How to Evaluate a Candidate’s Position on Cryptocurrency Regulation

Look beyond “pro-crypto” labels. Compare candidates’ specific proposals on agency authority, crypto classifications, registration, investor protection and implementation, using dated statements and public records.

To evaluate a candidate’s position on cryptocurrency regulation, look past labels such as “pro-crypto” and “anti-crypto.” Identify the laws, agency roles, investor protections and implementation steps the candidate actually supports, then verify those claims against statements and public records.

Start with what the candidate would change

Ask for a specific policy mechanism, not just a promise to support innovation or crack down on fraud. A useful answer might identify legislation, a rulemaking approach, an agency’s responsibilities, or requirements for a particular kind of crypto activity. If the candidate offers only a slogan, record the position as unclear rather than filling in the details yourself.

For a particular election, use the candidate’s own current statements and compare them with relevant legislation and official records. Record the date and source. Prefer a full interview, debate transcript, campaign policy page, bill text, recorded vote or official committee record over a short social-media excerpt or an advocacy group’s paraphrase. Keep direct quotations distinct from your own summary.

Compare candidates on the same policy questions

Use the same questions for every candidate. This makes differences easier to see and reduces the risk of treating a vague statement as a detailed plan.

Who should regulate each activity?

Ask which agencies should oversee exchanges, brokers, token issuers, derivatives and other crypto-related activities. Does the candidate want Congress to clarify or change agency mandates, or expect agencies to act under current law? The Congressional Research Service describes expanding SEC or CFTC authority and encouraging action under changed mandates as among the unsettled policy choices before Congress. Its overview is useful context, not a scorecard of any candidate’s views: CRS, Cryptocurrency: Selected Policy Issues.

How would assets and transactions be classified?

Ask what legal tests or definitions the candidate supports and how those tests would distinguish different assets and transactions. “Crypto” is not one legal category, and a token’s label alone does not settle how securities laws apply to a particular transaction.

On March 23, 2026, the SEC published an interpretive release addressing federal securities laws as they apply to certain crypto assets and transactions, with related CFTC guidance. The release discusses digital commodities, digital collectibles, digital tools, stablecoins and digital securities, as well as investment-contract analysis. It does not establish that every asset fits neatly into one category or resolve every regulatory question. Read the SEC release when assessing a claim about classification.

What registration and disclosure would be required?

Ask what platforms, intermediaries and issuers would have to register or disclose, and what practical route they would have to comply. A position that calls for registration is more informative when it explains who registers, with which agency and under what framework. A position against a requirement should likewise explain what safeguards, if any, would take its place.

The SEC Crypto Task Force lists clarifying how federal securities laws apply, distinguishing securities from non-securities, considering disclosure frameworks and registration paths, and helping investors make informed decisions among its priorities. Those topics provide concrete questions for comparing proposals: SEC Crypto Task Force.

How would the candidate protect investors and enforce the rules?

Ask what protections the candidate favors against fraud and market abuse, and how enforcement priorities should be set. Compare those protections with the candidate’s proposed compliance route: a position should be assessed as a whole, not reduced to whether it favors more or less regulation.

What does “innovation” or access mean in practice?

Ask what a workable path for responsible development and market participation would look like. Look for a description of the trade-offs or risks the candidate acknowledges alongside the benefits they expect. General support for innovation does not tell voters which activities would be permitted, under what rules or with what protections.

How would the plan be put into effect?

Look for concrete steps such as legislation, agency rulemaking, coordination between agencies or a stated implementation plan. Ask what evidence would show that the policy is working. Without a mechanism or an observable measure, a broad pledge may not be possible to evaluate after the election.

Build a comparison record, not an inferred score

A simple table can keep the comparison consistent. Link each entry to the underlying statement, bill, vote or official record. If you cannot find support for a position, write “not found” rather than inferring it from party membership or an unrelated vote.

Question Candidate A Candidate B
Regulatory authority Position and source link, or “not found” Position and source link, or “not found”
Asset and transaction classification Position and source link, or “not found” Position and source link, or “not found”
Registration and disclosure Position and source link, or “not found” Position and source link, or “not found”
Investor protection and enforcement Position and source link, or “not found” Position and source link, or “not found”
Innovation and access Position and source link, or “not found” Position and source link, or “not found”
Implementation and accountability Position and source link, or “not found” Position and source link, or “not found”

Keep the record dated. Crypto policy can shift through agency interpretations, congressional action and new candidate statements, so a position should be understood in the context of when it was expressed.

Use campaign-finance records as context, not proof

Federal campaign-finance filings can help voters understand fundraising context. The Federal Election Commission provides information on campaign receipts and disbursements and explains the records available: FEC, Introduction to campaign finance and elections.

A contribution or expenditure does not, by itself, prove why a candidate holds a position or what policy they would pursue. Before describing a transaction, check the filing, date, committee and transaction details. Contribution limits and reporting rules can change; consult current official information before quoting an amount. USAGov summarizes federal campaign-finance laws and identifies the FEC’s enforcement role: USAGov, Federal campaign finance laws.

Separate evidence from interpretation

When you summarize a candidate’s record, make clear which parts are the candidate’s words and which are your interpretation. A bill or vote can show a concrete action, but it does not automatically answer every question in the comparison. If a candidate has not addressed a topic, say so; do not convert silence into support or opposition.
