropriate language.
  • The plan is private, easy for authorized people to find, and dated.
  • A review is scheduled after changes in contacts, health, school, housing, or law.

What this plan cannot do

A preparedness file cannot prevent detention, guarantee release, create nationwide guardianship, or replace a court order where one is required. It also cannot make a state accept a document that was signed incorrectly or has expired. Its value is practical: it gives trusted people a clear, lawful starting point while qualified professionals address the legal questions specific to your family.
