The safest comparison is not “U.S. versus non-U.S.” A provider’s headquarters and your chosen storage region answer different questions. Start by identifying the laws that govern your organization and data, then map every service data flow, confirm the transfer mechanism, and test the provider’s contractual, technical and operational controls. A European region, a local subsidiary or a compliance certificate can help, but none is a blanket finding that your workload is compliant.
This guide gives a practical method for buyers, using the EU/EEA-to-U.S. transfer situation as a worked example. Exact obligations depend on your country, sector, data categories, services, contracting entity and current law. Have privacy counsel and security staff validate the final decision.

Why “U.S.” and “non-U.S.” are incomplete labels
Cloud compliance has at least two separate geography questions:
The Tool Desk
Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →- Where is data stored and processed? This includes primary content, replicas, backups, logs, telemetry, metadata and temporary files.
- Which legal entities and jurisdictions control the service? Incorporation, ownership, possession, custody, control and operational access can matter even when content remains in a local region.
A non-U.S. provider can use U.S. subprocessors or support staff. A U.S.-incorporated provider can offer a region, encryption design and contract that satisfy a particular use case. Neither label proves the result. The relevant comparison is the exact provider entity, product, configuration, region and data set.

Define the workload before comparing providers
Classify the data and purpose
List the data categories and what the service does with them. Separate personal data, health or financial records, confidential business information, credentials, source code, public information and regulated records. Record the purpose, retention period, users, countries of affected people and whether the provider acts as a processor, controller or another role under the applicable law.
Classification determines which rules and safeguards matter. A public website asset and an employee medical record should not receive the same residency, access or deletion assumptions.
Map every processing path
Draw a data-flow map for each candidate service. Include the control plane as well as the workload plane, because a service may store content in one place while identity, billing, support, monitoring or administration operates elsewhere.

| Flow to document | Questions to answer |
|---|---|
| Primary content | Which region stores and processes the database, objects, messages or files? Is the setting customer-selectable? |
| Replication and backup | Are replicas, snapshots and disaster-recovery copies confined to the selected geography? Can the provider move them during an outage? |
| Metadata and telemetry | Where are account records, usage logs, diagnostics, identifiers and service-generated metadata held? |
| Support and administration | Which staff or teams can view, troubleshoot or export data, from which countries, and under what approval and logging controls? |
| Subprocessors | Which entities receive data for payment, communications, security, analytics or other functions? How are changes notified? |
| Service-specific transfers | Does the provider disclose exceptions for service improvement, essential functions or features that do not follow the selected region? |
Identify the governing law and transfer mechanism
Start with the exporter, importer and data
Ask which law governs the organization’s processing, not merely where the server sits. For an EU or EEA organization, a transfer occurs when personal data is made available to an organization outside the EEA or otherwise leaves the protected area. The analysis must identify the exporter, the importing provider entity, the specific service and the categories of data involved.
The European Commission describes several transfer tools, including adequacy decisions, standard contractual clauses (SCCs), binding corporate rules, approved certification mechanisms, codes of conduct and limited derogations. An adequacy decision allows covered flows to a recognized destination under that decision without adding a separate transfer safeguard for the destination itself; the exporter still has its other GDPR duties.
Understand the EU–U.S. example
The Commission’s current adequacy list includes U.S. commercial organizations participating in the EU–U.S. Data Privacy Framework (DPF). The Commission adopted that adequacy decision on July 10, 2023 and says personal data can flow from the EU to participating U.S. companies. This is conditional coverage: verify that the particular provider entity and relevant activity are listed and within scope.
The DPF does not replace purpose limitation, transparency, security, processor terms, retention controls, onward-transfer analysis or the customer’s accountability. The Commission periodically reviews adequacy decisions, so treat the status as a point-in-time fact rather than a permanent guarantee. A joint Commission and U.S. Department of Commerce statement reported more than 2,800 participating enterprises by July 2024, with 70% identified as small and medium-sized businesses. That dated enrollment figure says nothing about a particular cloud workload.

When SCCs or another tool is needed
If the DPF does not cover the importer or activity, determine whether SCCs or another lawful mechanism applies. Read the transfer assessment, the parties’ roles, technical safeguards, onward transfers and any supplementary measures. A provider may publish a standard DPA and SCC package, but you remain responsible for confirming that it covers the service, entity, region and processing you will actually use.
Test residency claims against the actual service
A selectable region is useful only if the contract and technical behavior match the claim. Ask the provider to identify what “customer data” includes and what is excluded. Check whether the commitment covers:
- production content and user-submitted data;
- backups, snapshots, replicas and disaster-recovery copies;
- control-plane records, identity data and billing information;
- logs, diagnostics, telemetry and abuse-prevention signals;
- support tickets, screen-sharing sessions and troubleshooting exports;
- encryption keys and key-management metadata; and
- subprocessor handling and emergency operations.
AWS states that customers can choose European Regions and that customer data stays in the selected AWS Region, while also disclosing that a small number of services involve transfers and that exceptions can apply for service improvement or essential service functions. Treat that as a provider statement to verify against the exact service documentation, settings, contract and current subprocessor list—not as a universal property of every service.
Ask for a written list of services that do not support the desired residency boundary. Confirm whether failover, support access or a new feature can move data outside it, and whether you can disable that behavior.
Separate storage location from provider jurisdiction
Physical location and legal control are distinct comparison axes. The EDPB–EDPS joint assessment of the U.S. CLOUD Act explains that certain U.S. law-enforcement requests can reach provider-held records within the provider’s possession, custody or control regardless of where those records are stored. The assessment also discusses procedures to challenge or modify some warrants under limited conditions.
That 2019 initial assessment does not establish the result for every provider structure or later legal development. It describes targeted requests and procedural safeguards, not automatic, systematic or indiscriminate access. It also identifies unresolved questions about “control” and cross-border application. Use it to frame due-diligence questions, then obtain current legal advice for your entities and data.
For each candidate, document:
- the contracting and operating entities;
- which entity has possession, custody or control of the relevant data;
- where administrators and support personnel can access the service;
- what encryption and key arrangements prevent provider-readable content; and
- what notice, challenge, transparency and government-request commitments are contractual.
A locally incorporated provider is not automatically isolated, and a local region from a foreign provider is not automatically exposed. Verify ownership, subprocessors, technical isolation and the service’s legal terms instead of relying on branding.

Evaluate operational access and cryptographic control
Access pathways
Request the provider’s privileged-access model. Look for just-in-time access, named administrators, approval workflows, session recording, immutable audit logs, separation of duties and emergency-access procedures. Determine whether support can access plaintext, whether access requires your approval, and how quickly you receive notice of a government or security request.
Keys and encryption
Encryption at rest and in transit is only one part of the analysis. Establish who generates, stores, rotates and can use the keys. Customer-controlled or externally held keys may reduce provider access, but only if the service remains functional when the key is withheld and the configuration covers backups, logs and replicas. Confirm recovery procedures, key-destruction evidence and the effect of losing a key on portability and incident response.
Auditability
Require access logs that identify the person, service, purpose, time and action. Verify retention, export and independent review of those logs. A control that exists only in a marketing description is weaker evidence than a current audit report, testable configuration and contractual remedy.
Read the contract, not only the compliance page
Obtain the current agreement, DPA, transfer clauses, service-specific terms and subprocessor list for the exact SKU. Compare these items side by side:
| Contract area | Evidence to request | Decision question |
|---|---|---|
| Named entities | Order form, DPA and service terms | Which entity is your processor or subprocessor, and where is it established? |
| Scope | Region and service annexes | Do commitments cover the purchased product, edition and support plan? |
| Transfers | SCCs, DPF statement or other mechanism | Does the mechanism cover this exporter, importer, data and onward transfer? |
| Subprocessors | Current list and change procedure | Can a new entity or country be added without meaningful objection or exit rights? |
| Government requests | Notice, challenge and disclosure clauses | Will the provider notify you where legally permitted and seek to narrow overbroad demands? |
| Security | Technical and organizational measures | Are access, encryption, logging, incident and deletion controls specific enough to verify? |
| Portability and exit | Export format, assistance and deletion certificate | Can you retrieve data, revoke access and prove deletion without unreasonable delay or cost? |
AWS publishes DPA, SCC and government-request information, including commitments to challenge overbroad requests where appropriate. Google publishes transfer terms and states that Google LLC certified to the EU–U.S. DPF for EU/EEA transfers to and onward transfers from the U.S. as of September 1, 2023. Google’s terms also describe different positions for UK, Swiss and other transfers. These are provider-specific statements; confirm their application to the purchased product and contracting entity.

Interpret certifications and audit reports correctly
Ask for the report, scope, period and exceptions—not just a badge. Check whether the independent assessment covers the exact service, region, infrastructure, support process and subprocessor arrangement. A report may cover a control environment while excluding a newly launched feature or a customer-configured setting.
Certifications and attestations are evidence about defined provider controls. They do not formally certify that your organization complies with the law. Google explicitly says providers cannot certify customer compliance. AWS likewise tells customers to evaluate the laws relevant to their processing and use. Your risk assessment must connect the provider’s controls to your purposes, data categories and legal duties.

Use a consistent comparison worksheet
Score candidates only after collecting comparable evidence. A simple worksheet can use columns for “documented,” “contractual,” “technically configurable,” “independently tested,” “customer responsibility” and “open issue.” Record the document title, version date, service SKU and contracting entity for every answer.
| Comparison axis | Buyer questions |
|---|---|
| Governing law | Which privacy, security, residency, sector, public-records and procurement rules apply? |
| Data flows | Where are content, metadata, backups, logs, support data and subprocessor transfers handled? |
| Transfer basis | Which mechanism covers the specific exporter, importer, service and data? |
| Jurisdiction and control | Which entity controls the service, and what request and challenge procedures apply? |
| Residency controls | Can geography be pinned, and do control plane, support, telemetry, backups and keys follow it? |
| Security assurance | Which current audits, certifications, access logs, key controls and incident commitments apply? |
| Operational fit | Can the service meet resilience, latency, support, migration, egress, portability and exit requirements? |
Do not create a false “most compliant” ranking when evidence is not comparable. Official sources do not establish a general statistic showing that U.S. providers or non-U.S. providers have better compliance, residency quality or government-access risk.

- Classify the workload. Record data subjects, categories, purpose, retention, countries and regulated obligations.
- Map processing. Trace storage, computation, replication, backup, metadata, support, telemetry, subprocessors and administrator access.
- Identify laws and transfer routes. Determine whether data leaves the relevant jurisdiction and select the applicable adequacy decision, SCCs or other mechanism.
- Collect current evidence. Obtain the DPA, service terms, region commitments, subprocessor list, transfer language, audit reports and government-request process.
- Test controls with technical staff. Verify region settings, failover behavior, key custody, privileged access, logging, export and deletion in a non-production account.
- Document residual risk and approval. Assign each unresolved issue to legal, security, procurement or the business owner, set compensating controls and record the exit plan.
Recheck the assessment at material service changes, new subprocessors, changed regions, legal developments, incidents and contract renewals. A cloud decision is a living control, not a one-time location choice.
Common failure modes and fixes
“The data is in Europe, so there is no transfer.”
Why it fails: support, telemetry, identity, backups or a service exception may involve another country.
Fix: obtain a service-level data-flow statement and test the configuration, including disaster recovery.
“The provider is European, so government access is impossible.”
Why it fails: ownership, subprocessors, personnel and legal control may span jurisdictions.
Free tools Windows power users keep installed
One-click scans. No signup required.
Fix: identify the controlling entities, custody pathways, access controls and request procedures.
Best Value
“A DPF or SCC makes the whole workload compliant.”
Why it fails: transfer mechanisms address a defined route; they do not replace lawful purpose, transparency, security, minimization or processor governance.
Fix: document the mechanism and complete the wider privacy and security assessment.
“A certification transfers our responsibility.”
Why it fails: attestations cover provider controls and stated scope, not your configuration or legal duties.
Fix: map each provider control to your control owner and retain evidence of your settings and decisions.
“A region selector is a contractual guarantee.”
Why it fails: the interface may not cover every service component or future operational exception.
Fix: require written scope, exclusions, notification rights and an exit path if the boundary changes.
Applying the method to an EU organization considering a U.S. provider
Suppose an EEA organization wants to place customer records in a European region of a U.S.-incorporated cloud service. The team should first classify the records and identify its GDPR roles. It should then map primary storage, backups, logs, support and subprocessors. Next, it should verify whether the importing provider entity and activity participate in the DPF; if not, it should evaluate SCCs or another mechanism and document the transfer assessment.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteThe team should separately review the provider’s legal-control exposure, administrator access, encryption keys and government-request commitments. It should confirm that the chosen service—not merely the provider’s broader platform—supports the required residency boundary. Finally, it should test export, deletion, failover and key revocation, approve residual risks and schedule a reassessment. The outcome may be acceptable, unacceptable or acceptable only with additional controls; the provider’s nationality alone cannot decide it.
What to record in the final decision
Your file should let an auditor, regulator or replacement team reconstruct the decision. Keep:
- the data inventory and processing purpose;
- the current architecture and data-flow diagram;
- the legal analysis and chosen transfer mechanism;
- the named provider entity, service SKU and regions;
- the DPA, terms, subprocessor list and government-request clauses;
- audit reports, certifications and exceptions in scope;
- tested settings for residency, keys, access, logging, backup and deletion;
- customer responsibilities, compensating controls and residual risks; and
- review triggers, renewal dates, portability tests and exit assistance terms.
Refresh Commission adequacy status, provider terms, service-region details, subprocessors, compliance reports and relevant local law before purchase and whenever the service changes. The EU–U.S. framework, provider commitments and legal interpretations can evolve, while the 2019 CLOUD Act assessment is not a current opinion on every later development.
