To check whether an NVIDIA GPU is restricted for export to China, identify the exact product and part number, confirm its current export classification, then apply the relevant U.S. export rules to the destination, all parties, ownership, end user, and end use. A model name alone—or a clean screening result—cannot establish that a particular shipment is authorized.
1. Identify the exact GPU and configuration
Start with the product family, model, and manufacturer part number. Record whether the transaction involves an individual accelerator, a board, or a complete system containing advanced computing integrated circuits. Do not assume that a consumer GeForce card, a professional RTX product, and a data-center accelerator share an export classification just because they carry the NVIDIA name.

NVIDIA’s export-regulation page includes a searchable parts-classification resource with fields such as ECCN and other import/export information. NVIDIA describes those entries as informational: they may change without notice and are not a representation or warranty that a classification is correct. Use the lookup as a starting point, not the final authorization decision.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitches2. Confirm whether the item is subject to the EAR and find its ECCN
The U.S. Department of Commerce’s Bureau of Industry and Security (BIS) says the first classification questions are whether the item is subject to the Export Administration Regulations (EAR, 15 CFR parts 730–774) and, if so, what Export Control Classification Number (ECCN) applies. An ECCN is a key input to determining whether an export license is required; it is not an HTS or Schedule B customs code.

Ways to establish the classification
- Ask NVIDIA or the manufacturer. Request the classification for the exact part number and configuration, and check when the information was issued.
- Self-classify if qualified. Use the current Commerce Control List and its order-of-review process to compare the item’s technical characteristics with the relevant entries.
- Request a BIS classification. BIS accepts classification requests through SNAP-R. This is an official classification route, but it does not decide every other licensing issue in a transaction.
Compare any manufacturer result with the current Commerce Control List because ECCNs can change. If an item subject to the EAR is not described by an ECCN, it is generally classified as EAR99. EAR99 does not mean “unrestricted”: a license can still be required because of the destination, a restricted party, or the end use.
3. Apply the classification to China and the specific item rules
Use the ECCN’s reasons for control together with BIS country guidance and the current Commerce Country Chart to assess the destination. The Country Chart is a general reference, not a complete answer for advanced-computing products. Read the current EAR provisions that specifically address advanced computing and exports to China or Macau, along with any applicable review policy or additional restrictions.

The result depends on the exact item and the applicable rule, not simply on whether the destination is China. Do not infer that a GPU is permitted or prohibited from a Country Chart entry alone, or from the status of another NVIDIA model.

Screen all transaction parties against the U.S. government’s Consolidated Screening List and the applicable BIS restricted-party lists. Include the buyer, seller, intermediaries, consignee, and end user; a name-screening result is only one part of the analysis.

Look beyond the buyer’s name
- Identify the ultimate consignee and the actual end user, not just the party placing the order.
- Determine where the buyer’s ultimate parent is headquartered. BIS guidance dated May 31, 2026 says a license requirement applies to specified advanced-computing items exported to an entity headquartered in Country Group D:5 or Macau, or whose ultimate parent is headquartered there, even when the entity itself is located elsewhere.
- Describe the intended use and assess whether it involves a restricted military, military-intelligence, or weapons-of-mass-destruction-related activity. BIS’s AI counter-diversion guidance explains that knowledge of certain such AI-training uses may trigger controls.
- Consider remote access, onward transfer, and diversion circumstances where they are relevant under the current rules.
Being absent from a screening list does not by itself establish that the export is authorized; the item, destination, ownership, and end-use rules still apply.
5. Determine the authorization path and document the decision
Once the item classification and transaction facts are established, consult the current EAR text for the license requirement, applicable review policy, and any available authorization. BIS Part 740 describes license exceptions, which can authorize exports or re-exports that would otherwise require a license, but only when every condition of the relevant exception is met.

What the 2026 H200 announcement does—and does not—mean
On January 13, 2026, BIS announced that applications to export NVIDIA H200, AMD MI325X, and similar chips could be reviewed case by case if stated security requirements were met. BIS described conditions applicants must demonstrate, including customer compliance procedures and independent testing. This is a conditional license-review policy, not blanket permission to sell or ship H200 GPUs to China and not evidence that any particular shipment has received a license. The applicable final rule and current EAR text govern an individual transaction.
