How to Choose a License-Safe Open-Weight Model for Commercial Use

Open-weight availability does not guarantee commercial permission. Verify the exact model revision, its license and incorporated policies, and any separate terms from a hosted provider.

Choose by the exact model version and its applicable terms—not by a family name, a repository’s download button, or the label “open weight.” Before using a model commercially, verify the license file for the revision you plan to deploy, read any policies it incorporates, and check each condition against your actual use. If inference runs through a hosted service, review that provider’s terms separately.

What makes an open-weight model safe for your commercial use?

There is no family-wide answer. A downloadable set of weights tells you that the files are available; it does not, by itself, establish permission to use them in a revenue-generating product, redistribute them, or build on them. Terms can differ between versions and variants that share a model-family name.

“License-safe” here means that you have identified the applicable terms and verified that they permit your intended activities, subject to their conditions. It is a practical review, not a legal opinion or a guarantee that every legal issue has been resolved.

Which documents should you check?

Start with the exact artifact and revision

Record the model’s exact name, variant, repository, and revision. Locate the license at that revision, rather than relying on a family overview, a third-party summary, or a license file from another version. Save the license and model card with your evaluation and deployment records so you can identify the terms that informed the decision.

Follow incorporated policies and extra conditions

Read the model card and the license together. If the license incorporates an acceptable-use policy or other document, check that document too, including the revision that applies. Look for conditions stated outside a simple “commercial use allowed” label: notices, attribution, branding, naming rules, scale thresholds, restrictions on certain uses, and requirements to obtain additional permission.

Check the deployment contract separately

If you use a managed platform or hosted inference API, review the actual provider and plan terms as well as the model’s terms. The model license and service contract are separate layers; permission to use the weights does not settle what a provider permits or requires for its service.

How should you compare candidate licenses?

Use one row per exact model revision. Answer each question from the applicable documents, and record the source and revision beside the answer. If a term is not stated or you cannot verify it, write “not stated” and resolve the gap before deployment rather than treating silence as permission.

What to compare Question to answer Why it matters
Identity and version What exact model, variant, repository, and revision are being evaluated? Terms may differ between versions or variants with the same family label.
Commercial grant Does the agreement authorize the planned revenue-generating use, or require an application or separate permission? Weight availability is not itself a commercial-use grant.
Modification and redistribution Can you modify or redistribute the weights or derivatives? Must you include terms, notices, attribution, or modification markings? Internal use, fine-tuning, and distributing a model or product can trigger different obligations.
Business or scale triggers Do user counts, revenue, product categories, or other thresholds require extra permission, branding, or steps? A general commercial grant may be qualified by a threshold or type of business.
Use policies Does the license incorporate an acceptable-use policy or other restrictions, and which version applies? Reading only the license text can miss binding conditions referenced elsewhere.
Outputs and derivative models Do the terms address outputs, or using outputs to train or improve another model? Do not assume that an output-ownership statement resolves obligations for model improvement; check the exact terms.
Deployment route Will you self-host the weights or use hosted inference? What does the service provider’s contract add? The service agreement can impose conditions separate from the model license.
Geography and compliance Are there territory exclusions, sanctions, export-control, or governing-law terms relevant to your operation? Permission and compliance questions can depend on where the operator and users are located.

What do version-specific terms look like in practice?

Example and source What the source establishes How to use the example
Llama 3.1 Community License Agreement, Meta Platforms, released July 23, 2024, section 1(a) The agreement grants a non-exclusive, worldwide, non-transferable, royalty-free limited license under Meta’s relevant rights to use, reproduce, distribute, copy, create derivative works of, and modify the Llama Materials. It also incorporates the Llama Acceptable Use Policy and sets redistribution conditions. For this release, a licensee or affiliate that exceeded 700 million monthly active users in the preceding calendar month as of the release date must request a separate license from Meta. Review the full agreement and incorporated policy for the exact release you intend to use. The 700-million-user trigger is specific to this agreement; do not apply it to other Llama versions or model families.
Qwen repository README The README distinguishes code licensing from model-weight licensing and directs commercial users to the agreement accompanying each model. It identifies some legacy Qwen variants for which commercial use required applying or contacting the provider. Treat this as a warning to check the individual model’s agreement, not as a complete description of current Qwen releases.
OpenWeightModels.eu registry snapshot, 2026 In its reviewed 32-model sample, the registry records 23 models as commercially allowed, one with a special condition, and eight as conditional. These are counts from the registry’s own reviewed sample, not a market-wide estimate. Its official-license, policy, provider-terms, and applicable-law caveat still applies.

The examples show why a family name or shorthand label cannot settle the question. Even where a license allows commercial activity, duties concerning redistribution, branding, naming, incorporated policies, or additional permissions may still shape whether that particular use works for your product.

How do you verify a model before deployment?

  1. Pin the candidate. Record the exact repository, model name, variant, and revision used in evaluation; use the same identified artifact for the production decision.
  2. Save the governing documents. Keep the revision-specific license and model card with the deployment record.
  3. Trace every reference. Find incorporated policies and additional agreements, then note which version applies.
  4. Describe the real use. Specify whether the model is for internal work, a hosted product, redistribution of weights, a fine-tuned or embedded derivative, or training and improving another model with outputs.
  5. Map terms to activities. Check the commercial grant, redistribution and modification duties, notices or branding, thresholds, use restrictions, output provisions, and relevant territory or trade-compliance terms against that description.
  6. Review any service contract. If a provider hosts inference, check the actual provider and plan terms in addition to the model documents.
  7. Resolve material gaps. If permission or an obligation is unclear—especially for a consequential deployment—get advice from qualified counsel before proceeding.
  8. Repeat on upgrades. Recheck the documents whenever you change model versions; do not assume terms remain identical within a family.

When is a candidate ready to use?

A candidate is ready for your decision only when the exact artifact is identified, the applicable license and incorporated policies are on file, and each planned activity has been checked against their conditions. Record any separate provider terms and unresolved questions alongside the decision. If a material term remains uncertain, pause that use until you have clarified it rather than inferring permission from the fact that weights can be downloaded.

Terms can change. Confirm the current agreement for the exact model and revision before use; the examples above describe the named sources and releases, not every model or provider available as of October 4, 2026.
