Before you report workplace misconduct, create a prompt, dated record of what happened, preserve relevant material you can lawfully access, and check your workplace’s reporting policy. Keep observations separate from assumptions, and do not delay urgent safety action or an external filing deadline to finish your notes. The right reporting route and legal rules depend on the conduct and your jurisdiction.
Start with a factual incident log
Make an entry as soon as reasonably possible after each incident, while details are fresh. A paper notebook or a private digital document can work; choose a method you can use promptly and keep secure. No particular form is required by the guidance cited here.

For each event, record:
- The date, approximate time, and location.
- The people involved and anyone who may have witnessed it.
- What you personally saw or heard, using concrete, neutral wording.
- Exact words in quotation marks only when you remember them accurately; otherwise identify the wording as a paraphrase.
- Whether each detail comes from your own observation, a message or document, or another person’s account.
- Uncertainty or missing details, rather than filling gaps with a guess.
Separate fact from interpretation. For example, note that a manager sent a message at a particular time and quote its relevant wording if available; keep your view of what it meant distinct from the message itself.
Track evidence and follow-up
Note where supporting material is
Identify relevant emails, messages, documents, or other records and where they are held. Note who may have relevant information. Do not alter originals or access or copy records you are not entitled to use. In particular, avoid secretly copying confidential business, customer, personnel, or coworker information without advice about your rights and any restrictions.
Keep a chronology of what happens next
Record whom you contacted, when you made a report or raised a concern, what you communicated, and any response or follow-up. If you later experience adverse treatment, document the dates and specific events in the same factual way; whether conduct amounts to unlawful retaliation depends on the applicable law and facts.
Keep your notes and any permitted copies private and secure. Consider who can access a digital file, whether your storage method complies with workplace rules, and whether a paper record can be kept somewhere private. Neither paper nor digital notes are inherently more credible.

Check the reporting route and recording rules
Look for your employer’s handbook, anti-harassment policy, grievance process, or named reporting contact. The appropriate channel may depend on the issue: a route for harassment or discrimination may differ from one for fraud or an immediate safety concern. In U.S. harassment matters, the EEOC advises workers to consult their employer’s policy and follow its reporting process; its guidance also describes reporting through workplace contacts. EEOC guidance on what to do if you believe you have been harassed at work.
Do not assume that secretly recording a conversation is permitted or useful. Recording laws, workplace rules, and whether a recording can be used as evidence vary. Acas cautions that workplace recordings might not be allowed as evidence and that covert recording in an investigation meeting may be treated as misconduct or a breach of trust. Report urgent risks without waiting for a complete log
If there is immediate danger, a threat, or an urgent safety risk, prioritize getting to safety and contacting the appropriate emergency or workplace safety channel. You can document details when it is safe to do so. There is no single reporting route established for every kind of misconduct, so consult the relevant workplace policy, regulator, union or worker representative, or a qualified local adviser as appropriate.
Understand confidentiality and retaliation limits
A fair investigation may require an employer to share relevant details with the person accused or with witnesses. Access may be limited to people who need to know, but a report is not necessarily confidential in the sense that no one else will learn its contents. In UK complaint-handling guidance, Acas describes recording complaints, evidence, actions, findings, and outcomes. Acas guidance on what happens after handling a complaint.

Legal protection against retaliation is tied to the relevant law and the nature of the activity; it should not be assumed to cover every report in every jurisdiction. The EEOC describes protection under U.S. EEO law for reporting harassment, opposing conduct prohibited by those laws, or participating in an investigation or lawsuit. EEOC questions and answers on retaliation.
Check deadlines separately from workplace reporting
Workplace documentation and an internal complaint do not necessarily satisfy an external filing requirement or pause a deadline. For U.S. EEO harassment charges, the EEOC says the filing period is generally 180 or 300 days, depending on where the person works; federal employees and applicants follow different procedures and time limits. These are U.S.-specific rules for EEO matters, not general deadlines for all workplace concerns. EEOC guidance on employer liability for unlawful harassment.
UK Acas guidance and U.S. EEOC guidance describe different systems; neither should be treated as a universal procedure. If you may have a legal claim or a deadline, promptly check the relevant official body or consult a qualified local employment adviser rather than waiting until your incident log is complete.
