There is no universal yes-or-no rule. A mural visible in a public place may still be copyrighted artwork, and an exception that permits photographs of some buildings or sculptures may not cover a painted mural. Before you take, post, license, advertise with, or print a mural photograph, identify the country and the exact use. Check the local copyright exception and the location’s photography rules. If the law does not clearly cover your use, identify the rights holder and obtain written permission.
Why a public mural can still be protected
“Public” describes where people can see the mural; it does not automatically describe who may reproduce it. An original painting is generally a visual artwork protected by copyright. Copyright normally gives the creator, or a person or organisation that acquired the rights, control over specified reproductions, communications and other uses, subject to the exceptions in the law that applies.

The U.S. Copyright Office explains that original visual art, including paintings, can be protected when it is fixed in a tangible form. The artist is generally the initial copyright owner, although a work-made-for-hire arrangement or a written assignment can change who controls the rights. A city, developer, property owner or arts organisation may have commissioned the mural without owning every copyright interest, so do not infer ownership from the wall or the funding plaque.

The U.S. Copyright Office states: “The public display of artwork, in and of itself, does not constitute publication.” Seeing a mural from a pavement therefore does not by itself grant permission to reproduce its image.

The photograph and the mural are separate works
Your camera may create a second copyright work, but that does not erase the first one. An original photograph can be protected and the person who takes it is generally its initial copyright owner. The mural artist, commissioning party or another assignee may still control rights in the artwork depicted in the photograph.
Think of two permissions rather than one:
- Photograph rights: whether you are entitled to make and use your particular photo.
- Mural rights: whether your photo reproduces a protected two-dimensional artwork in a way the relevant law reserves to its rights holder.
You might own the camera image and still need clearance to place that image in an advertisement, sell it on merchandise or license it to a publisher. Conversely, permission from the mural artist does not necessarily resolve a restriction imposed by the site where you took the picture.
Decide what you will do with the image
“Can I take a picture?” is too broad a question for a reliable answer. Write down the intended use before checking the law, because an exception that covers one activity may not cover another.

| Private keeping | Will the file stay in your personal archive, with no public sharing? | Private capture and storage may be treated differently from public communication or commercial reproduction, but you still need to check the local rule. |
| Social posting | Will the mural be recognisable or the main subject, and is the account monetised or sponsored? | Uploading makes the image available to others. A personal post and a paid campaign can have different legal and contractual consequences. |
| Editorial publication | Will a news story, blog, book or documentary feature the mural prominently? | Some jurisdictions have exceptions or defences for particular reporting or incidental uses; they are not universal and may have conditions. |
| Licensing or stock sale | Will you grant customers permission to reuse the photo? | A licence from you cannot grant rights you do not possess in the mural itself. |
| Advertising or branding | Will the mural appear in an ad, sponsored post, packaging or a company’s promotional material? | Commercial-use limits are common in public-art exceptions. Obtain explicit clearance when the mural is a recognisable feature. |
| Merchandise | Will the image be printed on clothing, posters, phone cases or other products? | Repeated sales and distribution are high-risk uses when the artwork is the product’s visual subject. |
A six-step check before you publish or sell
1. Pin down the jurisdiction
Record the country in which the mural is located and, where relevant, the territory, state, province or locality. If the image will be published, streamed, licensed or sold in several countries, check the important destination markets as well as the place where you took the photograph. Copyright exceptions are territorial; a permission or defence in one country does not automatically travel with the file.

Use the current text of the relevant government copyright legislation or copyright-office guidance. Search for provisions described as freedom of panorama, public-art, incidental-use or similar, but read the operative wording rather than relying on the label.
2. Describe the image and the use precisely
Note whether the mural is the principal subject, how much of it is visible, whether you will crop or edit the picture, where it will appear, how long it will remain available, and whether money, sponsorship or a licence is involved. Keep this description with your records; it makes a permission request and a legal review much more specific.
3. Treat the mural as potentially protected
Assume an original mural requires a copyright check unless you have a clear reason not to. Look for the artist’s name, a commissioning plaque, a project website, municipal arts records or a building owner’s documentation. Ask whether the artist assigned rights, created the work under a work-made-for-hire arrangement, or retained rights under a commission contract. Do not rely on a statement that the artwork was “paid for” unless the underlying agreement says what rights changed hands.
4. Read the actual local exception
Check every condition: the types of works covered, whether the work must be permanently situated in a public place, whether the exception concerns only making a photograph or also distributing and communicating it, and whether commercial activity is excluded. The examples below show why the exact categories matter.

5. Check access and site rules separately
A mural can be visible from a public street while standing on private property, inside a venue or behind a controlled entrance. Look for posted photography rules, ticket terms, lease or venue conditions, and instructions from the property or site manager. Copyright permission does not authorise trespass, and a site rule does not by itself settle the mural’s copyright.
6. Ask the rights holder when the answer is unclear
If the exception does not clearly cover the mural and your intended use, pause the public or commercial use and seek permission. Government licensing guidance in the United Kingdom recommends checking copyright status and making a diligent search for the owner when a licence is needed. Keep a written record of who granted permission and what was agreed.
Freedom of panorama is not one worldwide rule
The phrase “freedom of panorama” is often used for exceptions concerning photographs or other images of works permanently located in public places. It does not have a single international definition. Laws can distinguish buildings from sculptures, three-dimensional works from graphic works, and personal or non-commercial activity from advertising and other commercial exploitation. Some rules permit the making of an image but impose separate limits on distribution or communication.
| Jurisdictional example | What the cited rule covers | What it means for a mural photograph |
|---|---|---|
| United States | Copyright Office guidance recognises that paintings and other original visual art may be protected. The guidance does not create a blanket permission for every public mural photograph. | Check the statutory exception that actually applies to your use. Public visibility alone is not a safe substitute for that analysis. |
| United Kingdom | Copyright, Designs and Patents Act section 62 lists buildings and specified permanently situated sculptures, models for buildings and works of artistic craftsmanship. | The enumerated categories do not list paintings or murals. Do not assume section 62 covers a painted wall. The provision says the copyright in a covered work is not infringed by making a graphic work representing it, making a photograph or film of it, or making a broadcast of a visual image of it; first establish that the mural fits a listed category. |
| Canada | The cited section 32.2 exception covers architecture and certain permanently situated sculptures or works of artistic craftsmanship. | Because the listed categories are specific, determine whether the artwork is within them before relying on the exception. A two-dimensional mural should not be treated as covered without checking the current statutory wording. |
| Belgium | Official guidance describes an exception for visual, graphic or architectural art permanently situated in public places, and states that the described exception is for non-commercial use. | A personal or other non-commercial context may be treated differently from advertising, sales or licensing. Verify the current conditions and whether your activity is commercial. |
These are examples, not a complete country-by-country survey. Even where an exception mentions public places, check permanence, the work category and the acts permitted. A rule that lets you make a photograph may not answer whether you may sell copies, upload it to a monetised service or authorise another company to use it.

How to investigate the rights holder
Start with the wall and the commissioning trail
- Photograph or transcribe any artist signature, plaque, project name or sponsor information.
- Ask the property owner, local arts office, public-art programme or building manager who commissioned the work.
- Search the artist’s official portfolio or representation for licensing instructions.
- Check whether a collective, estate, gallery or agency administers permissions for the artist.
- For a community project, ask the organiser which agreement governs reproduction and whether several artists contributed.
Ownership can be divided. One party may own the physical wall, another may have commissioned the mural, and the artist may retain copyright. Ask specifically who can license the reproduction you need, not merely who paid for the paint.
Make a diligent search
Keep a dated log of the places you checked and the people you contacted. Record unanswered emails, returned mail and any public statement about the work’s status. If you eventually rely on an orphan-work or similar process, the requirements are jurisdiction-specific; a casual internet search is not automatically sufficient.
Put permission in writing
A useful permission record identifies:
- the mural, artist and rights holder;
- the exact photograph or the permitted framing of the mural;
- the media and platforms, such as a website, print publication, social account or packaging;
- territory and duration;
- whether the use is commercial, sponsored, editorial or personal;
- any fee, credit line or attribution requirement;
- permitted cropping, colour changes or other edits; and
- whether you may sublicense the image or allow customers to reuse it.
Save the signed licence, the email chain and the final approved image. If the rights holder grants only a one-time post or a specified campaign, do not silently extend it to merchandise, paid promotion or a new territory.
Common situations and the safer approach
“I only want a holiday snapshot.”
Take the jurisdiction and site rules into account first. If the file will remain private, the practical risk is usually different from public or commercial use, but do not describe private capture as universally authorised. A sign prohibiting photography or a controlled site can still matter.
Best Value
“Can I post it on Instagram or another social platform?”
Posting is a public communication, not merely storing a personal photograph. Check whether the mural is the dominant subject, whether your account or post is sponsored or monetised, and whether the platform’s terms require you to have the necessary rights. If the local exception is limited to non-commercial activity or does not clearly include murals, ask the rights holder before posting.
“Can a news article show the mural?”
Editorial context can be relevant, but it is not a universal exemption. Determine whether the mural is necessary to the story, whether it is incidental background or the principal image, and what the local law says about reporting, quotation or incidental inclusion. When the mural is the focus of a feature, obtain clearance unless a clearly applicable exception supports the use.
“Can I use the photo in an advertisement?”
Assume that a recognisable mural used to sell or promote a product needs permission unless the governing law plainly provides otherwise. Tell the rights holder the campaign, channels, countries, run dates, edits and paid-media plans. A licence for editorial publication is not automatically a licence for advertising.
“Can I print it on shirts or posters?”
Merchandise makes the image part of a product offered for sale, so it is a distinct commercial use. Obtain a licence covering manufacturing, distribution, sales territories, duration and any minimum or continuing royalty terms. Do not rely on permission to post a low-resolution image online.
“The mural is only in the background. Does that solve it?”
Not necessarily. Some jurisdictions recognise incidental-use rules, while others do not or impose conditions. Describe how much of the mural is visible and whether viewers are expected to notice it, then check the local provision instead of assuming that background placement is harmless.
If you already took or posted the photograph
- Preserve the original file and note when and where it was captured.
- Review the site’s rules and the law for the country involved.
- If the use is public or commercial and clearance is uncertain, pause paid promotion, sales or further licensing while you investigate.
- Contact the likely rights holder with a precise description of the use and ask whether a retrospective licence is available.
- If you receive a complaint, save the notice, do not make admissions you cannot verify, and obtain advice from a lawyer qualified in the relevant jurisdiction when the stakes are material.
Removing a post may reduce ongoing exposure, but it does not decide whether the earlier use was authorised or whether a claim remains. Treat takedown, negotiation and legal advice as separate decisions.
A decision checklist
- Have you recorded the mural’s country and any relevant territory or locality?
- Have you written down the exact use, audience, platforms, duration and commercial context?
- Have you treated the mural as a potentially protected painting rather than assuming that public visibility grants permission?
- Have you checked the current statutory text for the precise work category, permanence and permitted acts?
- Have you checked access, venue and property rules independently of copyright?
- Have you identified the artist, assignee or licensing organisation, or documented a diligent search?
- Does your written permission cover the exact image, edits, media, territory, duration and commercial purpose?
- If uncertainty remains and the stakes are significant, have you obtained jurisdiction-specific legal advice?
The practical rule is simple: a public wall is not a universal licence. Clear the mural rights and the location rules separately, and match any permission or statutory exception to the way you will actually use the photograph.
