If your restaurant bill looks wrong, point out the specific line before you authorize payment, ask staff to explain or correct it, and check the revised total. You do not need to treat one disputed charge as a reason to reject the entire bill. Keep the itemized check and final receipt in case you need to follow up.
How do I dispute an incorrect restaurant bill before I pay?
- Review the itemized check. Check the listed items and arithmetic. Look for something you did not order, a duplicate, a price that differs from the menu or another displayed price, an unexpected fee, or a tip or service-charge calculation that seems incorrect.
- Identify the exact line and amount. Be specific and calm. For example: “Could you help me check this line? I don’t think we ordered it,” or “The menu showed a different price; could you confirm which price applies?”
- Ask for an explanation or corrected check. Give the server a chance to explain the charge or provide a corrected itemized bill. If they cannot resolve it, politely ask to speak with a manager.
- Check the revised total before paying. Confirm the disputed item or calculation has been addressed and that the new total reflects the correction before authorizing payment.
- Keep your records. Retain the check and final receipt, plus any relevant menu or posted price information. If the restaurant does not resolve the concern, make a brief note of the charge you disputed and the response you received.
These are practical steps, not a statutory script. If you choose to pay to finish the visit, keeping your records lets you address a later billing problem; paying does not by itself establish that every possible right has been waived, nor does it guarantee a later dispute will succeed.

What if a wrong amount posts to my credit card?
For a U.S. credit-card billing error, contact the card issuer promptly and follow its instructions for a written billing dispute. The FTC identifies errors such as an incorrect date or amount, a duplicate charge, or a charge for something not accepted or not delivered as agreed. Its credit-card billing guidance recommends sending written notice to the address the issuer designates for billing inquiries or errors.

Act quickly: the FTC says written notice should reach the issuer within 60 days after the first statement with the error was sent. The CFPB’s credit-card dispute guidance, last reviewed April 15, 2024, says written notice must be sent within 60 calendar days after the charge appeared on the statement to protect your rights. Because the agencies describe the trigger differently, do not wait to resolve that difference: contact the issuer immediately and use its stated procedure.
For a qualifying billing-error dispute under the applicable process, FTC guidance says you may withhold the disputed amount and related finance charges while the issuer investigates, but you must pay the undisputed part of the balance. Whether the process covers your issue depends on the circumstances. The CFPB notes that a different process may apply to complaints about defective goods or services.

Do restaurant fees have to be disclosed?
The FTC’s fee FAQ says that when consumers add optional fees, a business must clearly and conspicuously disclose them and include them in the final amount before asking the consumer to pay. That guidance has a defined scope; it does not establish that every unexpected restaurant fee is unlawful. The rules may depend on the fee and applicable state or local law, so ask the restaurant what the charge covers and consult the relevant local consumer-protection authority if needed.
Does the same dispute process apply to every payment method?
No. The federal guidance above is specifically about U.S. credit-card billing errors. Do not assume its deadlines or protections automatically apply to debit cards, cash, payment apps, gift cards, other countries, or every complaint about service quality. For a posted charge made another way, contact the payment provider promptly and check the consumer-protection rules where the transaction occurred.
