What Is the Income Tax Appellate Tribunal (ITAT), and How Does an Appeal Work?

India’s Income Tax Appellate Tribunal (ITAT) is a specialist quasi-judicial body that hears certain appeals in income-tax matters, ordinarily after an appeal before the Joint Commissioner (Appeals) or Commissioner (Appeals). To work out whether you can appeal, what deadline applies and which Income Tax Act governs, start with the order you want to challenge, its communication date and the relevant tax year.

What is the Income Tax Appellate Tribunal?

The ITAT is a specialist appellate tribunal for disputes under direct-tax laws. It is generally a later stage in the appeal process, not the first place to challenge an assessment. The route available depends on the type of order and the governing law; not every tax order can be taken to the ITAT.

The Income Tax Department describes appellate powers that can include confirming, reducing, enhancing or annulling an assessment; admitting additional grounds; seeking a remand report; rectifying mistakes; and granting a stay subject to conditions. Which powers matter in a particular case depends on the appeal and the applicable provisions.

Where ITAT fits in the appeal process

Stage What it does
Income-tax authority Issues the order that may be challenged. Identify the issuing authority and order type before choosing an appeal route.
Joint Commissioner (Appeals) or Commissioner (Appeals) Ordinarily hears an earlier appeal before a matter reaches the ITAT.
Income Tax Appellate Tribunal Hears an eligible appeal at the Tribunal stage and issues an order.
High Court A further appeal from an ITAT order is available where a substantial question of law arises; it is not an automatic next appeal in every case.

The ITAT describes its orders as final within the Tribunal system, subject to the High Court route where that legal threshold is met.

How to file and follow an ITAT appeal

The precise filing requirements can vary with the order, applicable provision and current Tribunal instructions. Use the ITAT’s e-filing portal and its current practice note and appeal checklist rather than relying on a generic list of forms or attachments.

  1. Identify the order and applicable law. Record the authority that issued the order, the relevant tax year, and when and how the order was communicated. These facts help establish whether an ITAT appeal is available, which Act applies and how limitation is calculated.
  2. Check the current official filing instructions. On the ITAT e-filing portal, use the assessee login and review the appeal workflow, practice note and checklist for the relevant matter. Confirm the required form, supporting documents, fee, verification and any bench-specific requirements in those instructions.
  3. Submit the appeal and retain the records. Keep the filing acknowledgement and copies of the submitted documents. The exact requirements should be confirmed from the applicable instructions before filing.
  4. Monitor the appeal dashboard. For e-filed matters, the portal dashboard can be used to view filing details, address defects and file documents or petitions. Check it for notices and updates, and act on any defect within the time or manner stated in the relevant notice.
  5. Review the order and any further remedy. Once the ITAT issues its order, consider whether the case raises a substantial question of law that permits an appeal to the High Court.

What is the time limit for an ITAT appeal?

There is no safe universal deadline to apply without checking the order type and governing provision. For appeals under section 253(3) of the Income Tax Act 1961, the amended wording effective from 1 October 2024 is generally described as requiring filing within two months from the end of the month in which the order is communicated. Because the date and manner of communication and the applicable provision affect the calculation, verify the current statutory text and ITAT practice note for your case before relying on that period.

A delay may be condoned if sufficient cause is established, but condonation is not automatic. Do not assume that filing late will be excused; check the applicable procedure and obtain case-specific advice where needed.

Which Income Tax Act applies after 1 April 2026?

The Income Tax Act 2025 commenced on 1 April 2026. The Income Tax Department’s transition guidance says proceedings pending on that date generally continue under the Income Tax Act 1961. It also says proceedings initiated after that date for tax years beginning before 1 April 2026 are governed by the 1961 Act. The commencement of the new Act does not by itself revive an already expired limitation period.

Accordingly, do not select a section number or deadline solely by looking at the date you file. Establish the tax year and whether the proceeding was already pending on 1 April 2026, then check the transition rules and the provision governing the specific order. Matters outside the stated transition cases require their own assessment under the applicable law.

Can you appeal an ITAT order?

A further appeal to the High Court is available when a substantial question of law arises for determination. The ITAT’s description of this route does not make every disagreement with its findings appealable: the applicable statutory requirements and the nature of the issue must be assessed in the particular case.

What to confirm before filing

  • The exact order and issuing authority, and whether that order is appealable before the ITAT.
  • The tax year and whether the 1961 Act or the 2025 Act, including its transition provisions, governs the matter.
  • The communication date and manner, the applicable limitation provision, and the current filing instructions.
  • The current ITAT checklist for the required appeal form, attachments, fee and verification.
  • Whether you are filing an appeal, curing a defect, seeking interim relief, or considering a High Court appeal after an ITAT order.

This is general procedural information, not a determination of the deadline or remedy in an individual case. Consult the applicable legislation and current official Tribunal instructions for the matter before you.
