How to Identify the Laws That Apply to Big Data Analysis

Big-data laws depend on the data, location, roles, purpose, and sharing. Learn how to scope applicable rules and use voluntary governance frameworks appropriately.

There is no universal checklist of laws for big data analysis. Which rules apply depends on where an organization and the people its data concerns are located, what kind of data is involved, the organization’s role, and what it does with the data—including how it combines, analyzes, shares, and retains it. Start by mapping those facts, then match them to current legal requirements; use governance frameworks to organize the work, not as substitutes for law.

What laws apply to big data analysis?

The answer is specific to the project. A rule that covers personal data may not apply to a dataset that is genuinely non-personal, while a new link between datasets or a new use may change the privacy and security risks. Sector, location, and the roles of the organizations handling the data can also matter.

For an initial legal map, check the rules that may apply in each relevant jurisdiction and compare them across the issues that affect your project:

  • Reach and scope: Which organizations, people, activities, and locations does the rule cover?
  • Data and roles: What data categories are covered, and what duties attach to each party’s role?
  • Use and rights: What purposes and legal grounds are permitted, and what rights or notice duties apply?
  • Safeguards and sharing: What security, assessment, breach, sharing, or cross-border transfer requirements apply?
  • Timing and enforcement: When did the rule take effect, and which authority enforces it?

These are questions for the mapping process, not a claim that every law contains the same requirements. The European Commission’s overview of EU data-protection law, for example, identifies several distinct instruments rather than one rule that applies to every analytics project.

Which EU rules are relevant examples?

The European Commission describes EU data-protection legislation as including the General Data Protection Regulation (GDPR), the Law Enforcement Directive, and the Data Protection Regulation for EU institutions, bodies, offices, and agencies. These instruments have different scopes. The directive concerns competent authorities’ processing for law-enforcement purposes; the regulation for EU institutions applies to those institutions and bodies. They should not be treated as rules that automatically govern every private-sector analytics project.

The Commission also identifies the Data Governance Act and the Data Act as separate instruments concerned with data access and use. The Data Governance Act establishes a framework that includes reuse of certain public-sector data, data intermediation services, and voluntary data altruism. The Commission says the GDPR applies whenever personal data is involved in reuse covered by the Data Governance Act.

The Data Act entered into force on 11 January 2024 and began applying on 12 September 2025, according to the Commission. Its timing does not by itself establish that a particular analytics activity falls within its scope. For any of these instruments, check the current legal text and the facts of the intended use.

Does analyzing personal data change the legal analysis?

Yes. In the EU context, the Commission states that GDPR applies whenever personal data is involved in reuse covered by the Data Governance Act. More broadly, whether information is personal—and whether a project joins it to other information in a way that changes its identifiability—can affect which legal obligations need review. Do not assume that calling a dataset “big data,” pseudonymized, or de-identified settles the question.

Inventory data before analysis or combination. Flag personal and sensitive information, health-related data, children’s data, confidential business information, and any data subject to special restrictions. Then identify the project’s purpose, the parties’ roles, the applicable legal ground where required, notices or permissions, retention plan, recipients, and process for handling rights requests.

Is the NIST Privacy Framework a law?

No. The National Institute of Standards and Technology (NIST) describes its Privacy Framework Version 1.0, published in January 2020, as a voluntary tool for managing privacy risk. NIST states: “The contents of this document do not have the force and effect of law and are not meant to bind the public in any way.” Its FAQ describes the framework as jurisdiction- and sector-agnostic: it can help an organization carry out its legal obligations, but it does not embed the specific terms of any one law.

Use the framework to structure risk management, not as a compliance certification, legal opinion, or replacement for identifying binding requirements. NIST’s Big Data Interoperability Framework Volume 4, published on June 26, 2018, provides technical context on big-data security and privacy, including use cases, taxonomies, and the security and privacy fabric of the NIST Big Data Reference Architecture. It is a technical resource, not a statute.

How should an organization scope a big-data project?

The following sequence is a practical governance workflow, not a statutory checklist. It draws on NIST’s voluntary risk-management approach and the OECD’s description of data governance across the data lifecycle.

  1. Map locations. Record where the organization operates, where the people represented in the data are located, and where data is stored, accessed, or transferred.
  2. Inventory data. Classify the data, including whether it is personal, sensitive, health-related, about children, confidential business information, or subject to special restrictions. Note how datasets could change when linked.
  3. Identify parties and roles. List each organization involved and determine its role under the potentially applicable rules—for example, controller, processor, service provider, covered entity, business associate, researcher, or public authority, where relevant.
  4. Document the proposed use. State the analysis purpose, legal authority or other lawful basis where required, notices and permissions, retention period, access and sharing recipients, and how rights requests will be handled.
  5. Assess risks and safeguards. Before combining datasets or enabling a new use, assess privacy and security risks. Restrict access, protect the data, document decisions, and plan for deletion or de-identification where appropriate.
  6. Map law separately from guidance. Use a framework such as NIST’s Privacy Framework to organize risk work, while separately identifying binding requirements and checking current regulator guidance.
  7. Review when facts change. Reassess when the data, purpose, vendors, jurisdictions, or applicable law changes.

How can governance support trustworthy data use?

The OECD defines data governance as the technical, policy, and regulatory frameworks used to manage data across its value cycle, from creation through deletion. That lifecycle view helps connect decisions that can otherwise be treated as separate: collection, access, analysis, sharing, retention, and disposal.

The OECD’s recommendation on data access and sharing calls for trustworthy sharing tied to defined public or societal purposes, with benefits, costs, and risks considered, and with ethics, the rule of law, human rights, privacy, and freedoms taken into account. It recommends coherent, flexible, scalable governance frameworks and regular review. This is an international recommendation, not binding law for every organization.

An OECD paper published in 2024 notes that approaches differ among jurisdictions and legal systems. It warns that policy silos can cause misunderstanding, complicate compliance and enforcement, and impede the use of shared principles. Although that paper focuses on AI, the caution is relevant to analytics projects that cross privacy, data-governance, and other policy domains: coordinate the review rather than assuming that one policy checklist resolves them all.

When is a project-specific legal review needed?

Use a qualified legal or privacy professional when the project crosses jurisdictions, involves sensitive or restricted data, introduces a new purpose or recipient, or leaves uncertainty about the parties’ roles or applicable requirements. A high-level overview cannot determine whether a particular project is lawful. The EU examples above are not an exhaustive global list, and current laws and regulator guidance should be checked against the project’s actual facts.
