How to Get a New Court Date After a Courthouse Closure

A courthouse closure may not automatically reset your hearing. Check the court’s notice and case status, contact the clerk promptly, and verify the new date and any case action.

If a courthouse closure disrupted your hearing, contact the court that scheduled it as soon as it reopens and ask what happened to your case. A closure does not necessarily reset every hearing automatically: check the court’s official closure notice and case status, then follow that court’s instructions for rescheduling or requesting a continuance.

1. Check the closure notice and case status

Look for an announcement on the court’s official website or case portal. The notice may explain whether hearings were cancelled, postponed, or handled another way. Check the court system that scheduled your hearing rather than relying only on a general government closure notice. Massachusetts, for example, says its Trial Court may not close when federal courts do and directs people to check its own announcements and contact the specific court; policies vary by court. If the docket or portal does not show a new date, do not assume one has been set. Online records may not immediately reflect the court’s next step, so confirm directly with the court.

2. Contact the court that scheduled the hearing

When the courthouse reopens, call the clerk’s office or the department handling the case. Have your case number, the names of the parties, the scheduled hearing date, and the courthouse ready. Ask whether the hearing was cancelled, already reset, or whether you must file a motion or other request.

Colorado’s emergency-closure policy instructs parties to contact the court on the first business day after the closure to reschedule. It also describes going to the clerk’s window on that first open business day as an alternative. The policy is a Colorado example, not a nationwide rule; check the current instructions for your court. Colorado Judicial Branch emergency policy.

While you have the clerk’s attention, ask:

  • Is the hearing officially cancelled, postponed, or reset?
  • Do I need to file anything, and is there a court form?
  • Is there a deadline or an approved way to submit the request?
  • Must I send a copy to the other party, or obtain their position?
  • How will the replacement date be communicated, and when should I check again?

Clerk staff can generally explain filing and calendar procedures. For advice about legal rights, strategy, warrants, defaults, or an adverse order, contact an attorney or legal aid provider.

3. Follow the court’s deadline and filing instructions

Act promptly: local deadlines can be short. For example, a Blaine Municipal Court local-rule provision says non-City parties must contact the Clerk’s Office within two business days after reopening is publicly announced to reschedule hearings missed during an emergency closure. It warns that failure to do so may be deemed failure to appear. This is a local example, not a deadline for other courts; confirm whether the rule is current and applies to your case. Blaine Municipal Court rules.

Ask which submission methods the court accepts for this situation. Depending on the court’s instructions, options may include a portal, phone contact, an in-person clerk window, mail, or fax. Do not assume a method permitted for ordinary continuance requests is accepted for a closure-related matter. Confirm the deadline, how to prove submission, processing expectations, and whether a separate copy must go to another party.

4. If required, make a written request for a new date

If the court directs you to file a written request, identify the case and scheduled hearing, explain that the courthouse closure prevented the hearing from going forward, and ask for a new date. Follow the court’s instructions about forms, filing, service, and whether the other party’s agreement or position must be included.

Vermont Judiciary’s general continuance guidance says to explain why you are requesting a new date and whether the other party agrees. King County’s ordinary continuance instructions provide a separate example involving a written request, advance filing, and sending a copy to the other party. Those ordinary-request requirements do not establish the closure procedure for another court. Use the instructions from the court handling your case. 5. Keep records and verify the new date

Save the official closure notice, your hearing notice, any relevant case-portal entries, and copies or receipts for anything you file. Keep a brief record of calls and messages, including dates, whom you contacted, and any instructions you received.

Do not treat a call or submitted request as approval. Check the docket or contact the court again to confirm that a new date has actually been entered or communicated, and ask when and how notice will be sent.

6. Check immediately for orders or other consequences

Ask whether the court entered an order or took other action when the hearing did not go forward. Consequences depend on the court and case type. Vermont’s guidance warns that missing a hearing or trial in a criminal matter may result in a warrant; the Blaine rule example also warns that missing its specified post-reopening contact window may be treated as failure to appear. These examples do not predict what happened in another court or case. Vermont Judiciary guidance; Blaine Municipal Court rules.

If you learn that a warrant, default, or other adverse order may have been entered, contact an attorney or legal aid promptly. Do not rely on a general closure announcement to resolve a case-specific consequence.

What to do if you cannot reach the court

Use the contact details on the court’s official site, check its closure announcement and case portal, and try again when the court is open. If the court specifies an in-person clerk window or another submission method, follow that instruction. Keep records of your attempts and continue checking the docket until the court confirms the case’s status and next date.

Rules for continuances and missed hearings are jurisdiction- and case-specific. California Rule of Court 3.1304, for example, concerns law-and-motion hearings in California; it does not determine what happens after a courthouse closure in another state. California Rule of Court 3.1304.
