Maintain it by identifying each item clearly, recording every handler and movement, controlling access, and using packaging suited to the evidence. The exact forms and procedures depend on the evidence, agency policy, receiving laboratory, and applicable law.
What a chain-of-custody record needs to establish
NIST defines chain of custody as tracking evidence as it is collected, safeguarded, and analyzed, while documenting each handler, the date and time of collection or transfer, and the purpose of the transfer. In practice, the record should make it possible to follow the item’s history, locations, handling, control, and disposition in chronological order. It should also cover evidence derived from a primary sample. NIST’s glossary definition and its biological evidence preservation handbook describe these principles.

Information to capture
- A unique case or item identifier and a clear description of the evidence.
- Who collected it, when and where it was collected, and its condition or notable marks.
- Its packaging, seal condition, and preservation method where relevant.
- Each custodian, the dates and times they received or released it, the locations involved, and the reason for the movement or access.
- Storage locations, examinations or other actions performed, and any repackaging or change in seal.
- Final disposition, recorded according to the applicable procedure.
Use the form or system required by the agency and case. Paper, electronic, or combined records can work; the essential requirement is a complete, retrievable history of custody and transfers. Retention periods and required fields are not universal and depend on applicable case rules and law.
How to maintain chain of custody from collection onward
At the scene
Record the recovery location, date and time, item description, condition, and unusual marks in scene notes. Identify the item and collector on its label and custody record, and document where it was found. Choose packaging and a preservation method appropriate to the evidence, then mark and seal it as required by current agency and laboratory procedures. At every handoff
Record and acknowledge each transfer rather than relying on a later summary. A signed paper record or secure electronic acknowledgment should identify the outgoing and incoming custodians, the date and time, the location, and the transfer purpose. Obtain a receipt when submitting evidence to a property or evidence section or a laboratory. Limit the number of handlers where practicable, and keep the record and storage entry current.
- Verify the item identifier and inspect the package and seal condition.
- Record outgoing and incoming custodian names or required identifiers, date and time, location, and purpose.
- Note any seal condition, damage, discrepancy, or other relevant observation; do not silently correct or obscure it.
- Obtain a signed receipt or secure electronic acknowledgment.
- Update the storage or case-management record so the item’s current location and custodian are traceable.
This is an operational checklist synthesized from NIJ and NIST guidance, not a mandatory universal form. NIJ’s typical chain-of-custody checklist also stresses recording field location, preservation, custodians, labels, and receipts.

During storage and analysis
Keep evidence in a controlled, secure location when it is not being transferred, and restrict access under agency procedure. Record authorized handling, examinations, and any movement between storage areas. If opening or repackaging is necessary, document who did it, when and why, the package and seal condition beforehand, and how the item was resealed or otherwise secured. The goal is a record that explains the item’s history rather than merely listing transfers.

Choose packaging and seals for the evidence
Packaging helps preserve physical condition and evidentiary value, but no single container is suitable for every item. The material, contamination risk, degradation risk, transport and storage conditions, and planned analysis all matter. NIST’s trace-evidence collection guide emphasizes suitable containers, separation of known and questioned items, and measures to avoid cross-contamination, including changing gloves between items.

- Use packaging compatible with the evidence and its preservation needs; follow the receiving laboratory’s submission instructions.
- Separate items when needed to reduce cross-contamination, particularly known and questioned materials.
- Mark packages so the item and case identifiers remain clear and associated with the record.
- Apply seals and document them according to the applicable procedure; record a seal’s condition when custody changes.
Tamper-evident bags and seals can help indicate whether a package has been opened or altered, but they do not replace custody records or controlled access. For example, the UK Home Office’s version 9.0 procedure, published September 18, 2025, describes bags that combine a bag, seal, and label, use barcodes, and have unique reference numbers to record. Those instructions apply to specified UK investigators; they are not a universal packaging rule. See the UK Home Office procedure.
Additional integrity steps for digital evidence
For digital evidence, document the original source and how the image or file was created or transferred to the investigative organization. NIST’s Digital Evidence Preservation: Considerations for Evidence Handlers recommends hashing digital images and other objects with a NIST-approved hashing algorithm and storing the resulting hashes separately from the image or file in a secure location.

A hash is an integrity control, not a complete custody history or proof of every aspect of authenticity. Keep recording who handled the item or file, when and why it moved, where it was stored, and what was done to it. Preserve the original source and document transfers and processing under the relevant forensic and agency procedures.
Choose a record system that preserves a usable history
Paper, electronic, and combined systems are all possible. Select and operate a system based on whether it supports complete, traceable events—not simply whether it is digital. Check whether it captures item identity, handlers, transfer purpose, date and time, condition, and location; restricts and records access; supports acknowledgments and receipts; and allows reliable audit and retrieval. It must also meet agency policy and applicable law.

NIST’s December 16, 2025 report announcement describes variation among law-enforcement evidence rooms and recommends standardized classification for packaging, storage, and management, a quality management system with routine audits, and technological tools to track performance indicators and improve procedures. These are organizational recommendations, not a claim that one system fits every agency. Read NIST’s report announcement.
Apply the right procedure to the jurisdiction and evidence type
These practices synthesize U.S. NIST and NIJ guidance, with a UK Home Office example explicitly identified above. They are general operational principles, not a jurisdiction-specific legal checklist or a guarantee of admissibility. Requirements for collection, packaging, access, transfer, retention, and disposition can vary with the item, case, receiving laboratory, agency procedure, and local, state, or federal law. Follow current agency and laboratory instructions for the evidence you handle.
