AI-agent income is not identified in the official materials discussed here as a separate Indian tax category. The classification depends on what you received and what transaction took place. A fee for AI services and income from transferring a qualifying virtual digital asset (VDA) raise different tax questions; being paid in crypto does not, by itself, make a service fee income from a VDA transfer.
Start with the receipt and the transaction
Separate the work that earned the payment from any later transaction involving the token. The key questions are whether you earned a service fee, received a token through an issuance or reward, or received proceeds for transferring a token you already held. Then establish whether the digital asset meets the applicable VDA definition and who paid and received it.

| Situation | Question to resolve | Relevant VDA rule |
|---|---|---|
| You provide AI or automation services and receive payment | How should the service receipt be classified and, if paid in tokens, valued when received? | Sections 115BBH and 194S concern VDA transfers; they do not by themselves determine the tax category of a service fee. |
| You transfer a qualifying VDA | Did a transfer occur, and what income arose from it? | Section 115BBH addresses income from transfer; section 194S addresses withholding on consideration for a transfer. |
| A platform facilitates a sale or service | Does the platform and arrangement meet the statutory conditions? | Section 194-O may be relevant to an e-commerce operator facilitating sales or services, including digital products; it does not automatically apply to every AI-agent marketplace. |
The Income Tax Department’s VDA definition materials under the Income-tax Act, 1961 and the Department’s Income-tax Act, 2025 definition page describe qualifying digital representations of value, including specified tokens and other covered assets. Whether a particular token qualifies depends on its characteristics and the applicable statutory definition. The materials do not identify AI-agent output or service income itself as a VDA.

What section 115BBH says about a VDA transfer
The Department’s 2026 VDA overview describes income from transfer of VDAs as taxable at 30% plus applicable surcharge and cess under section 115BBH of the Income-tax Act, 1961. Its computation permits the cost of acquisition but not other expenditure or allowances as deductions. The section also restricts setting off VDA-transfer losses against other income and carrying those losses forward. Its transfer rule applies whether or not the VDA is a capital asset.
#1 Best Overall
This is a rule for income from a VDA transfer, not a universal rate for every payment connected with AI services. The service-receipt classification, including where the fee is paid in tokens, is not conclusively settled by the official materials described here.
What section 194S withholding does—and does not do
Section 194S provides for 1% tax deduction at source (TDS) on consideration for transfer of a VDA paid to a resident, subject to the statutory conditions and thresholds. The Department’s TDS rates information gives annual thresholds of ₹50,000 for a specified person and ₹10,000 for other payers. The section also addresses consideration paid wholly or partly in kind, including an exchange for another VDA.
Rank #2
TDS is withholding, not a final decision about the recipient’s income category or final tax computation. A deduction under section 194S does not, on its own, establish that a payment for AI services is income from a VDA transfer.

If you receive tokens as compensation for services and later sell, exchange, gift or otherwise transfer them, the service payment and the later transaction are distinct events to examine. The official materials described here do not conclusively establish how to classify or value a token-denominated service receipt, what valuation date or method applies, or how that receipt interacts with a later disposal. They do not support treating a particular two-step tax formula as settled for AI-agent compensation.
For your circumstances, the contract, the identity of the payer and recipient, whether the token was newly issued or transferred, when and how much value was credited, the token’s characteristics, and any later disposal can all matter. Take those facts to an India-qualified tax professional with VDA experience rather than assuming that a token payment automatically answers the classification question.

The Income Tax Department’s 2026 VDA overview and related materials refer to sections 115BBH and 194S of the Income-tax Act, 1961, while the Department also provides a VDA definition page for the Income-tax Act, 2025. Do not silently combine provisions or assume that the 1961 Act section numbers map directly to the new Act. Confirm which Act and provisions apply to the tax year in question before filing or relying on a section reference.
Quick Recap
Records to gather before deciding how to report the income
- The service agreement, invoice, or other record describing what the AI agent or operator did and what was earned.
- The identity of the payer and recipient, and details of any platform or marketplace that facilitated the payment.
- Whether the receipt was in rupees, foreign currency, or a digital asset; if it was a token, information that identifies the asset and supports whether it may meet the VDA definition.
- The date and amount credited, along with records supporting the value attributed to a token payment.
- Records of any later sale, exchange, gift, or other transfer of the token, including the date and consideration where applicable.
- Any TDS records and facts needed to assess whether section 194S or, for a platform arrangement, section 194-O may apply.
