To find out what a particular store says about its cameras and customer data, start with the retailer’s current official privacy notice, then check whether it specifically describes in-store video, its purposes, sharing, and retention. If it does not, ask the retailer directly: a general online privacy policy may not explain camera practices, and a camera’s presence alone does not show whether it uses facial recognition or other identification.
Where to find the retailer’s current privacy notice
- Open the retailer’s official website or app. Check the footer, account settings, help pages, and checkout or loyalty-program screens for links labeled Privacy, Privacy Policy, Your Privacy Choices, or Customer Data.
- Use the site’s search function, or a web search for the retailer’s name and “privacy policy.” Prefer the notice published by the retailer over third-party summaries.
- Check the notice’s date or save a copy of the page. Policies and practices can change, so a search snippet or old cached page may not reflect the current notice.
The FTC’s consumer privacy materials offer a useful framework for reading disclosures: look for what information is collected, how it is used, whether it is shared, and how it is protected. That framework does not mean every retailer uses the same format or has the same disclosure obligations.

What to search for in the policy
Use the page’s find function to check for terms such as camera, video, surveillance, analytics, facial recognition, in-store, retention, sharing, and service providers. A notice may describe online accounts and purchases but say little or nothing about in-store cameras.

Does it discuss device identifiers, purchase or loyalty-account information, or information entered through the retailer’s site or app? Do not assume every store collects all of these categories.
- Purpose: Does it say video is used for security, loss prevention, store operations, customer analytics, personalization, or another purpose?
- Identification or linkage: Does it explicitly describe facial recognition or another method of identifying a person, or linking visits, purchases, or accounts? The presence of a camera does not establish that identification occurs.
- Sharing: Does the policy name vendors or service providers, affiliated businesses, authorities, or other recipients of the information?
- Retention and choices: Does it state how long information is retained and provide a privacy contact or any request, objection, or choice mechanism? A notice’s silence does not establish that a particular practice is absent.
What to ask if the policy does not explain cameras
Use the privacy contact listed in the notice or the retailer’s customer-service channel. Be specific about the store or location if relevant, and ask for the current notice that applies to in-store cameras. You can ask:

- Are cameras used for security only, or also for analytics, identification, or another purpose?
- Does the retailer use facial recognition or another method to identify people or link visits to purchases or accounts?
- How long is footage retained?
- Is footage shared with vendors, service providers, affiliated businesses, authorities, or other recipients?
- Is there a privacy contact or any way to make a request, objection, or choice about this information?
Ask the retailer to point you to the relevant notice or explain which policy applies. The sources available here do not establish a universal right to access or delete in-store footage, so do not assume a request can be granted in every location.
How much older retail-tracking information can tell you
The FTC’s April 2015 article, “Privacy trade-offs in retail tracking,” described video retail analytics used to observe in-store patterns and said such analytics typically did not use facial recognition at that time. It also distinguished camera systems from other retail tracking methods and discussed how notice and choice varied by method. That article is historical context, not evidence of what a retailer uses today; check the retailer’s current notice or ask directly.

Why camera security disclosures matter
In August 2024, the FTC announced proposed action against security-camera company Verkada over allegations that included inadequate protection of camera footage and customer account information. The announcement said a March 2021 breach gave a hacker access to more than 150,000 live Verkada customer cameras. That figure concerns the breach described in that case, not retail cameras generally. The FTC also described a proposed $2.95 million monetary penalty as part of a proposed order requiring a federal judge’s approval; the announcement alone does not establish that the penalty was finally imposed.
“When customers invite companies into private spaces to monitor consumers by using their security cameras and other products, they expect those companies to provide basic levels of security, which Verkada failed to do.”

Comparing two store privacy notices
If you are comparing retailers, use the same questions for each notice. Record only what the text says; if a topic is absent, mark it “not specified,” rather than treating silence as proof that the store does or does not use a practice.

What a policy cannot establish by itself
The FTC materials discussed here provide general privacy context and a specific camera-vendor enforcement example. They do not establish one U.S. rule requiring every store to publish a camera-specific policy, a universal footage-retention period, or the rights available to a reader in an unspecified jurisdiction. If you need to know what applies to a particular store, verify its current official notice and, where relevant, consult current guidance from the regulator for your location.
