Evaluate a proposed data center as both a land-use decision and an infrastructure decision. Find every approval process, obtain one complete project description, and test the project’s effects and promises against local evidence: who pays for power and water capacity, what the site can support, what impacts neighbors may face, and which benefits are enforceable. There is no single U.S. approval sequence or universal threshold, so confirm the rules and deadlines with your local authorities.
1. Map the approvals, decision-makers, and deadlines
Start with the parcel address and local planning department. Ask which approvals the proposal needs, which decisions are discretionary, which agencies or utilities are involved, and where each application and public comment docket can be reviewed. Record hearing dates and submission deadlines as soon as they are announced.

- Check the parcel’s zoning and whether the proposed use is allowed as of right or needs a rezoning, special permit, variance, site-plan approval, or other local action. The names and sequence of approvals vary by jurisdiction.
- Ask which agencies handle environmental permits, electric service, water supply, wastewater, and stormwater. Do not assume approval from one agency covers the others.
- Ask whether utility infrastructure has a separate review or public process, and how to find its filings and meeting notices.
- Keep a dated copy of applications, plans, agency responses, revisions, and your own submissions.
Pennsylvania’s official planning toolkit is intended to support decisions from initial inquiry through zoning, permitting, and long-term planning. Michigan EGLE’s FAQ illustrates that environmental permits, electric-utility matters, and wastewater review can involve different entities and case-specific processes. These are examples of how to investigate, not a national approval checklist.

- Buildings and site: building locations, heights, phases, equipment areas, setbacks, access roads, lighting, and landscaping.
- Electricity: expected and peak demand, requested service capacity, anticipated connection date, substations and transmission work, proposed power supply, and any on-site generation or backup systems.
- Water and wastewater: water source, expected annual and seasonal use, peak demand, cooling design, reuse plans, wastewater volumes and destination, and stormwater controls.
- Neighborhood effects: generator emissions and testing, expected day and night noise, lighting, construction schedules, truck routes, and emergency-response needs.
- Ownership and phases: applicant and operating entities, anticipated schedule, and how the site or obligations would be handled if ownership changes.
Ask for the same assumptions to be used across application materials, public presentations, and impact studies. ERCOT’s 2026 request for information shows the breadth of data a grid operator may seek, including power dependency, on-site generation, water sources and use, cooling, noise, light, traffic, public financial assistance, tax benefits, and ownership. That request is specific to Texas and is not a general disclosure rule.
3. Trace electricity demand, grid work, and cost responsibility
A facility’s electricity bill and the cost of new shared grid infrastructure are separate questions. Ask the electric utility and relevant regulator to explain both. Request the project’s load forecast, the upgrades needed to serve it, the construction schedule, and the rules or agreements that determine who pays.
Questions for the utility or regulator
- How much load has the applicant requested, and what demand is expected at each phase?
- What transmission, substation, or distribution work is required, when must it be built, and what happens if the project schedule changes?
- Which costs are assigned to the developer, the utility, other ratepayers, or taxpayers? Which are project-specific, and which become shared infrastructure?
- What happens to those costs if actual electricity use is lower than forecast, construction is delayed, or the facility closes after upgrades are built?
- How do the utility’s local rules address reliability and affordability as demand grows?
Fairfax County says residents do not directly pay for data-center electricity, but may pay a portion of infrastructure upgrades needed to serve increased demand. That is a local explanation, not a rule for every utility territory. Pennsylvania’s GRID standards identify energy affordability as one of four focus areas, and a Massachusetts executive order issued September 8, 2026, describes concerns about grid investment, affordability, and reliability. For a specific proposal, rely on the applicable utility filings, regulator, and rate rules.

4. Test water use, cooling, and wastewater capacity
Request estimates that identify the water source and distinguish annual consumption from seasonal and peak demand. Ask how much water the cooling system uses under different operating conditions, whether water is reused, and what the estimate includes. A description such as “closed loop” or “low water” is not enough without quantities, assumptions, and a clear accounting boundary.
- Ask the water utility or regulator whether the source and local system can serve the proposed demand, including during drought or low-flow conditions.
- Ask where wastewater will go, how much will be produced, what treatment is required, and whether the receiving system has capacity.
- Request stormwater and water-quality plans, including how runoff will be managed during construction and operation.
- Ask what analysis addresses effects on water quality, aquatic species, and habitat.
Massachusetts’ 2026 framework says data-center development should not strain local or regional water and wastewater systems and should avoid negative effects on water quality, aquatic species, and habitat. ERCOT’s 2026 request treats water source, consumption, and cooling technology as distinct information needs. Those materials can help shape questions, but the local water and wastewater providers are the relevant starting point for capacity at a particular site.
5. Examine neighborhood, environmental, and construction impacts
Review the site plan and supporting analyses for the places and times impacts may be greatest: homes and sensitive sites near equipment, nighttime operations, generator testing, construction traffic, and periods when cooling equipment is under heavy demand. Ask what standards apply, who prepared each technical analysis, and whether the applicant will monitor conditions after opening.

- Noise: request day- and night-time analysis that identifies cooling equipment and generator locations and considers tonal or low-frequency sound. Ask for monitoring commitments and a process for investigating complaints.
- Air: ask what emissions are expected from backup generators and other on-site equipment, how often generators may be tested, and which air permits or limits apply.
- Traffic and construction: request truck routes, construction hours and schedule, expected road impacts, and plans for managing dust, runoff, and disruption.
- Land and safety: examine lighting, site design, habitat, emergency access, and the project’s relationship to nearby homes and other sensitive locations.
Fairfax County identifies energy and water demand, air and water quality, noise, building design, environmental effects, and site location as topics in its local data-center planning work. Massachusetts’ expectations also address air quality, public health, noise, land use, and the environment. The requirements that apply to a specific proposal depend on its location and permits.

6. Compare public costs with the benefits being claimed
Ask for the assumptions and calculations behind both projected revenues and public costs. A headline tax figure or job total does not by itself show the project’s net local value.

- Request details of tax treatment, exemptions, incentives, grants, or other public financial assistance.
- Ask what property and other local revenue is forecast, when it would arrive, and which assumptions drive the estimate.
- Request estimates of public infrastructure and service costs, including who is expected to bear them.
- Separate temporary construction employment from permanent jobs. Ask for the number, wage and skill assumptions, local hiring or training commitments, and the methodology used to produce each estimate.
- Ask for an independent review of the fiscal model and compare the proposal with plausible alternative uses of the site.
Pennsylvania’s standards include workforce and economic development alongside energy affordability. ERCOT’s 2026 request asks about public assistance and tax benefits. The official materials cited here do not establish a universal permanent-job count or predictable net fiscal result; use the project’s local evidence rather than generalized claims.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.7. Turn community benefits into verifiable obligations
Treat a promise as a proposal until its recipient, amount or service, timing, duration, reporting, verification, and remedy are clear. Ask for commitments to be written into an enforceable agreement or permit where local law allows, and check what happens if the operator misses a target or ownership changes.

- Who specifically benefits, and how will eligibility be determined?
- What will be provided, in what amount, and when will it begin?
- How long does the commitment last, and who reports progress?
- Who independently verifies results, and how can the public review the evidence?
- What remedy applies to noncompliance, and does the obligation carry over to a new owner?
Massachusetts Executive Order 658, dated September 8, 2026, directs specified state agencies to condition permits for covered projects above 25 MW on framework conformance and submission of a community benefits agreement, among other requirements. This is a Massachusetts-specific condition for the covered permits and projects, not a nationwide threshold. Pennsylvania’s GRID materials emphasize transparency and engagement and set expectations for projects seeking state support. Canada’s principles call for early engagement and independently verifiable local-impact information, including tracking material commitments over time. These examples can inform requests but do not automatically apply in other jurisdictions.

8. Participate early and make a useful public record
Take part while plans and conditions can still be considered. Attend relevant planning, utility, and environmental hearings, and send focused questions before the applicable deadlines. Ask for written answers and request that the answers, revised plans, and any commitments be placed in the public record.
- Find the official docket and schedule. Confirm the correct agency, application number, hearing dates, and comment deadline with the authority handling the decision.
- Submit specific questions tied to documents or impacts. For example: “Which forecast supports the requested peak load, and who pays for the substation upgrade if the project uses less power than forecast?”
- Ask for responses and revisions in writing. Keep copies of what you submit and note when new plans or studies are added.
- Include the relevant affected parties. Where appropriate, involve nearby residents, local governments, utility and water providers, and relevant Indigenous communities.
Pennsylvania’s GRID process gives local approval an explicit place before state environmental permit review under its requirements. Canada’s principles call for early, transparent engagement with affected local governments and Indigenous communities and respect for local approval processes. Local timing, standing, and legal rights must be confirmed with the actual permitting authority.
9. Compare proposals or design alternatives on the same basis
If there is more than one proposal, site, or design, use the same questions and evidence standards for each. A lower impact in one category does not settle whether a location is suitable if local systems lack capacity or costs are allocated unfairly.
| Comparison area | What to compare |
|---|---|
| Site and land use | Zoning compatibility, distance to homes and sensitive sites, site design, and required approvals. |
| Power | Power source, requested and forecast demand, grid capacity, infrastructure schedule, and cost allocation. |
| Water | Source, seasonal and peak use, cooling method, reuse, wastewater route, and local system capacity. |
| Local impacts | Air, noise, traffic, construction disruption, land and habitat effects, and proposed monitoring. |
| Public value | Subsidies, forecast revenue, infrastructure and service costs, and durable local employment commitments. |
| Commitments | Whether mitigation and community benefits are measurable, independently verifiable, enforceable, and durable. |
Do not turn unlike evidence into a universal score. Record what is known, what remains uncertain, and which community priorities shape the judgment.
Which thresholds and rules are examples, not national standards?
Several current administrative examples can help residents understand the kinds of procedures to look for, but each applies only within its stated context.
- Massachusetts: Executive Order 658 applies specified permit conditions to covered data-center projects with peak electricity demand above 25 MW. The order is dated September 8, 2026.
- ERCOT, Texas: its 2026 request for information applies to covered data-center developers pursuing interconnection to the ERCOT System at 25 MW or more. The page lists October 12, 2026, as the submission deadline and says a report is intended on or before December 10, 2026. These dates describe that Texas process, not a general local approval calendar.
- Pennsylvania: GRID materials set expectations for projects seeking state support; they are not a nationwide project standard.
- Fairfax County, Virginia: its explanation of residents’ potential share of grid-upgrade costs describes local arrangements, not every utility’s rules.
Confirm whether each policy, deadline, or condition applies to the specific applicant, project, agency, and location before relying on it.
