Do not share sensitive information with an AI mental-health chatbot until you can explain, in plain language, what the service collects, why it uses the data, who receives it, how long it keeps it, and how deletion works. Read the privacy policy and the app’s settings first. If those answers are missing, contradictory or difficult to find, use only non-identifying, general questions—or choose not to use the service.
This guide answers the practical question: How to evaluate an AI mental health chatbot before sharing personal information? It focuses on generative-AI chatbots and wellness applications, not traditional telehealth platforms or regulated digital therapeutics. The legal examples are primarily U.S. guidance, and the result can change with your country, the provider’s status and the product’s design.

What you are actually evaluating
A chatbot conversation is more than the words you type. A service may also collect account details, device identifiers, IP address, timestamps, diagnostic logs, uploaded files, voice recordings, location signals or information inferred from your messages. The useful question is therefore not simply “Is this private?” It is whether you understand the entire data lifecycle.

The Federal Trade Commission (FTC) says consumer health information can include information that conveys or enables an inference about health, not merely a formal diagnosis. A message such as “I have panic attacks before work” can therefore be sensitive even when you never state a medical condition.

A pre-disclosure audit you can complete in 15 minutes
Perform this check before entering an intimate story. Save a copy of the policy and note the date, because wording and settings can change.
- Identify the service category. Is it a general-purpose generative-AI chatbot, a mental-health wellness app, a telehealth service, or a regulated digital therapeutic? Do not assume that labels such as “therapy” describe a particular legal relationship.
- Open the current privacy policy. Use the in-app link and the provider’s website. Search within it for “conversation,” “content,” “health,” “training,” “improve,” “advertising,” “retention,” “delete,” “vendor,” “sale” and “anonymous.”
- Inspect account and device permissions. Check whether microphone, contacts, photos, precise location, calendar or advertising identifiers are optional. Deny anything unnecessary and verify that the app still works.
- Find the model-training control. Look for a switch that stops use of conversations for training or product improvement. Read whether turning it off applies to new chats only, whether humans may still review content, and whether it affects existing data.
- Test deletion before disclosure. Locate the path to delete an individual conversation and the whole account. Read exceptions for fraud prevention, legal compliance, backups, safety records and aggregated or de-identified data.
- Check sharing terms. Determine whether service providers, analytics vendors, advertising partners or affiliates receive chat content or only identifiers. “We do not sell data” does not necessarily mean “we never share it.”
- Ask a harmless question. Use a made-up scenario and then inspect the conversation history, export function, feedback controls and any personalization panel. This reveals what the interface actually does, rather than what a slogan promises.
- Apply a stop rule. If a material answer is absent, buried in an inaccessible document or inconsistent with the settings, do not provide identifying or intimate details.
How to read the privacy policy
Separate chat content from account and device data
Policies often list “personal information” broadly and then describe chat content elsewhere. Make two inventories. The first is what you type, upload, say or show. The second is account information (such as email, age or payment details), device and network identifiers, cookies, crash reports and usage timestamps. Ask whether the two sets are linked to a profile and for how long.
Also look for inferred information. A system may derive interests, emotional states, risk scores or likely diagnoses from your messages. The policy should explain whether those inferences are stored, used to personalize responses or shared.
Find every stated purpose
Necessary service operation is only one possible purpose. Other purposes may include safety monitoring, quality review, research, model training, product improvement, personalization, marketing, advertising measurement, legal compliance and corporate transactions. A broad phrase such as “for business purposes” does not tell you enough; look for a specific explanation of what happens to conversations.
The American Psychological Association (APA) advises consumers to be extremely cautious with sensitive information and to avoid personally identifying details. Its consumer guidance states: “The public and consumers must be cautious with their data and check privacy policies and in-app settings when using an app or GenAI chatbot.”

Answer the training question precisely
“Will my chats be used to train the AI?” has several possible answers. A provider might use content to train a foundation model, fine-tune a product, evaluate responses, allow human reviewers to label examples, or improve abuse detection. A setting may opt you out of one use while permitting another. Check whether opt-out is the default, whether it covers voice and uploaded files, and whether it is available without a paid plan.
Look for the retention period attached to training data. Deleting a visible chat may not remove a model already updated from it, and a policy should explain what deletion can and cannot accomplish. If the provider does not explain this, treat training use as unresolved.

Map recipients and onward transfers
List each recipient category named in the policy: hosting and storage providers, customer-support contractors, security and fraud vendors, analytics services, advertising or measurement partners, affiliated companies and government authorities responding to lawful requests. Determine whether those parties can receive the text of a conversation or only technical identifiers.
Check where processing occurs and whether information leaves your country. Cross-border transfer language may affect your rights and the remedies available to you. A statement that data is “shared only with trusted partners” is not a meaningful answer unless the categories and purposes are described.
Understand retention and deletion
A credible policy gives a period, a trigger or a method for deciding how long records remain. “As long as necessary” should be accompanied by criteria. Ask whether deleted chats persist in backups, moderation logs, customer-support tickets, legal holds or de-identified datasets.

Deletion should be available through a clear in-app path or an accessible request process. Note the expected completion time, whether the provider sends confirmation and which records are exempt. The FTC recommends deleting information when there is no longer a legitimate business need to retain it; a provider should explain that need rather than relying on indefinite storage.
Look for security without treating it as a privacy promise
Encryption in transit and at rest, access controls, audit logs and breach notification procedures reduce security risk, but they do not answer whether the company is allowed to use your conversation for advertising or model improvement. Evaluate security and privacy as separate questions.
Inspect settings and permissions in the app
Policies describe practices at a high level; settings reveal choices available to you. Review them before your first personal message and again after major updates.
- History: Is chat history on by default? Can you disable it, and does disabling history stop retention or merely hide the list?
- Training and improvement: Is there a clearly labeled opt-out? Does it cover existing conversations and all device types?
- Human review: Can staff or contractors read conversations for quality, safety or support? Is there a way to exclude your content?
- Personalization: Can the service create a persistent memory or profile? Can you inspect and erase individual memories?
- Sharing: Are links, screenshots, feedback forms or “share with the team” buttons sending the full transcript?
- Permissions: Is access to microphone, camera, contacts, files, location and notifications necessary for the feature you want?
- Account controls: Can you export data, change the login email, remove a payment method and close the account without contacting sales?
On a phone, review the operating system’s permission screen as well as the chatbot’s own menu. Revoke access that is not needed, then test whether the app requests it again. Keep the minimum account information necessary to use the service; an optional real name, profile photo or contact import increases identifiability.
Does HIPAA protect a consumer chatbot conversation?
Usually, you cannot answer that from the app’s marketing label. The U.S. Department of Health and Human Services (HHS) says the HIPAA Privacy Rule generally does not cover health information that a person enters into a personal app unless that app is provided by a HIPAA-covered entity or its business associate. A standalone consumer chatbot may therefore fall outside HIPAA even when it discusses depression, medication or therapy.

That is not a declaration that the provider can do anything it wants. The FTC Act, the Health Breach Notification Rule, state privacy laws, contract terms and other rules may apply, depending on the service and jurisdiction. HHS also explains that HIPAA-covered entities and their business associates have specific obligations when they use online tracking technologies. Whether those obligations reach your chatbot depends on the provider’s legal relationship and product design.
| Question | What the answer depends on | What to verify |
|---|---|---|
| Is HIPAA relevant? | Whether the app is supplied by a covered entity or business associate, not simply whether it handles health-related text. | Who operates the service, under what agreement, and which component receives your message. |
| Can another privacy rule apply? | Provider type, data practices, state or national law and the service’s representations. | Applicable notices, breach terms, consumer rights and complaint channels. |
| Does “HIPAA compliant” settle the issue? | No. The phrase may omit training, advertising, retention and non-HIPAA data flows. | Specific practices, limits, controls and evidence supporting the claim. |
Treat “HIPAA compliant,” “private” and “secure” as claims to investigate, not as substitutes for a policy. The FTC warns against misleading health-data claims and against burying material information.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Compare two services with the same scorecard
If you are choosing between chatbots, record evidence for each one in the same table. Do not rank a service when a material cell is unknown.
| Comparison axis | Questions to record | Why it matters |
|---|---|---|
| Data collected | Are chat text, voice, uploads, account details, device IDs, IP address, cookies or inferred traits collected? | More linked data makes a conversation easier to associate with you. |
| Purposes | Are responses generated only for your session, or are content, feedback and metadata used for safety, analytics, training or advertising? | A service purpose can permit uses you did not expect. |
| Recipients | Which vendors, reviewers, affiliates and advertising or measurement partners can access content or identifiers? | Each recipient adds another organization and policy to the data chain. |
| Retention and deletion | What is the stated period, what survives deletion, and is confirmation provided? | Short, defined retention limits future exposure. |
| Clarity and accessibility | Can an ordinary user find the policy, settings and deletion controls without contacting support? | Unclear controls make promises hard to verify or exercise. |
| Service category and legal relationship | Is it a general chatbot, wellness app, telehealth service or regulated therapeutic, and who is the responsible entity? | Category affects applicable duties; a bare HIPAA label does not. |
Use “not stated” when a provider does not answer. An unknown training policy or deletion process is a risk finding, not a neutral score.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesRed flags that should stop disclosure
- The privacy policy is missing, inaccessible, or materially different from the in-app settings.
- “We may use data to improve services” appears without saying whether conversations train models or receive human review.
- Deletion removes the visible history but the policy reserves indefinite retention of backups, logs or derived profiles.
- The company promises not to sell data but lists advertising, cross-context behavioral advertising or broad partner sharing.
- Opt-out controls are hidden, apply only to future chats, require a paid tier or cannot be used without an account representative.
- The app requests contacts, precise location, microphone or photo access unrelated to the feature you need.
- A “HIPAA compliant” badge is presented without identifying the covered entity, business associate relationship or limits of the claim.
- The policy says information may be used for “any business purpose,” “research” or “commercialization” without meaningful boundaries.
Signals that support a cautious yes
No signal guarantees safety, but these details make a decision more evidence-based: a dated, readable policy; a separate explanation of conversation content; a default-off or clearly documented training use; granular controls for history and memory; named recipient categories; a defined retention period; an account-level deletion path with exceptions explained; and permission requests that match the feature.
Best Value
Confirm the controls yourself. A provider’s statement that it “does not use chats for training” still leaves questions about customer-support review, safety monitoring, backups and advertising identifiers.
What to share, if you decide to continue
Start with the least identifying version of your question. Replace names, employers, schools, addresses, dates of birth, phone numbers, email addresses, account numbers and exact locations with general descriptions. Do not upload medical records, therapy notes, prescription labels, insurance documents, voice recordings or screenshots containing other people’s information unless you have a clear reason and understand the retention terms.
Use a graduated approach:
- General information: Ask about coping techniques or how to prepare for a conversation without describing your identity.
- Limited context: Add broad, non-identifying details only if the first answer is useful and your audit found acceptable controls.
- Personal details: Share intimate history only when you have a specific need, have verified the policy and settings, and accept that deletion may not remove every copy or derived record.
Do not treat the chatbot as a confidential substitute for a licensed professional. If you need diagnosis, treatment, medication advice or a human assessment, use an appropriate qualified service and ask that provider how it handles records.

If you already disclosed something sensitive
- Stop adding information until you understand the controls.
- Export or record the policy and settings that applied when you used the service.
- Delete individual conversations, saved memories and uploaded files, then request account deletion if you no longer need the service.
- Turn off training, personalization, marketing and unnecessary permissions; revoke the app’s access in your device settings.
- Ask support what remains in backups, safety logs, human-review systems, vendor systems and de-identified or aggregated datasets, and request written confirmation of the available deletion.
- If the provider made a misleading health-privacy claim or fails to honor its stated process, document dates and messages and consider the consumer-protection or privacy complaint route available in your jurisdiction.
Changing your password can protect account access, but it does not erase a conversation already stored by the provider. Focus on deletion and use controls as well as login security.
A practical decision rule
Proceed only when you can answer all five questions: what is collected, how it is used (including training), who receives it, how long it is retained, and how you can delete it. If one answer is unclear, keep the interaction generic. If several are unclear, do not disclose personal information and look for a service with more transparent controls or seek human support.
This approach follows the FTC’s recommendations to minimize data, limit access and permissions, provide an accessible explanation of collection, use, sharing and security, and delete information when there is no longer a legitimate business need to retain it. It also reflects the APA’s warning that consumers should check both privacy policies and in-app settings before using a generative-AI chatbot for mental-health matters.
