How to Claim a GST Refund in India: Eligibility, Documents and Steps

GST refund claims in India depend on the statutory ground, its evidence and a category-specific deadline. Here are the common routes, documents and RFD-01 filing steps.

To claim a GST refund in India, first identify the statutory ground for the claim, check its conditions and filing deadline, and gather the evidence required for that category. Most claims are filed electronically in FORM GST RFD-01 through the GST Common Portal. After filing, save the application reference number (ARN), monitor portal notices and processing, and check that the refund bank account passes PFMS validation. The usual limitation period is two years from the applicable “relevant date,” but that date depends on the type of refund.

Who may be eligible for a GST refund?

Having paid GST or having an input tax credit (ITC) balance does not, by itself, establish eligibility. The claim must fit a permitted refund ground, meet its conditions and exclusions, be filed by the appropriate applicant, and be supported by records. Common routes described in the CBIC refund rules and Circular 135/05/2020-GST include:

  • Zero-rated exports: A refund of eligible unutilized ITC may be available for qualifying zero-rated supplies made without payment of integrated tax, subject to statutory conditions and restrictions. In other circumstances, tax paid on export of services may be refundable under the applicable rules.
  • Supplies to an SEZ: Depending on the route and circumstances, a claim may concern eligible unutilized ITC on qualifying supplies made without payment of tax, or tax paid on qualifying supplies to an SEZ.
  • Inverted duty structure: A supplier may be able to claim eligible accumulated ITC when the tax rate on inputs is higher than the rate on output supplies, subject to exclusions and the prescribed formula.
  • Deemed exports: A refund may be available for qualifying deemed-export supplies. The rules identify the recipient as the applicant in specified cases and set out supporting evidence requirements.
  • Excess balance or tax paid: Other grounds include an excess balance in the electronic cash ledger, excess tax paid, or tax paid under an intra-State/inter-State classification later found to be wrong.

These are common categories, not an individual eligibility decision. The correct route can depend on the tax period, return and invoice records, payment details, export or SEZ evidence, and the provisions in force when you file. The CBIC rules and guidance describe the categories and their conditions.

What is the time limit for filing?

Section 54 of the CGST Act sets a general limit of two years from the relevant date for applying for a refund. “Relevant date” is not one universal date: the Act gives different rules for circumstances such as exports, deemed exports, refunds arising from an order, and other claims. Identify the exact refund ground and the corresponding statutory clause before calculating your filing deadline. See section 54 of the CGST Act.

Exceptions or later amendments may affect a particular claim. The linked CBIC page is an enacted-text page and may not reflect every subsequent amendment, so check the current consolidated Act, applicable notifications and the live portal requirements before filing. If the deadline is close or disputed, seek qualified GST advice rather than relying on a general calculation.

What documents and evidence are required?

There is no single document checklist for every refund. The following examples are described in the CBIC rules; the current RFD-01 category prompts and applicable rule wording govern what to submit for an individual claim.

Claim situation Examples of evidence described in the rules
Refund arising from an order or certain appeal deposits Reference to and copy of the relevant order from the proper officer, authority or court, or the relevant payment reference.
Export of goods A statement of shipping bill or bill of export numbers and dates, with the related export invoice numbers and dates. A goods-export claim also has a filing precondition tied to delivery of the export manifest or export report.
Export of services A statement of invoice numbers and dates, with relevant Bank Realisation Certificate (BRC) or Foreign Inward Remittance Certificate (FIRC) details, as applicable.
Supply of goods to an SEZ An invoice statement and evidence of the specified-officer endorsement that the goods were admitted for authorized operations.
Supply of services to an SEZ An invoice statement, endorsement evidence, and details and proof of recipient payment for authorized operations.
Deemed exports An invoice statement and other evidence notified for the category.
Qualifying inverted-duty unutilized ITC An Annexure 1 statement in RFD-01 with invoice details for the period. The rules also prescribe a refund formula and require a debit to the electronic credit ledger for the amount claimed.

Unjust-enrichment evidence may also apply. The rules generally call for a CA or cost accountant certificate for claims above ₹2 lakh stating that the incidence of tax has not been passed on; for claims not exceeding ₹2 lakh, a declaration is generally relevant. The rules provide exceptions for certain statutory cases, so check the applicable provision for the claim.

How to file a GST refund application

  1. Reconcile the claim records. Match the claim amount to the relevant returns, tax payments, invoices, ITC records and category-specific evidence. For an ITC refund, account for the required debit to the electronic credit ledger.
  2. Calculate the limitation date. Apply the relevant-date rule for the particular refund ground, not a date assumed to apply to every claim.
  3. Select the refund category. Choose the route that matches the statutory ground and confirm its conditions, exclusions and supporting-statement requirements.
  4. Submit FORM GST RFD-01 electronically. The refund rules direct applicants to file through the Common Portal, directly or through a facilitation centre notified by the Commissioner. Save the ARN and application receipt. An eligible refund of an electronic cash ledger balance may instead be claimed through the relevant return under the rules. See the CBIC refund rules.
  5. Monitor portal communications. Check the GST Portal for acknowledgement, deficiency communications, notices and processing status. Respond using the applicable procedure and within the time allowed if the officer requests information or identifies a deficiency.
  6. Check bank validation and payment status. Ensure the account entered for the refund is valid and correctly mapped. The GST Portal refund advisory says payment follows bank validation through PFMS. If validation fails, the advisory says you may need to amend registration bank details and use the portal’s “Update Bank Account” function against the ARN.

How to track the application and refund payment

Track the tax-office processing stage and the payment stage separately. Use GST Portal tracking to follow application processing, notices and status; use PFMS to check bank validation and disbursal status. The GST Portal refund-tracking advisory describes these separate checks. Filing an application does not establish a guaranteed real-world payment date; no typical processing duration is specified in the cited official material.
