How to Communicate a Union Organizing Campaign Clearly at Work

Learn how to explain a workplace union campaign clearly, respect coworkers’ choices, follow time-and-place rules, communicate online safely, and document possible interference.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Explain the campaign in plain language: identify the shared workplace issue, describe the collective process being proposed, state the next voluntary step, and show coworkers where they can ask questions. Keep facts, proposals, and uncertainties separate. Use non-work time for solicitation, respect neutral workplace rules, and never imply that everyone must support, sign, attend, or disclose a view.

Most private-sector employees covered by the National Labor Relations Act (NLRA) have a right to organize and a right to refrain. Public-sector workers, supervisors, and employees in some industries may be covered by different rules. The guidance below is general information, not a legal determination about a particular workplace.

Start with a message coworkers can understand in one minute

A clear campaign explanation answers four questions in order:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. What shared issue are workers addressing? Use a concrete description such as unpredictable scheduling, safety concerns, or inconsistent policies. Do not invent a grievance or present one person’s complaint as a group position.
  2. What collective process is being proposed? Explain that coworkers are considering acting together through a union and negotiating as a group. A union can provide a process for collective bargaining; it cannot guarantee a particular wage, benefit, schedule, or contract result.
  3. What happens next? Give one practical, voluntary action: ask a question, talk with an organizing-committee member, attend an information meeting on personal time, or review a fact sheet.
  4. Where can people verify information? Name a consistent place for updates and identify reliable sources, including National Labor Relations Board (NLRB) guidance for questions about federal rights.

Use short sentences and ordinary terms. Say what is known, what is being proposed, and what has not been decided. A message that acknowledges uncertainty is more credible than one that promises an outcome.

A 60-second example

“Several of us are talking about how scheduling changes and safety concerns affect the whole team. We are exploring whether to organize so employees can address these issues collectively and negotiate with management. Nothing about pay or benefits is guaranteed; those issues would be part of a bargaining process. If you want to learn more, you can ask questions privately or join an information discussion during non-work time. Participation is your choice.”

Know the legal setting before choosing words or channels

The NLRB says, “You have the right to form, join or assist a union.” Federal law also protects declining to participate in organizing or concerted activity and campaigning against a union. Those rights generally apply to covered private-sector employees, not automatically to every worker or workplace.

  • Coverage varies. Public-sector employees and workers in certain industries may be governed by other federal, state, or local regimes. Supervisors and managers can have different status under the NLRA.
  • Rules are fact-specific. A short description cannot establish whether conduct is protected or unlawful. For an individual question, contact the NLRB or a qualified labor lawyer.
  • Voluntary participation matters. Your message should leave room for questions, disagreement, and choosing not to participate.

Official NLRB employee guidance, accessed October 13, 2026, states: “Working time is for work, so your employer may maintain and enforce non-discriminatory rules limiting solicitation and distribution.” The same guidance distinguishes working time from non-work time and explains where discussion and literature distribution may occur.

Match the activity to time, place, and ownership

Before handing out a flyer, starting a conversation, or posting online, check five factors: whether the time is work or non-work time; whether the location is a work or non-work area; whether the channel belongs to the employer; whether a restriction is applied evenly to comparable communications; and whether your wording preserves each coworker’s choice.

Activity General NLRB distinction Practical approach
Talking with coworkers Employers may enforce neutral limits on solicitation during working time. They generally may not prohibit union discussion or solicitation during non-work time, such as breaks, before work, or after work. Hold organizing conversations during breaks or before/after shifts, and move to an approved non-work area when possible.
Distributing literature Non-work-time distribution is generally allowed in non-work areas, including break rooms and parking lots, subject to neutral rules. Check whether a rule covers all distributions, then distribute only on non-work time in a non-work area.
Employer bulletin boards, email, phones, or devices An employer may restrict use of employer-owned communication media if it does not discriminate against union-related or other protected communications. Do not assume a company system is private or available for campaign use. Use personal devices and accounts where lawful and practical.
Social media Group discussion of work-related issues may be protected concerted activity. A purely individual gripe unrelated to group action may not be. Connect posts to shared workplace concerns, avoid personal attacks, and do not disclose confidential information.

A rule that singles out union communication while allowing comparable non-work discussion can raise a different issue from a genuinely neutral rule. Do not assume either that every technology restriction is valid or that every union-related message is protected.

Build the campaign explanation in layers

1. Describe the shared concern, not a guaranteed remedy

Start with observable effects: “Schedules are changed with little notice,” “Employees lack a consistent way to report hazards,” or “Policies are applied differently across shifts.” If the issue is based on a survey or group discussion, say so and explain how coworkers can review the information. Avoid exaggeration, rumors, and claims that organizing automatically produces a specific result.

2. Explain what organizing changes

Describe the proposed collective process: employees discuss priorities, decide whether to seek union representation, and, if representation is established, bargain with the employer. Separate that process from campaign promises. A union does not itself set a guaranteed wage or benefit; bargaining outcomes depend on negotiations and the resulting agreement.

3. State what remains open

Use explicit labels such as “current fact,” “proposal,” and “question.” For example: “The current schedule policy is posted here” (fact); “We propose predictable notice” (proposal); “We do not yet know what management would agree to” (uncertainty). This prevents a tentative goal from being mistaken for a settled result.

  • What You Get: Anker USB-C Hub (7-in-1), welcome guide, 18-month warranty, and our friendly customer service.

4. Give one next step and one way to decline

Offer a low-pressure action: “Ask me questions,” “Read the fact sheet,” or “Join the next discussion on your own time.” Add, “You do not have to participate or tell anyone how you feel.” The NLRB recognizes both organizing rights and the right to refrain, so voluntary language is a legal and ethical safeguard.

Use a repeatable conversation method

  1. Ask permission. “Is now a non-work time when we can talk for a minute?” If the answer is no, stop and arrange another lawful time.
  2. Lead with the shared issue. Use one specific example and explain why it affects more than one person.
  3. Describe the process. Explain that coworkers are considering collective action and what the next decision point is.
  4. Invite the person’s priorities. Ask, “What workplace issue would you want addressed?” Listen without arguing.
  5. Correct misinformation carefully. Say what is verified, identify what is uncertain, and point to a reliable source.
  6. Offer a follow-up. Provide a personal contact method or meeting information that does not require disclosure of a position.
  7. Respect the answer. Do not repeatedly pressure someone who declines.

Questions that improve clarity

  • “Which issue affects your shift most?”
  • “What information would you need before deciding whether to participate?”
  • “Would a translated or large-print version help?”
  • “Would you rather receive updates privately or not receive them?”

Flyers, handouts, and meetings

What a useful handout contains

  • A plain-language description of the shared concern.
  • A short explanation of the proposed collective process.
  • Clear separation of facts, proposals, and unanswered questions.
  • The date, time, and location of the next voluntary information opportunity.
  • A way to ask questions without publicly identifying a position.
  • A statement that employees may participate, refrain, or campaign against a union.
  • Language access, readable type, and alternatives for workers who cannot use the primary format.

Keep the document current. Date each version, identify the person or committee responsible for updates, and remove superseded claims rather than letting contradictory copies circulate.

Where and when to distribute

Distribute literature during non-work time in non-work areas, such as a break room or parking lot, while following neutral workplace rules. Do not interrupt active work or block entrances. If a supervisor challenges the activity, avoid an argument; note the exact instruction, the time, the location, and whether comparable distributions are treated the same way.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How to run an information meeting

  1. Announce that attendance is voluntary and schedule the meeting outside working time unless an authorized policy permits otherwise.
  2. Begin with the shared issue and the meeting’s purpose.
  3. Present verified facts before proposals or opinions.
  4. Reserve time for questions, including disagreement.
  5. Record open questions and assign someone to verify answers rather than guessing.
  6. End with the next optional step and a way to receive or decline future updates.

Digital communication without avoidable risk

The NLRB states that employees may band together online to address work-related issues and that social-media discussion can be protected concerted activity. A post that is only an individual gripe, with no connection to group action, may not qualify. Make the collective connection clear: identify the shared workplace issue, invite coworkers to discuss it, and describe the action being considered.

Safer practices for posts and group chats

  • Use personal accounts and devices when possible, and review the platform’s privacy settings.
  • Do not post confidential customer, patient, personnel, trade-secret, or security information.
  • Describe events accurately; preserve screenshots of relevant messages.
  • Distinguish “we are asking for” from “the employer agreed to.”
  • Moderate harassment and threats. Strong disagreement is not a reason to expose someone’s private information.
  • Assume that content may be copied or forwarded even when a group is labeled private.

Employer-owned email, messaging platforms, telephones, bulletin boards, and digital devices may be subject to neutral restrictions. A general technology policy does not automatically answer every case; compare how the employer treats other protected or non-work communications.

Respond to common coworker questions

“Does supporting this guarantee a raise or a better schedule?”

No. Organizing creates a collective process for addressing priorities and bargaining. It does not guarantee a particular wage, benefit, schedule, or contract term.

“Do I have to sign, attend, or tell you how I will vote?”

No one should be pressured to participate or disclose a view. Explain the available information and let the person decide.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Can management stop us from talking?”

Working-time solicitation and distribution may be limited by neutral rules. Non-work-time discussion and solicitation generally cannot be prohibited merely because they concern a union, and literature distribution during non-work time in non-work areas is generally protected under NLRB guidance. Employer-owned communication systems can have separate, neutral restrictions.

“Can I post about this online?”

Group discussion of work-related concerns may be protected concerted activity, while an isolated personal gripe may not be. Keep posts accurate, collective in focus, and free of confidential information.

“What if I disagree with the campaign?”

Say that disagreement and campaigning against a union are protected choices for covered employees. Do not retaliate, ostracize, or demand an explanation.

Recognize coercion and retaliation

NLRB guidance identifies threats, coercive questioning, spying or creating the impression of surveillance, and punishment for protected organizing as improper employer conduct. The Department of Labor WORK Center lists examples such as firing, demotion, transfer, reduced pay or hours, reduced benefits, and making work more difficult because of pro-union views.

Do not label a management action unlawful based on a brief description. Instead, preserve evidence:

  • Keep copies of schedules, policy notices, messages, and disciplinary documents.
  • Write a dated, factual account of who said or did what, where, and who witnessed it.
  • Save original digital messages and note when they were received.
  • Do not secretly record conversations unless you know the recording law that applies.
  • Avoid altering documents or encouraging witnesses to coordinate stories.

Workers who believe their rights were interfered with can contact the NLRB. The agency says unfair-labor-practice charges can be filed without cost and advises contacting it promptly. Its general guidance states that charges generally should be brought within six months, but deadlines and legal theories are fact-sensitive; verify the current instructions with the agency before relying on that period.

Use communication frames as a planning checklist, not a formula

A 2025 preprint by Arianna Pera, Veronica Jude, Ceren Budak, and Luca Maria Aiello examined 158,238 Facebook posts from U.S. labor unions published from January 2015 through December 2024; 157,883 posts contained text. It categorized messages as:

  • Diagnostic: identifying a workplace problem.
  • Prognostic: proposing a solution or course of action.
  • Motivational: encouraging people to act.
  • Community: expressing solidarity and shared identity.
  • Engagement: inviting interaction.

The authors reported that diagnostic and community frames were common overall. In election cases unions won, pre-election communication showed increased diagnostic, prognostic, and community framing; patterns differed in lost cases. This is an observational study of communication patterns, not evidence that any frame causes an election win. Use the categories to check whether your message explains the problem, the proposed process, the human stakes, and the next voluntary action—never as a guaranteed recipe.

A practical campaign communication workflow

  1. Map the audience. Note languages, shifts, locations, accessibility needs, and preferred private contact methods.
  2. Agree on factual basics. Create a one-page source sheet for policies, dates, and verified answers.
  3. Draft a core message. Keep the shared issue, process, uncertainty, and next step consistent across formats.
  4. Adapt by channel. Prepare a spoken version, a handout, and a digital version without changing the substance.
  5. Check time and place. Confirm that each activity occurs during non-work time when required and in an allowed area.
  6. Review neutrality and privacy. Remove pressure, personal data, unsupported promises, and confidential information.
  7. Log questions. Assign a person to verify unanswered questions and publish corrections promptly.
  8. Monitor treatment. Record any new rule, warning, schedule change, or questioning that appears connected to organizing, without declaring a legal violation.

Final pre-send checklist

  • Does the first sentence name a concrete shared concern?
  • Does the message explain the collective process without promising a result?
  • Are facts, proposals, and uncertainties clearly labeled?
  • Is the next action specific, optional, and scheduled at a lawful time?
  • Can a coworker ask questions or decline updates without embarrassment?
  • Does the format work for the workforce’s languages and accessibility needs?
  • Is the channel personal or employer-owned, and have neutral policies been checked?
  • Have you removed confidential information, personal attacks, and unverified claims?
  • Do you know how to preserve records and contact the NLRB if interference is suspected?
