Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Before sending money to a crypto presale, verify who is offering it, what the token gives you, how the sale works, and what evidence supports the project’s claims. Treat missing information as a risk to investigate—not as proof of fraud, but not as a reason to fill gaps with assumptions. A presale label, white paper, audit, or legal disclaimer does not establish that an offer is safe, compliant, or likely to make money.
Start by identifying the issuer
Write down the legal entity named as the seller, its jurisdiction, the people responsible for the project, and any stated affiliates or advisers. Then check those identities independently. A project website, social-media profile, certificate, or team biography is a claim to verify, not independent proof of who is behind the offer.

- Look for a legal entity name and a consistent account of who is issuing the tokens and receiving payment.
- Check whether named people and firms have a verifiable history relevant to the roles they claim.
- Compare information across sources rather than relying only on the project’s own channels.
- Record facts you could not verify as “not disclosed” or “unverified.” Do not silently treat them as established.
The U.S. Securities and Exchange Commission (SEC) advises investors to investigate the people and firms involved in a token offering and check relevant registration backgrounds. The Commodity Futures Trading Commission (CFTC) likewise identifies difficulty finding information about listed individuals or entities as a warning sign.
Translate the pitch into token rights and sale terms
Describe in plain language what a buyer receives. Is the token said to provide access to a product, a governance function, a claim, redemption rights, or something else? Distinguish rights promised by the sale documents from benefits described only in marketing. A token’s name or the word “utility” does not explain what the holder can actually do.

Read the sale terms, business plan, and white paper for specific answers to the questions below:
- What will the issuer do with the funds?
- What is the sale price, and does it change across phases?
- Is there a minimum fundraising goal or a maximum target, and what happens if the minimum is missed?
- When and how will tokens be delivered? Are there vesting, transfer, or resale restrictions?
- Are refunds, redemption, or other remedies available, and under what conditions?
- What trading access or liquidity does the issuer actually promise, if any?
Specific disclosure rules vary. For example, ESMA’s MiCA single-rulebook list concerns white papers for asset-referenced tokens and includes items such as offer size, sale phases, refund treatment, payment methods, transfer timing, rights, restrictions, risks, and audit outcomes where applicable. That is a scoped regulatory example, not a universal checklist or statement that every presale is governed by the same requirements.
Separate what exists from what is promised
Compare the claimed use case with the product or service that exists now. Mark shipped functionality separately from roadmap items. For each promised benefit, ask what must happen for the token to be useful, who must deliver it, what resources are committed, and what the offer says will happen if development is delayed or abandoned.

A promotional white paper is not automatically complete or reliable. The UK Financial Conduct Authority (FCA) warns that white papers may be incomplete or misleading. Cross-check their claims against sale terms, verifiable issuer information, project milestones, and technical documentation. The CFTC also notes that future demand, competition, technology changes, liquidity, adoption, and theft can affect a token’s value.
Inspect the code and audit evidence
Ask whether the relevant blockchain is public, whether the token or sale contract code is available, and whether an independent cybersecurity audit exists. The SEC’s Investor Bulletin on initial coin offerings recommends asking whether code is published and whether an independent audit has been performed. These are diligence questions—not a guarantee of security.
If an audit report is provided, check its date, the named contract and version, the scope of the review, reported findings, and exclusions. Compare the contract identified in the report with the address and code used for the sale. An “audited” label alone does not show that the current sale contract was reviewed, that every issue was fixed, or that the project is safe.

Check the legal context without relying on labels
Legal treatment depends on the specific facts and jurisdiction. Do not assume that calling a token a utility token, describing a project as decentralized, incorporating offshore, or adding a disclaimer settles its legal status.
For U.S. readers
The SEC’s April 22, 2026 educational overview describes an investment contract as involving an investment of money in a common enterprise, with a reasonable expectation of profits derived from the essential managerial efforts of others. It says a crypto asset offered with promises of managerial efforts may be subject to federal securities laws if the other elements are met. This is a U.S.-specific framework, not a rule to apply everywhere or a determination about an unnamed sale.
For UK readers
The FCA says initial coin offerings vary, can be high-risk and speculative, and whether a particular offer falls within its regulatory boundary can be determined only case by case. Its ICO guidance was originally published in 2017; check current FCA materials for developments before relying on it for a current legal question.

A project’s own claim that it is registered, exempt, or outside a regulator’s remit should be checked against relevant primary records. The official materials described here do not determine the status of any specific, unnamed presale.

The SEC’s May 29, 2024 investor alert describes promoters creating and touting a memecoin, sometimes through a so-called presale, to build demand and then selling before the hype ends. That example does not establish that every presale is a pump-and-dump; it does make independent verification important. The SEC staff alert is guidance, not a binding legal rule.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Be wary of guaranteed returns, pressure to act immediately, unsolicited pitches, and claims based only on social-media posts.
- Verify celebrity, government, company, and regulator endorsements through official channels; impersonation is a known scam tactic.
- Do not disclose private keys. The SEC warns that scammers may request them while pretending to recover assets.
- Do not pay unexpected extra “taxes,” withdrawal charges, or recovery fees to unlock funds or retrieve losses without independently verifying the demand.
The SEC advises: “Never make investment decisions based solely on information from social media platforms or apps.” The CFTC states: “There is no such thing as a guaranteed investment or trading strategy.” Its advisory also warns that buying tokens only in the hope of selling later at a higher price is speculation and carries considerable risk, regardless of how convincing a white paper or business plan sounds.

Compare offers using the same evidence standard
If you are comparing more than one offer, use the same rows for each. Record “verified,” “claimed only,” “not disclosed,” or “not applicable,” and keep the source and date beside each entry. This is a way to organize diligence, not a validated scoring model or a prediction of returns.
| Comparison row | What to record for each offer |
|---|---|
| Issuer and team | Legal entity, jurisdiction, named people and affiliates, and independently verifiable background. |
| Token and product | Rights, utility available now versus promised later, and how the product could create demand for the token. |
| Sale and funding | Price and phases, disclosed supply and allocation, fundraising targets, use of proceeds, and milestones. |
| Delivery and exit terms | Refund or redemption terms, vesting and transfer limits, delivery timing, resale access, and stated liquidity assumptions. |
| Technical evidence | Published contract code, audit identity, date, scope and findings, and whether audited code matches the sale contract. |
| Legal claims | Relevant jurisdictions, registration or exemption claims, and whether those claims can be checked in primary records. |
| Pressure and payment risks | Urgency, guaranteed-return language, reliance on social media, impersonation concerns, and unusual payment or withdrawal demands. |
Know when to pause
Pause rather than send funds if you cannot verify who is taking payment, cannot explain the token’s rights or the terms of delivery, or find that key claims depend on pressure, promises, or unverifiable endorsements. A missing answer is information about the offer’s transparency; it is not a gap to fill with optimism. If you need a legal conclusion, seek advice based on the actual offer and the jurisdiction that applies to you.
